SUMMARY OF CHANGES

AMENDMENT 004

AMENDMENT 004 is issued to incorporate the following changes and answer PPI questions:

The proposal due date will be changed from March 9th; to March 19, 2015 there will be another follow on Amendment to answer questions not yet obtained.

Question: FUEL CELLS RE. Specification Section 48 18 13.0050 We have noticed an inconsistency in the specification: Section 1.6.3 describes a product with 300 kW output, but section 2.3.4 describes a 400 kW system. 2. Paragraph 1.3 reads: “The powerplant system shall operate on natural gas and anaerobic digester gas as the fuel source” Does it mean we will blend the gas?

Answer: 1. Provide fuel cell with 400 kW output. 2. Fuel cell shall operate on natural gas only.

Anaerobic digester gas operation is not required.

Question: (Include RFP Section, page number, and paragraph if applicable)

In Specs Vol 1- SECTION 01 32 17.00 20 Part 1.4 Page 2 it is stated that:

Project schedules must be prepared and maintained using Primavera P3, Primavera SureTrak or current mandated scheduling program.

Please clarify if at the proposal phase it is allowed to use different scheduling software as MSP (Microsoft Project) and provide USG with the required source file document in .mpp, accordingly.

Answer:

Microsoft Project will not be acceptable. Please use Primavera as specified in SECTION 01 32

17.00 20; Part 1.4; Page 2.

Question: (Include RFP Section, page number, and paragraph if applicable)

In regards to the LEED documentation, paragraph 1.3.1 of section 01 33 29 states that the US Government will register the project with the USGBC, but who is responsible for collecting, downloading, and submitting all documentation to the USGBC through LEED Online, including all associated submittal fees?

Answer: The contractor is responsible for collecting, downloading, and submitting all documentation for Construction Credits, which are all credits included in the LEED construction submittal, to the USGBC through LEED Online. But there are other parties responsible for uploading some data in these credits as well, the Commissioning for example. All LEED Review fees will be paid by the Government.

Question: (Include RFP Section, page number, and paragraph if applicable)

In paragraph 1.3 of Section 01 33 29, it states that no variation to the LEED Scorecard nominated as “Table 1” in the LEED documentation specification is to be allowed. What if the Contractor notes an error in the attempted credits noted in the scorecard? Is the Contractor allowed to suggest additional credits (either design or construction) that were not previously considered or believed to be unachievable?

Answer:

Contractor is responsible for corrections only to Construction Credits. The Contractor may suggest additional credits not previously considered, but may not remove or delete any Construction Credits already designated to be achieved.

Question: (Include RFP Section, page number, and paragraph if applicable)

The LEED Scorecard in Section 01 33 29, indicates that Enhanced Commissioning will be attempted. Does this imply that the Contractor is not responsible in providing the Commissioning Authority for the construction phase? That is, that the government has already nominated a Commissioning Authority during the design phase that will be used throughout the construction phase as well?

Answer:

Correct, while the Contractor is responsible for achieving the required Commissioning utilizing a Commissioning Manager who is hired by the contractor, the contractor is not responsible for providing the Commissioning Authority. The Government will provide the Commissioning Authority which may or may not be the same as the Commissioning Authority used during Design.

Question: What field experience and expertise does the SSHO person have to have?

Answer:

SSHO Experience is defined by EM 38511 and all its sub paragraphs:

3.Basis of Evaluation and Submittal Requirements for Each Factor

We received the amendment No. 3 and I demand more simply regarding a permanent Consortium

EXAMPLE

The permanent Consortium includes 5 Companies :

Company “A” Does not have the requirement requested in the solicitation (He has not done no. 3 similar projects required of $. 6,000,000.00 in the last 7 years and has not the SOA for categories and amount required)

Company “B” Does not have the requirement requested in the solicitation (He has not done no. 3 similar projects required of $. 6,000,000.00 in the last 7 years and has not the SOA for categories and amount required)

Company “C” Does not have the requirement requested in the solicitation (He has not done no. 3 similar projects required of $. 6,000,000.00 in the last 7 years and has not the SOA for categories and amount required)

Company “D” HAS THE REQUESTED REQUIREMENTS

Company “E” Does not have the requirement requested in the solicitation (He has not done no. 3 similar projects required of $. 6,000,000.00 in the last 7 years and has not the SOA for categories and amount required)

The permanent Consortium designates companies “A” and “B” to do the job indicates in this Solicitation BUT The companies “A” and “B” does not have the necessary requirements requested in the Solicitation (They have not performed no. 3 similar project required of $. 6,000,000.00 in the last 7 years and have not the SOA for categories and/or amount required)

The Company “D” , that have the requirement requested decides to participate alone OUTSIDE

THE PERMANENT CONSORTIUM.

THE PERMANENT CONSORTIUM MAY PARTECIPATE WITH DESIGNATED

COMPANIES “A” AND “B” WHO DO NOT HAVE THE REQUIREMENT

REQUESTED IN THE SOLICITATION ?

THE PERMANENT CONSORTIUM MAY PARTECIPATE IF THE ONLY COMPANY

(COMPANY “D”) , THAT HAVE THE REQUIREMENT REQUESTED, PARTECIPATES

ALONE OUTSIDE AND NOT IN THE PERMANENT CONSORTIUM AT THE SAME

SOLICITATION ?

Please clarify

Answer: If Company D wants to participate with designated companies A and B and A and B do not have the qualifications of the solicitation then this would be a deficiency and not be eligible for award. The Consortium doesn't qualify to bid if the sum of all the qualifications held by each individual company of the Consortium doesn't equal the amount required by the solicitation in a peculiar work category.
