lll. Amendment No.0001 Response to RFIs
1. Please confirm that proposal submission requirements of paragraph (3) include the following two (2) elements:
A Certified Public Accountant (CPA) must issue directly to the Contracting Officer by the submission date of the initial proposals confirming offeror’s accounting system provides for the four (4) accounting functions specified.
Offeror must submit disclosures per FAR 52.230-1 and FAR 52.230-7.
Government Response: Correct. Both require submissions due with proposal submission.
2. Please confirm the Government intends to issue a firm-fixed price contract for Design Phase Services as the basis of the initial contract award.
Government Response: Correct.
3. Understanding the Government intends to issue a firm-fixed price contract for the Design Phase Services as the basis of the initial contract award, provided a Certified Public Accountant (CPA) confirms offeror’s accounting system is GAAP compliant, and given the Contracting Officer will not exercise the GMP
Option until the Construction Documents are at least 75% complete, is it acceptable for offeror to provide the information related to FAR 52.230-1 and FAR 52.230-7 concurrently with the bid guarantee
(90 days prior to the exercise of the Construction Option)?
Government Response: Negative, the documents must be provided along with the initial proposal submission.
4. For this solicitation and award of contract, will the Government consider a firm-fixed price conversion either prior to, during or after entering the Construction Phase Option of the contract?
Government Response: The Government can and will consider a firm fixed price conversion either prior to, during or after entering the Construction Phase Option of the contract. However, in accordance with Paragraph IV.B, FAR 52.216-1, Type of Contract, in the Solicitation, the contract being contemplated and what will be awarded is a Guaranteed Maximum Price (GMP) with Construction Contingency Allowance and Shared Shavings contract. Therefore, converting to a firm fixed price contract is at the discretion of the Contracting Officer.
5. Reference the May 25, 2017 Pre-proposal information and instructions (presentation slide 15), the
Agreement (page 17) and solicitation (page 16):
o Please clarify that for this project any personnel planned to have management interface via ePM must have and/or obtain HSPD-12 clearance(s) and that construction personnel are not required to have
HSPD-12, or any other background check, clearance(s) for site access until after the Government takes custody of the facility.
Government Response: Any personnel planned to utilize ePM and/or any other Government owned information systems will be required to have and/or obtain HSPD 12 clearance(s) prior to granting access to such system. Personnel not planned to utilize ePM and/or any other Government owned information systems will be required to have an HSPD 12 clearance only if access to the building post substantial completion is required.
6. Please confirm that all commissioning requirements for this scope of work are included as part of the solicitation documents.
Government Response: The CMc scope of work addresses general commissioning requirements.
Specification sections dictating specific commissioning requirements have not yet been developed. In addition, the Commissioning Plan for the project has not been developed. The CMc contractor should expect to fully commission all building systems in accordance with the standards referenced in Division 1, Section 019113.
7. For the purposes of this proposal and based upon the structural / blast concept design narratives, should
CMc assume perimeter protection is to achieve ASTM F 2656 rating PU-40 throughout, if not please specify perimeter protection requirements.
Government Response: At this time, that is correct.
8. Please confirm the two covered walkways are outside of the blast zone and that those structures will not be subject to meeting blast, progressive collapse requirements.
Government Response: At this time, that is correct.
9. Please provide an updated document or narrative indicating where each of the secured roll-up doors / grilles are to be located the parking structure.
Government Response: Standard coiling doors are to be at the Judges’ secured parking and at the USMS Vehicle Sallyport. Prefinished, high-speed insulated roll-up doors are to be located at the entrance/ exit to the parking garage from E. Coffee Street.
10. Please confirm the integration scope of work for all security and security interfacing systems (gate arms, roll-up doors, cameras, etc.) for perimeter and interior is to be part of the CMc scope of work.
Government Response: Gates and barriers, overhead doors, and other items similar to those within the base work will be required to be controlled (via buttons/panels, overhead doors relays, vehicle loops, etc.)
and integrated by the CMc, typically back to the USMS command and control room and guard booth.
Perimeter cameras, keycard readers, etc. are to be integrated and installed by the CMc contractor. Interior cameras, keycard readers, duress buttons, etc. for Courts and USMS occupied spaces will be installed and integrated by the Security Installer which is outside the base work.
11. Please delineate which scope(s) of work related to Telecommunications, Data, Audio/Visual and other non-security related low voltage wiring and systems are to be part of the CMc scope of work.
Government Response: The CMc shall be responsible for the infrastructure for Telecommunications, Data, Audio/Visual and other non-security related low voltage systems. The cost for the infrastructure for these systems is included in the maximum budget amount of $80,000,000 stated in Paragraph I.E. of the Solicitation. The CMc may also be requested to procure and install the necessary wiring and equipment for Telecommunications, Data, Audio/Visual and other non-security related low voltage systems. This work would be added to the CMc contract via a contract modification and would be funded outside of the $80,000,000.
12. Please confirm that all fixed furnishings (bookcases, shelves, jury seating, etc.) are to be part of the CMc scope of services and that all non-fixed furnishings (removable seating, chairs, shelving, etc.) are by
Others.
Government Response: The CMc scope of work includes all fixed furnishings and courtroom jury box seating. Within the Courtrooms, the evidence cabinet and recording equipment cabinet are also included in the CMc scope of work; these may or may not be fixed furnishings. Please reference Chapter 12 of the U.S. Courts Design Guide, Tenant Improvements and Furnishings.
13. Related to above, specific to courtroom furnishings, please advise whether attorneys tables, lecterns and jury seating are to be part of the CMc scope of work.
Government Response: The attorney tables, lecterns and jury seating are to be a part of the CMc scope of work.
14. For Circuit Library and Study spaces please advise what elements of FFE are to be a part of the CMc scope of work.
Government Response: For Circuit Library and study spaces "casework/millwork" such as the circulation desk are to be included in the CMc scope of work (reference Chapter 12 of the U.S. Courts Design Guide). The study tables and shelving in the library stack areas are "furnishings" and will be by others.
15. Please clarify whether shelving shown on the final concept drawings in judge’s chamber offices, clerk offices, conference / library in chambers, and Circuit Library are to be built-in or government furnished items.
Government Response: The shelving shown on the final concept drawings in judge’s chamber offices, law clerk offices and conference/library in chambers are custom design, but modularly built shelving units that are fastened to the wall - the basis of design is page 19 of the 4/18/17 finish development booklet. In accordance with Chapter 12 of the U.S. Courts Design Guide, 20 ranges of fixed bookcases with adjustable shelving shall be provided for each district judge’s chambers and 10 ranges of fixed bookcases with adjustable shelving shall be provided for each magistrate judge’s chamber. In future development, the quantity and configuration may change per some of the alternate designs in the booklet. For the Circuit Library space, the circulation desk and millwork for the technical services area are built ins. Please reference Chapter 12 of the U.S. Courts Design Guide..
16. Please confirm that all workstations / modular work spaces are by others.
17. Please confirm custom pews (to match courtroom millwork) are to be installed as part of the CMc scope of work.
18. Due to the dense frame and building materials please advise whether an internal (UHF or similar) antennae will be required as part of the USMS installed within the building for communication(s) requirements.
Government Response: At this time, we do not know of such requirement.
19. Will the courtroom windows be required / designed to achieve the wall STC ratings or a lower rating?
Government Response: The window STC is determined by calculation, with a design assembly called out and detailed in the drawings to be built by the millwork contractor or alternatively a wood window manufacturer, but will not necessarily be a tested assembly. It will be at least 2 sheets of glass with an airspace in between.
20. Please advise if any of the stairwells are to receive finishes above unfinished concrete and standard painted steel.
Government Response: The walls shall be painted/filled concrete and the stairs shall be painted steel.
21. There is reference to raised flooring and extent of raised flooring on one of the reflected ceiling plans.
Please advise via drawing or narrative the full extent of raised flooring requirements for the facility.
Government Response: The extent of raised flooring will be within each courtroom and Jury Assembly, which is a placeholder for a future courtroom in the 30 year plan. Additionally the probation and clerks server rooms, and the USMS command and control and security equipment room shall receive raised flooring.
22. Per the US Courts Design guide (related to Judges), which exterior windows should be subject to ballistic provisions in addition to blast loading?
Government Response: The exterior windows located at the 2nd floor Visiting Judge’s Chamber and 2nd floor Shared Judges’ Conference Room will be required to be ballistic. However, the cost for the ballistic glazing is outside of the $80,000,000. This will be funded via a Reimbursable Work Authorization (RWA).
23. From the HBRA final concept drawing labeled “Basement / Parking Plan” it is understood there are operable grilles / gates / rollup doors at the main entrance & exit to the basement parking area and the
USMS Sallyport. Other locations are unclear but we assume there is at least one other case at the Judges
Parking. Please confirm these three locations and advise if others exist.
Government Response: This is correct. Roll up doors are to be located at the entrance/ exit to the parking garage from E. Coffee Street, at the Judges’ secured parking and at the USMS Vehicle Sallyport.
24. Are there any unique rough-ins to consider for the courtrooms relating to projectors, projection screens, video monitors at the jury box, or other audio / visual items?
Government Response: There are no projection systems planned. Jury boxes will have monitors, attorney tables and benches will have connections for AV.
25. The HBRA Tenant Finish Development document shows Public Corridor and Lobby finishes but does not indicate whether to apply these to the pair of main stairs on either side of the lobby / atrium. Please clarify whether these stairs will receive the ornamental finishes similar to the lobby and corridors or if their primary purpose is egress and finishes will be non-ornamental.
Government Response: The finishes do not apply to the inside of the stairs.
26. Section II.D Factor #2 Past Performance and Experience. Will projects submitted for Factor #2 Past Performance and Experience located within the area for which the project is being built (“Area” is defined by Factor #4 Geographic / Market Presence) be evaluated and/or rated higher and/or as more favorable than projects that are not located within the “Area”?
Government Response: No.
27. Section II.D Factor #2 Past Performance and Experience. For this solicitation will the Government consider a hospital as a “similar Class A building” provided it meets the other stated requirements?
Hospitals are highly complex facilities sharing many similar features with courthouses such as physical security, access control, robust HVAC, STC requirements and others. Hospitals also meet the BOMA Class A requirements of high quality standard finishes, state of the art systems, exceptional accessibility, and a definite market presence.
Government Response: Yes, the Government will consider a hospital as a “similar Class A building” provided it meets the other stated requirements for a similar project as defined in the Solicitation.
28. The concept design appears to indicate that the exterior wall backup is concrete. Please confirm that this is intended to be precast concrete.
Government Response: The exterior back-up wall is currently assumed to be cast-in-place concrete.
29. Please provide the REVIT (BIM) file for use by the offerors in support of preparing the cost and technical proposal submissions.
Government Response: The REVIT (BIM) model can be obtained by sending an email request to the GSA Contracting Officer (CO). The GSA CO will provide offerors with the url link and password for downloading the model.
30. Please clarify whether “Section II.E Other Information” should be included with the “Technical Proposal” or “Price Proposal”.
Government Response: The other information should be submitted along with the Technical Proposal.
31. There is currently double coverage within the CMa scope of work and the CMc scope of work with regards to Partnering and Partnering Facilitator. Please clarify which entity (CMa or CMc) will have the lead and responsibility for partnering in both Design and Construction Phases for this project. If the CMa will have responsibility for leading and facilitating partnering, please issue an amended SF 1442, Attachment “A” Pricing Schedule removing the firm-fixed price, unit pricing per partnering session. If CMc is to provide the service please confirm that the CMc Statement of Work section III.C.9. Partnering, please provide the Contracting Officer approved list of Partnering Facilitators referenced in the solicitation.
Government Response: The CMc will have the lead and responsibility for partnering in the Design Phase and the CMa will have the lead and responsibility for partnering during the Construction Phase. Section III.C.9 of the CMc Statement of Work, 2nd paragraph is revised as follows: “The Contractor shall provide the Contracting Officer with a list of the key personnel from the Contractor and its subcontractors who will participate in the partnering sessions. The Contracting Officer may, in his/her sole discretion, add or remove any individual from the list. The Contracting Officer shall provide a list to the Contractor with the names of the individuals who will participate in the partnering sessions on behalf of the Government and its A/E and on site construction manager. The CMc Contractor shall issue the invitations to all of the individuals who will participate in the partnering sessions and generally serve as the host during any such session’s team. The CMc Contractor shall provide: the (1) Facilitator; (2) meeting room; and, (3) other incidental items for the partnering sessions during the Design Phase Services.”
32. Please confirm the following:
a. The Fee (General Conditions, OH/P, Insurance, G&A) per the CMc Solicitation Section VI.E.
Total Evaluated Price, is a firm-fixed amount as per the definitions included within the CMc Agreement Section IV. Contract Clauses IV.A. Public Buildings Service (PBS) Contract Clauses 1. b. Guaranteed Maximum Price. Note: see also item b. below for clarification on paragraph numbering.
Government Response: Correct.
b. Please confirm that the paragraph referenced above, the CMc Agreement Section IV. Contract Clauses IV.A. Public Buildings Service (PBS) Contract Clauses 1. b. Guaranteed Maximum Price, is mislabeled and should be alphanumeric number “c.”.
Government Response: Yes, Paragraph 1.b. under Section IV, Contract Clauses IV.A., Public Buildings Service (PBS) Contract Clauses, should be 1.c.
33. Please reference concept drawing number 102. Please confirm the 2 different colors on the “Elevation Toward Courtroom” are intended to indicate 2 different colors of paint and not differing materials.
Government Response: The 2 beige-like colors are representing gyp wall surfaces.
34. Reference court floor concept plans. Are corridors along the sides of the courtroom leading to jury rooms intended to utilize public corridor finishes (marble and terrazzo) or is carpet the intent for these areas? The only public circulation that appears to take place in these corridors is jury movement.
Government Response: At this time it assumed to be epoxy terrazzo.
35. Please reference District and Magistrate Judge Office Interior Elevations on concept drawings 104 and 106.
Please confirm wall finishes are intended to represent painted hardwood wainscot below the chair rail.
Government Response: Gypsum.
36. Please reference District and Magistrate Judge Office Interior Elevations on concept drawings 104 and
106. Is the finish above the chair rail intended to be painted gypsum or the Acoustic Fabric Covering shown on page 15 of the Tenant Finish Development document?
Government Response: Gypsum.
37. Since a bid guarantee and performance and payment bond is not required until the Construction Phase, please clarify whether a bonding capacity letter from surety(ies) is required with submission of offeror’s response.
Government Response: Yes, a letter of bonding capacity should accompany the proposal.
38. From past and present GSA CMc procurements, the GMP is tracked through open book accounting that is reviewed and monitored by GSA and its CMa until final design. Then a firm-fixed price is established prior to NTP for construction. Please clarify if that is also the plan for this project.
Government Response: The Government currently does not intend to establish a firm fixed price for construction prior to the NTP for the construction phase work.
39. For the Design Phase services pricing component, please clarify the following:
In addition to the requirement for a firm-fixed price proposal for the Design Phase Services (base contract), the pricing schedule identifies overhead, profit and commission for changes to the Design Phase. How will preconstruction services costs be determined in the event of change to the Design Phase?
Government Response: In the event of a change to the scope of work for Design Phase Services, preconstruction services costs will be negotiated for a firm fixed price to include level of effort, overhead, profit and commission.
Markups for overhead, profit and commission will be based on the CMc’s pricing schedule submitted and negotiated if necessary in response to the solicitation.
40. Please specify any mock-ups required to be performed by CMc as part of its services in Design and/or Construction Phases.
Government Response: At this time, none are specified.
41. Please provide a list of Government Furnished Contractor Installed items as well any Owner required dumpster / haul services anticipated to be provided by CMc. If not yet available, please provide an allowance value acceptable to the Government to carry for this scope of services.
Government Response: At this time, there are no Government Furnished Contractor Installed or Owner required dumpster/haul services anticipated.
