TASK 4: PERMITTING

Task 4A: Environmental Services

Description: Wetlands are protected under Chapter 373 of the Florida Statutes (FS) and Section 404 of the Clean Water Act (USEPA). As part of the permitting process, Wood will conduct an ecological site evaluation, including:

• Wood scientists will conduct a desktop analysis of the project area to identify wetland boundaries and listed species occurrences and habitats within the project limits. Typical sources reviewed for the project area may include, but not be limited to, U.S. Fish and Wildlife Service (USFWS) National Wetland

Inventory (NWI) data/maps; soil surveys from the U.S. Department of Agriculture-Natural Resources

Conservation Service (NRCS); U.S. Geological Survey (USGS) topographic maps; current and historical aerial photography; Florida Land Use, Cover and Forms Classification System (FLUCCS), Florida Natural

Areas Inventory (FNAI) mapped land uses, Florida Fish and Wildlife Conservation Commission (FWC), and U.S. Fish and Wildlife Service (USFWS).

• Wood’s wetland scientists will delineate the limits of wetlands and the Myakka River surface water line in the areas to be disturbed by the proposed construction in the main channel and breach area, in accordance with the Routine On-Site Wetland Determination method as described by the 1987

United States Army Corps of Engineers (USACE) “Corps of Engineers Wetlands Delineation Manual” and the Florida wetland delineation method, “Delineation of the Landward Extent of Wetlands and

Surface Waters” (Chapter 62-340). Note that the limits of wetlands to be disturbed fall within the overall Myakka River floodplain, which is nearly two miles wide. The wetland edge will be delineated using GIS while the limits of wetlands to be disturbed will be delineated in the field and marked with labeled field flagging and/or pin flags. These points will be documented with a handheld

Global Positioning System (GPS) unit with sub-meter accuracy. Field observations will also be documented in field notes, field forms, and digital photographs.

• Wood scientists will identify the wetland Seasonal High-Water Lines (SHWL) within the project area in wetlands to be disturbed.

• Wood scientists will perform a Uniform Mitigation Assessment Method (UMAM) evaluation of the wetlands within the project work limits to determine potential impacts from the work. Wood will also perform a desktop UMAM analysis of the offsite areas identified as likely to be impacted or improved as a result of the proposed project. As the primary goal of the project is ecological restoration, it is anticipated that any wetland impacts will be offset by the benefit of performing the site restoration itself and that additional mitigation will not be required.

• Concurrent with wetland field evaluation, Wood scientists will perform a pedestrian survey of the project site to identify evidence of state and federally protected species or their habitats.

Observations, or lack thereof, will be included in the ecological report.

• Wood will meet with the WMD and USACE onsite to confirm the wetland evaluation as needed.

This will be scheduled as a single site visit.

• This task does not include species-specific surveys such as bonneted bat nesting cavity surveys or gopher tortoise burrow surveys.

• This task includes an assessment of the west side of the Myakka River and assumes that FDEP will secure an access agreement with the landowner.

Deliverable: The deliverable will include an electronic Adobe Acrobat (.pdf) copy of the ecological report which will include the UMAM analysis, wetland delineations with wetland SHWLs, and a description of the results of the protected species observations, to be delivered to the BDC project manager.

Performance Measure: Deliverables will be reviewed by the Department to confirm they are complete, Subtask 4A

Task 4B: Permit Preparation and Submittal

Description: Wood will prepare the USACE Nationwide permit application and the SWFWMD General ERP permit application. Based on a preliminary discussion with Sarasota County, it is assumed that Sarasota

County permitting will not be required for this work. The permit applications will include a copy of the previously prepared Hydrologic and Hydraulic analysis from the feasibility analysis phase of the project if requested by the individual agency. Wood does not anticipate revising the previously prepared report or hydrologic and hydraulic modeling for the project. A pre-application meeting was previously held with the

SWFWMD during the feasibility portion of the project and an additional pre-application is not included in this SOW.

• Wood will prepare and submit the permit application packages. Documents to be included are the feasibility report detailing no offsite water quantity impacts with the ICPR4 results; the Ecological

Report as prepared in Task 4A with UMAM forms, permit figures; and 60% design plans. These 60% design plans will be signed and sealed by a Florida Licensed and Registered Professional Engineer.

• Wood will respond to Requests for Additional Information (RAI) from the USACE and the SWFWMD during permitting. Generally, this is understood to be a response to one RAI for each agency, however, Wood will communicate as needed with the agencies to ensure a timely permit process with limited questions and RAIs.

Upon completion of the 60% Design Plans, Wood will submit the permit application package to FDEP for review and signatures. After concurrence from FDEP, Wood will submit the required permit applications with attachments and supporting data, including the 60% construction plans, to the applicable permitting agency(s).

TASK 6: LEADED COATINGS SURVEY AND PRE-DEMOLITION ASBESTOS SURVEY

Description: Wood will conduct a National Emissions Standards for Hazardous Air Pollutants (NESHAPs) pre-demolition of the riverbank stabilization area. The sampling strategy will be based on Asbestos Hazard

Emergency Response Act (AHERA) sampling method, with a minimum of three samples per homogeneous area. Sampling will be conducted by a Florida Certified Asbestos Inspector. Samples will be sent to a contracted National Voluntary Laboratory Accreditation Program (NVLAP) accredited laboratory. A minimum of three (3) samples are recommended per suspect asbestos-containing material. The sampling locations will be documented at the subject site and material types (including concrete), locations, and quantities will be noted.

The bulk material samples will be transported following chain-of-custody procedures to a laboratory accredited under the National Institute of Standards and Technology (NIST) Voluntary Laboratory

Accreditation Program (NVLAP) where they will be analyzed for asbestos using Polarized Light Microscopy

(PLM) methods in accordance with EPA Method 600/R-93/116. Materials having results of point count analysis of less than 1% are considered to be non-asbestos-containing. Polarized Light Microscopy (PLM) is inexpensive, but it cannot identify non-asbestos fibers as asbestos. If the PLM analytical results indicate levels between “trace” (<1%) and 1% asbestos, the samples must be analyzed by point count methodology to better quantify the actual asbestos content. Also, to eliminate false positives (and costly unnecessary abatement), samples reported as containing between 1% and 10% asbestos can be analyzed/verified by point count. The alternative is to assume the subject material to be asbestos-containing.

Leaded Coatings Survey

Wood will complete a leaded coatings survey of the subject structures located at the subject site. Testing will be performed using a RMD LPA-1 X-Ray Fluorescence (XRF) meter by individuals certified in its use by the manufacturer, and in accordance with the manufacturer’s guidelines. Testing will be performed by individuals certified by the Environmental Protection Agency (EPA) in Lead-Based Paint Inspection. Real-time field sheets will be prepared and submitted as an attachment to the final report.

Deliverable: The deliverable will include the final report detailing the results of the leaded coatings survey and the NESHAP asbestos survey.

Performance Measure: Deliverables will be reviewed by the Department to confirm they are complete, Subtask 6
