About this file
This document is the 52.212-2 Evaluation-Commercial Products and Commercial Services provision, which outlines the evaluation criteria for a federal contract opportunity.
The key details are:
- The contract will be awarded to the responsible offeror whose offer is most advantageous to the Government, considering price and technical acceptability.
- Price will be evaluated on a lowest price technically acceptable (LPTA) basis, with the Government only evaluating the total proposed price and not itemized or per unit pricing.
- Technical acceptability will be evaluated based on the offeror's ability to provide a comprehensive approach to performing the entire Performance Work Statement.
- The Government may determine an offer unacceptable if the option prices are significantly unbalanced, though evaluation of options does not obligate the Government to exercise them.
- A written notice of award or acceptance will result in a binding contract, and the Government may accept an offer before the specified expiration time unless a written withdrawal is received.

52.212-2 Evaluation—Commercial Products and Commercial Services.
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:
EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) Price – Lowest price technically acceptable (LPTA) and balanced pricing. The offer shall provide pricing utilizing Table 1 on the solicitation (RFQ – Laundry Services Amendment 3) in accordance with the Performance Work Statement. The Government will only evaluate pricing that is provided in Table 1.
The Government will not evaluate itemized or per unit pricing. The Government will only evaluate the total proposed price, which is equal to the sum of the proposed price for each CLIN.
Award will be made to the offeror with the lowest total proposed price, who is determined to be technically acceptable, IAW with paragraph iii of this section.
(iii) Technical Acceptability – Contractor must provide proof of technical expertise - a comprehensive approach in accordance with the Performance Work Statement. Offeror must determined to be capable of performing the entire PWS. Each offeror will be evaluated as technically acceptable or not technically acceptable. All offerors who are evaluated as technically acceptable are eligible for award.
An offeror evaluated as not techically acceptable is not eligible for award.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer (email), to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
