About this file

This is a Solicitation Amendment for a HUBZone small business set-aside Indefinite-Delivery/Indefinite-Quantity (IDIQ) paving contract for Nellis Air Force Base and the southern portions of the Nevada Test & Training Range. The Government intends to award a single contract using the Lowest Price Technically Acceptable (LPTA) source selection procedure, with a total contract duration of three years, each year constituting an "ordering period". The maximum task order amount is $2,000,000, with an aggregate contract value of $9,900,000.

The solicitation requires offerors to submit four separate proposal volumes: Completed Documentation, Price Proposal, Technical, and Past Performance. Key evaluation factors include verifying HUBZone small business status, providing a quality control plan, demonstrating ability to obtain materials, and presenting relevant past performance. Proposals will be electronically submitted via Department of Defense Secure Access File Exchange (DoD SAFE), with specific requirements for formatting, content, and documentation. The contract will be awarded to the responsible offeror whose proposal represents the best value to the government based on the lowest evaluated price of technically acceptable proposals.

However, upon examination of the initial proposals, the CO will reexamine this determination and if, in the CO's opinion, there is adequate price competition, no additional price information will be requested and certification under FAR 15.406-2 will not be required. However, if, at any time during this competition, the CO determines that adequate price competition no longer exists, offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

Section M - Evaluation Factors for Award

Header Miscellaneous Text (Modified):

Section M - Evaluation Factors for Award

1. BASIS FOR CONTRACT AWARD

(a) This acquisition is a Lowest Price Technically Acceptable (LPTA) source selection conducted in accordance with Federal Acquisition Regulation (FAR) 15.3, Source Selection, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Department of the Air Force Federal Acquisition Regulation Supplement (DAFFARS).

(b) The Government seeks to award a single contract to the offeror who is considered technically acceptable, deemed responsible in accordance with the Federal Acquisition Regulation (FAR) Part 9, whose proposal conforms to the solicitation's requirements (to include all stated terms, conditions, representations, certifications, and all other information required by this solicitation) and represent the best value to the Government.

(c) While the Government source selection evaluation team and the Source Selection Authority (SSA) strive for maximum objectivity, however the source selection process by its nature is subjective. Therefore, professional judgment is implicit throughout the entire process. The Government reserves the right to award without discussion; thus, each initial offer should contain the Offeror's best offer. However, the Government does reserve the right to conduct discussions if determined by the Contracting Officer to be necessary.

2. NUMBER OF CONTRACTS TO BE AWARDED

The Government intends to award one (1) contract for the Nellis AFB and Nevada Test & Training Range (NTTR) Paving Indefinite-Delivery, Indefinite-Quantity (IDIQ) as a HUBZone small business set-aside.

3. REJECTION OF UNREALISTIC OFFERS

The Government may reject any proposal that is evaluated to be unrealistic in terms of program commitments, including contract terms and conditions, or unrealistically low pricing when compared to Government's estimate and competitive pricing, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the program.

4. CORRECTION POTENTIAL OF PROPOSALS

The Government may consider, throughout the evaluation, the "correction potential" of any deficiency or proposal inadequacy. The judgment of such "correction potential" is within the sole discretion of the Government.

5. EVALUATION FACTORS

(a) The Government will evaluate the offeror's proposal against the specifications and requirements of this solicitation to determine whether the proposal is acceptable or unacceptable using the ratings and description below:

ACCEPTABLE: Proposal meets the specifications or requirements of the solicitation.

UNACCEPTABLE: Proposal does not meet the specifications or requirements of the solicitation.

(b) EVALUATION FACTORS:

i. Factor 1: Completed Documentation

ii. Factor 2: Price

iii. Factor 3: Technical

iv. Factor 4: Past Performance

(c) An unacceptable rating in one or more factors will result in the proposal being determined unacceptable and ineligible for award.

(d) Evaluation Process:

i. Step 1 - All proposals COMPLETED DOCUMENTATION (Volume 1) will be evaluated for completeness in accordance with the specification's requirements outlined in this solicitation.

ii. Step 2 - PRICE Proposals (Volume 2) will be ranked from lowest total evaluated price (TEP) to highest TEP.

iii. Step 3 - TECHNICAL (Volume 3) will be assessed for technical acceptability

iv. Step 4 - PAST PERFORMANCE (Volume 4)

(e) Factor 1 - COMPLETED DOCUMENTATION (Volume I): The Government will evaluate the offeror's Volume I documentation against the specifications and requirements of this solicitation using the ratings and description identified in paragraph 5(a) above. Factor 1 is divided into the following sub-factors: Sub-factor 1, Points of Contact; Sub-factor 2, SF1442; Sub-Factor 3, Small Business Representation; Sub-Factor 4, Bonding Capability. Each sub-factor will be assessed on a pass/fail basis using the ratings and descriptions below. A failed assessment of any sub-factor will result in an overall unacceptable rating for Factor 1. Failure to provide all the required and completed documentation will result in the termination of the evaluation and will result in the proposal being ineligible for award.

PASS: Sub-factor meets the specifications or requirements of the solicitation.

FAIL: Sub-factor does not meet the specifications or requirements of the solicitation.

(1) Sub-Factor 1 - Points of Contact (POC): Sub-factor 1 will be reviewed for the following:

(f) Factor 2 - PRICE (Volume II): The Government will evaluate the offeror's Volume II documentation using the ratings and description identified in paragraph 5(a) above. Failure to provide pricing in accordance as required by this solicitation and the Line-Item Pricing Schedule (Attachment 2) may result in the Government removing the proposal from further consideration.

(1) The Government will rank all offers from lowest TEP to highest then begin evaluations with the lowest TEP offer. Price evaluations will assess the price proposal for completeness, accuracy, reasonableness, balance, and compliance to this solicitation's specifications and requirements.

(2) To determine the TEP, the total price for each line item on the Line-Item Pricing Schedule (the product of the offeror's proposed Unit Cost multiplied by the government-supplied estimated quantity listed on the Pricing Schedule) will be added together to provide a total price for each annual Ordering Period. The totals for each Ordering Period will then be added together to identify each offeror's TEP. All three one-year Ordering Periods will be considered in determining the offeror's TEP.

(3) Analysis of price proposals will be conducted using one or more of the techniques defined in FAR 15.404-1 for reasonableness and unbalanced pricing. For a price to be reasonable, it must represent a price to the Government that a prudent person would pay in the conduct of competitive business. Normally, price reasonableness is established through adequate price competition but may also be determined through cost and price analysis techniques as described in FAR

15.404. For additional information, see FAR 31.201-3. Additionally, a price proposal may be rated unsatisfactory if it is determined that an unreasonable and or an unbalanced pricing condition exists.

(g) Factor 3 - TECHNICAL (Volume III): The Government will evaluate the offeror's Volume III documentation against the specifications and requirements of this solicitation using the ratings and description identified in paragraph 5(a) above. Volume III is divided into the following sub-factors: Sub-factor 1, Quality Control Plan; Sub-factor 2, Ability to Obtain Materials. Each sub-factor will be assessed on a pass/fail basis using the ratings and descriptions identified in paragraph 5(e) above. A failed assessment of any sub-factor will result in an overall unacceptable rating for Factor 3.

(1) Sub-factor 1 - Quality Control Plan: An acceptable Quality Control Plan, at a minimum, must provide a detailed narrative to include any graphic representations of the offeror's plan to ensure successful execution of the paving IDIQ program and subsequent task order projects. The offeror's proposal shall clearly convey the specifications and requirements outlined in Section L of this solicitation.

(2) Sub-factor 2 - Ability to Obtain Materials: At a minimum, offerors must provide evidence of ability to obtain materials that meet the specifications required by this contract, including but not limited to: concrete, asphalt, base course and subbase aggregate. This requirement can be satisfied by providing a signed letter or a quote from the source of supply listing the specifications of the material being provided. The specifications of the materials listed shall meet the specifications included in this contract to be considered acceptable.

(h) Factor 4 - PAST PERFORMANCE (Volume IV): The past performance evaluation is an assessment of the offeror's probability of meeting the minimum past performance requirements of this solicitation. This assessment is based on the offeror's record of relevant and recent past performance information and how well the offeror performed on prior contracts.

In conducting the Past Performance evaluation, the Government reserves the right to use both the information provided in the offeror's Past Performance proposal volume and information obtained from other sources, such as the Federal Awardee Performance and Integrity Information System (FAPIIS), the Defense Contract Management Agency (DCMA), commercial sources, or similar systems.

(1) Recency Assessment - An assessment of the offeror's past performance information will be made to determine if it is recent. To be recent, the effort must have been performed during the past six (6) years from the date of issuance of this solicitation. Efforts that have not yet been completed must (a) be at least 50% complete from the date of issuance of this solicitation, and (b) the Offeror can validate completion percentage with a government approved progress report. Past performance information that fails to meet these conditions shall not be evaluated. NOTE: If any part of the performance falls within the above timeframe, the information in its entirety may be evaluated for past performance.

(2) Relevancy Assessment - The Government will conduct an evaluation of all recent performance information to determine how closely the services performed under those contracts relate to the contemplated Paving IDIQ contract. The past performance information sheets, questionnaires, and information obtained from other sources will be used to establish relevancy of past performance. The Government will determine relevancy when assessing recent contracts according to the below ratings:

ACCEPTABLE: Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown (see note below).

UNACCEPTABLE: Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

NEUTRAL: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305[a][2][iv]). Therefore, the offeror shall be determined to have unknown (or "neutral") past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.

Relevant past performance includes performance of items 01AA - 01AZ or 01BN - 01CH listed on the Ordering Period 1 Paving IDIQ Line-Item Pricing Schedule (Attachment 02). Each recent/relevant past performance information submitted for evaluation must be valued at no less than $250,000 with a minimum performance length of 30 calendar days to be considered for evaluation.

6. DISCUSSIONS

It is the Government's intent to award without discussions; therefore, it is imperative that each offeror submit their best terms with their initial proposal. However, if during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices (ENs), and the Final Proposal Revision (FPR) will be considered in making the source selection decision.

7. SOLICITATION REQUIREMENTS, TERMS AND CONDITIONS

Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.
