About this file

This document is the Evaluation—Commercial Products and Commercial Services provision (52.212-2) for a federal contract opportunity. The Government will award the contract to the most advantageous responsible offeror, evaluating offers based on two primary factors: price and technical merit. For the technical evaluation, only the five lowest-priced proposals will be assessed on a pass/fail basis, with ratings of Acceptable, Reasonably Susceptible of Being Made Acceptable, or Unacceptable.

The technical evaluation includes two specific subfactors: 1) Narrative & Materials (N&M), requiring a 5-page narrative demonstrating a sound approach to work requirements, and 2) Past Experience, requiring a 2-page narrative showing the offeror's experience performing similar services within the past five years. Offerors must submit detailed information about their methodology, skills, equipment, and relevant project history. The Government will also evaluate option prices by adding them to the total basic requirement price, with the ability to determine an offer unacceptable if option prices are significantly unbalanced.

52.212-2 Evaluation—Commercial Products and Commercial Services.

As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:

Evaluation—Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. All technically acceptable offers shall be treated equally except for their prices and performance records. Failure to meet a requirement may result in an offer being determined technically unacceptable. The following factors shall be used to evaluate offers:

(i) Price. Initially, offers shall be ranked according to price, including any option or additive item prices if applicable. The price evaluation will document the offeror’s reasonableness and affordability of the proposed total evaluated price.

(ii) Technical. The Government shall then evaluate the five (5) lowest priced technical proposals on a pass/fail basis, assigning ratings of Acceptable, Reasonably Susceptible of Being Made Acceptable, or Unacceptable. The proposals shall be evaluated against the following subfactors:

1. Subfactor – Narrative & Materials (N&M): Submit a narrative, not to exceed 5 pages, which demonstrate a sound approach and methodology for accomplishing work requirements identified in the solicitation and PWS with the appropriate skills, equipment, and materials, in the appropriate quantities, and at the appropriate time to meet the Government’s desired outcomes.

2. Subfactor – Past Experience: Submit a narrative, not to exceed 2 pages, which demonstrate offeror’s experience to perform a service of this magnitude and complexity. Discuss and provide experience of personnel and relevant/recent projects. Relevant performance includes performance of efforts involving that are similar or greater in scope, magnitude and/or complexity than the effort described in this solicitation. Each relevant project shall have been performed during the past five (5) years from the date of issuance of this solicitation. If no past experience, state so and indicate in detail how you plan to overcome this lack of experience.

(c) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
