About this file

This document is a justification for other than full and open competition for a portion of the ACAD 312255 Rehabilitate Schoodic Water & Wastewater Systems acquisition by the National Park Service. The project aims to rehabilitate the aged water and wastewater systems in Acadia National Park's Schoodic District through renovating lift stations, repairing the supervisory control and data acquisition system, replacing wastewater collection lines, reconstructing well houses, and improving freeze protection. The justification approves acquiring VTScada software by Trihedral on a sole-source basis, as it is the only available product on the FedRAMP compliant listing. The software will connect various water and wastewater sites and the emergency generator to the operations building for remote monitoring and control. The anticipated $22,900 cost is considered fair and reasonable based on published pricing and common use in similar applications.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

BRAND NAME ONLY FOR PORTION OF ACQUISITION

SCADA SOFTWARE

1. Identification of the Agency/Contracting Activity:

The U.S. Department of the Interior, National Park Service, Denver Service Center, Lakewood, Colorado is the contracting activity for a project to Rehabilitate Schoodic Water & Wastewater Systems, Acadia

National Park, Winter Harbor, Maine.

Scope of Work Synopsis:

This project is a Design-Bid-Build construction effort that will rehabilitate the potable water and the wastewater systems in Acadia’s Schoodic District, which were constructed circa 1970s, modified at various times in the years following, and are aged beyond their useful lives. Over 250,000 visitors use facilities in this remote site each year. Improved water and wastewater treatment systems will decrease the likelihood of environmental contamination and compromised health and safety of visitors and employees.

The project addresses ongoing maintenance/repair work by upgrading the systems for continued service.

Work includes renovation of deteriorated lift stations with new pumps, mechanical components, and controls; repair of the supervisory control and data acquisitions (SCADA) system; inspection and replacement of wastewater collection lines; well house reconstruction, and improvements to minimize freezing potential.

2. Nature and/or Description of the Action Being Approved:

The project is for rehabilitation of Schoodic Water & Wastewater Systems. Only a portion of the acquisition is for a brand-name or item peculiar to one manufacturer, as follows:

For installation of a Supervisory Control and Data Acquisition (SCADA) system and a radio telemetry system for both the water and wastewater systems to allow NPS to monitor and control systems effectively.

The existing Schoodic Campus emergency generator will also receive SCADA connectivity to allow for

Park maintenance to remotely monitor generator and power status, alarms, and fuel level.

The proposed SCADA software will allow connectivity from the Acadia Schoodic Operations Building to water and wastewater sites with control functionality and to collect monitoring and alarm information.

These sites include the new well pump, Water Treatment Plant (WTP) clearwell tank, WTP chlorine analyze, WTP pH meter, and Schoodic Campus emergency generator. Each of these sites will receive a

Programmable Logic Controller which connects it to the SCADA server through a radio system.

In addition, the SCADA software will be operated via a standalone Internet Service Provider (ISP) and integrated onto independent hardware which prevents security risks to the Park’s DOI network. The independent hardware will consist of one (1) desktop workstation and one (1) thin client (tablet) to allow for remote monitoring.

The Designer of Record has recommended the use of brand name product “VTScada by Trihedral to fulfill this project’s SCADA software requirement. This product is commonly used for similar water and wastewater applications and is used for several municipal water and wastewater systems across New

England and has been approved and is the only software currently included on the FedRamp Compliant listing.

3. An Identification of the Statutory Authority Permitting Other than Full and Open Competition:

The use of brand name descriptions for particular items to satisfy a portion of this acquisition is authorized pursuant to 41 U.S.C. 3304(a) (1) “Only One Responsible Source and No Other Supplies or Services will

Satisfy Agency Requirements” (See also, FAR 6.302-1(c) (1)). When the acquisition of the brand name product, material or component is essential to the Government’s requirements use of the product thereby precludes consideration of a product manufactured by another company. FAR 6.302-1(c)(1)(ii)(B). As stated above, the item listed is essential to the Government’s requirements for the long-term protection of the historic masonry system for the restoration of the building.

4. A Demonstration of The Unique Qualifications or The Nature of The Brand Name Item That Requires Use of The Authority Cited:

A description of the unique qualifications or the nature of the brand name item being acquired, including the subcontractor’s name and address or brand name item’s description is as follows:

Trihedral

Suite 400, 1160 Bedford Highway

Bedford, NS, Canada B4A 1C1

This product is the only available SCADA software on the FedRAMP compliant list—The approval process requires a lengthy approval process controlled by a Joint Authorization Board made up of representatives from the Department of Homeland Security, General Services Administration, and Department of Defense.

For application to a NPS unit, it also requires Park IT to submit an application for implementation of the proposed product, approval by the Region IT, and approval by WASO IT. Any similar product without the

FedRAMP approval status requires an individual third-party security review and approval by DHS.

5. A Demonstration that the Nature of the Acquisition Requires Use of the Authority Cited:

Market Research efforts by the Designer of Record for this project, who has the specialized knowledge and expertise to assess SCADA software for this work, resulted in finding no other software compatible with the current SCADA software system.

6. A Description of Efforts Made to Ensure Offers are Solicited from as Many Potential Sources as Practicable

Including Whether a Notice was or will be Publicized as Required by Subpart 5.2:

This Brand Name justification is for only the SCADA Software portion of the construction project. The

Government will continue to consult the approved FedRamp listing for future procurements with similar requirements. This action does not exceed the threshold for the requirement to publish the notice as required by FAR 5.2. The Brand Name Only Justification will be posted with the Solicitation in accordance with FAR 6.302-1(c)(1)(ii)(C) and 5.102(a)(6).

7. A Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and

Reasonable:

The anticipated costs of the VTScada by Trihedral for this project is approximately $22,900 based on the

Class B Construction Cost Estimate and published pricing available from the Manufacture and authorized resellers. This price accounts for one (1) SCADA Server, two (2) SCADA Web Servers, one (1) SCADA

Software License, and two (2) SCADA Webserver Software Licenses. The recommended brand name product is commonly used for similar water and wastewater applications and is reasonably priced within the industry for similar SCADA products. They also have local offices for support with their headquarters located in Halifax, Canada with a New England support office and several local certified integrators for their product. Given the accelerated design scheduled to meet Fiscal Year 2022 construction award obligations, alternative products are not feasible due to the lengthy approval process.

Alternative products are not feasible.

8. A Description of the Market Research Conducted and Results or a Statement of the Reason Market

Research Was Not Conducted:

The Designer of Record noted similar products which would be capable of fulfilling this project’s requirement. However, each of these products are not approved through the FedRamp process would require a lengthy third-party review and approval process. Given the accelerated design scheduled to meet

Fiscal Year 2022 construction award obligations, alternative products are not feasible due to the lengthy approval process.
