1.2.2.2 The Work of each project will be executed using experienced installers, workers, established trade practices, industry standards, and manufacturer recommendations and/or instructions to provide fully functional facilities, systems, equipment and assemblies suitable for their intended use and in strict compliance with the contract requirements.
SECTION 2 CONSTRUCTION
2.1 GOVERNMENT ADMINISTRATION
2.1.1 Quality Assurance (QA) Responsibility: The Government will monitor construction activities to ensure compliance with project requirements. Observations may be performed during both standard and non-standard hours by personnel representing various Government organizations having an interest in the means and methods used to install the Work. Discussions between Contractor and said Government personnel will be construed as informal and NOT as a Government directive. Government directives will be issued only in written format by the Contracting Officer.
2.1.2 Separate Work: The Government reserves the right to perform work at the job site by separate Contractor. The work will be accommodated by the Paint and Protective Coatings IDIQ Contractor without additional cost to the Government to the extent said work does not create a burden for the Paint and Protective Coatings IDIQ Contractor. The Contracting Officer will provide final determination of occurrence, extent and correction for claim that work by separate contractor constitutes a significant burden or imposition for on-going Paint and Protective Coatings IDIQ work.

SECTION 3 COST DETERMINATIONS
3.1 GENERAL REQUIREMENTS
3.1.1 Goal: The Government’s goal is to accomplish construction using efficient, economical means and methods commensurate with the requirements of each task order.
3.1.2 Contractor Responsibility: The Contractor’s cost determination will utilize value engineering analysis and exercise reasonable judgment to assist the Government in meeting this goal, without reducing standards of quality.
3.1.3 Proposal Preparation Costs: The costs for preparation of task order proposals shall be the responsibility of the Contractor and not directly reimbursable. Each task order awarded shall include at a minimum all labor wages, management, supervision, mobilization, material and equipment costs. The Contractor shall furnish all project management, planning, estimating, labor, transportation, materials, equipment, tools, supervision, design if applicable, and all other associated costs necessary to fulfill the requirements of the task order.
3.1.4 RS Means, Coefficient, and City Cost Index
3.1.4.1 Bare Cost Total in the current year’s E4Clicks Premier Estimating Software System (E4CLICKS) and the current year’s R.S. Means Facilities Construction Cost Data book published by R.S. Means, Inc. Bare Cost as referred to in the R. S. Means Facilities Construction Cost Data Book is the installed price.
3.1.4.2 The coefficient is the price multiplier that the contractor offers. The Government uses this multiplier to apply to the total costs to arrive at the price for an individual task order. The Government established unit prices listed in the E4CLICKS (material, equipment, and labor without any markups for material, equipment, labor, subcontractor, sales tax, overhead, or profit), multiplied by the average City Cost Index (CCI) percentage for Lawton, Oklahoma, multiplied times the coefficient to arrive at the actual price for the task order. The coefficient shall be represented as net, a decrease from or an increase to the prices listed in the E4CLICKS. An offer of net would be represented as 1.00. An example of a decrease from the prices in the E4CLICKS would be 0.98. An example of an increase above the prices in the E4CLICKS would be 1.06.
3.1.4.3 The coefficient shall contain all costs other than the pre-priced unit prices contained in the current version of RS Mean Cost Data and non-pre-priced items. The coefficient is a numerical factor that represents the contractor’s costs. The coefficient must be sufficient to cover all cost including but not limited to items as follows: general & administrative expenses; home office expense and field overhead; as-built drawings; insurance; material delivery expenses; material submittals; computer and software expense; quality contract management and supervision; safety; site security; overhead; profit; project indirect and direct costs; bond premiums; licenses; certifications; basic contract mobilization and basic contract demobilization expense; traffic cones and barricades; gross receipts tax; general conditions (superintendent salaries); all labor burden costs (prime and subcontractor); material waste;
consultant fees; subcontractor costs to include but not limited to overhead and profit; on and off site storage; as well as costs associated with compliance of environmental, labor, and tax laws, or these specifications. The offeror’s coefficient should consider the above expenses because allowance will NOT be made after contract award for any purpose. The coefficient will not be adjusted for the life of the contract.
3.1.4.3.1 Mobilization for rental equipment for each task order will only include whatever is allowed and addressed via RS Means Cost Estimating Guide line items for mobilization for the particular equipment to be used.
3.1.4.3.2 Any change in the applicable minimum hourly rate of wages (Davis-Bacon Wage Determinations) during the contract period shall not affect the unit price to be paid by the Government for work performed under this contract. (See Section J and FAR Clause 52.222-6)
3.1.4.4 Pricing Coefficients: The purpose of applying the coefficient to direct pre-priced costs from the E4CLICKS is to compensate the contractor for burden costs and profit for performance. The pricing coefficient is not subject to economic price adjustments and the coefficient shall remain unchanged during the life term of the contract.
3.1.4.5 E4CLICKSdates: Increase/decrease of any cost in the work performed are determined by the applicable current year’s E4Clicks Premier Estimating Software System and the current year’s R.S. Means Facilities Construction Cost Data book published by R.S. Means, Inc. provided by and required to be used by the contractor.
3.1.4.6 City Cost Index (CCI) Quarterly Updates: The Contractor shall notify the Government of any quarterly changes to the City Cost Index (as a result of quarterly weighted average updates) and the changed CCI will take effect within 15 calendar days from the date of the notification by RS Means. The purpose of allowing for quarterly updates is to use the most current RS Means pricing information available from which to price out proposals or modifications.
3.1.4.7 Modifications to existing task orders: Modifications deleting work will be at the CCI in effect at the time of award of the task order or at the CCI in effect when the affected work was added (if added via modification after award of the respective task order). Modifications adding work shall be at the CCI in effect at the time of adding the additional work to the task order.
3.1.5 Deviation From UPB Data:
3.1.5.1 Non Pre-priced Items (NPI): Construction items not identified by the UPB will be submitted with competitive pricing quotes from three (3) or more sources when line item value is
$2,000.01 or greater. Components will be described using UPB format and submitted on stationary bearing the full legal name, address and telephone number of the bidder.
3.1.5.2 Reduce project cost when local material and equipment unit costs are available and when work can be accomplished using a more economical crew composition than the type listed in the UPB.
3.2 END OF YEAR PROJECTS (Provisional)
3.2.1 Preparation of Proposals: In addition administration of on-going projects, the Contractor shall have sufficient resources and capacity to deliver multiple proposals, within a compressed time period, for provisional projects issued at the End of Year (EOY).
3.2.2 Award: Award of provisional projects will be contingent upon the availability of funding and base prioritization.
3.2.3 Right To Negotiate: The Government reserves the right to enter into negotiations with the Contractor for purpose of obtaining a guaranteed price for one or more submitted EOY proposals. Negotiation actions by the Contracting Officer will be undertaken and completed before availability of funding is determined. Said actions will NOT, however, be construed by the Contractor to indicate intent to award. All costs incurred by the Contractor as a result of proposal preparation and subsequent negotiations will be borne solely by said same, whether project is or is not awarded.
