About this file
This is a Price Proposal Form for a Design-Build construction project (P-1538-SOF Armory) under NAVFAC Mid-Atlantic's IDIQ Multiple Award Construction Contract. The form requires contractors to provide pricing for a base construction contract and six optional line items, with award based on the total sum of all items.
The base price (CLIN 0001) covers complete construction of the SOF Armory facility, split between building construction to the 5-foot line ($0001A) and sitework beyond that line ($0001B). Optional items include: Audio Visual System equipment with government estimate of $91,573 (CLIN 0002); Furniture, Fixtures, and Equipment with government estimate of $2,472,290 (CLIN 0003); geotechnically unsuitable soil removal at 900 cubic yards (CLIN 0004); surcharging at 500 cubic yards (CLIN 0005); petroleum impacted media disposal at 700 cubic yards (CLIN 0006); and hazardous contaminated soil disposal at 170 tons (CLIN 0007). Contractors may propose a Handling and Administration Rate up to 5% for FF&E and A/V options. The government reserves unilateral rights to exercise options within 360 calendar days, with contract completion required within 835 calendar days. Additional bonding and consent of surety are required if options are exercised, and failure to provide pricing for any line item results in proposal rejection.

GENERAL BID NOTES
a. Award will be made on the total sum of Contract Line Item (CLIN) 0001, which includes subtotals of CLINs 0001A and 0001B, and the extended total under CLINs 0002 – 0007 (Base and all options). For CLINs 0004, 0005, 0006, and 0007, enter unit prices and extended totals in spaces provided. If there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid and the total recomputed accordingly. If an Offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.
b. The Government reserves the unilateral right to award CLINs 0004-0007 (Option Items 3-6) to the Contractor at the proposed price within 360 calendar days after the contract award, and in accordance with all bid notes. A firm fixed proposed price is required for CLINs 0004-0007. No provision is made for economic price adjustment. If CLINs 0004-0007 are exercised, the contract completion date remains 835 calendar days after award of the contract.
c. Evaluation of Options (JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the price for the option(s) (CLINs 0002-0007) to the total price for CLIN 0001. In accordance with FAR 52.217-5 Evaluation of Options, evaluation of options will not obligate the Government to exercise the option(s).
d. In FAR 52.217-7; Option for Increased Quantity-Separately Priced Line Item (Mar 1989), the Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.
e. The Government may reject an offer as nonresponsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.
f. If CLINs 0004-0007 are exercised, additional bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all Items.
g. Failure to enter a price for any CLIN will result in a proposal being rejected.
OPTION BID NOTES
These notes apply to CLINs 0002 and 0003.
a. The estimated amount for FF&E and A/V has been supplied by the Government, to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E and A/V including freight and installation charges. The Government FF&E and A/V Estimate is only an estimated amount.
b. If awarded, line items will be funded separately after completion of FF&E and A/V design package review by the Government, and receipt of appropriate funding by the Government.
c. Bonding is required for the design, procurement and installation of FF&E and A/V equipment.
d. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E and A/V not to exceed 5 percent. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E and A/V. The proposed HAR is a fixed percentage. The HAR amount will be determined/adjusted as the FF&E and A/V amounts are finalized.
e. The Government is not obligated to award the Option line item(s). Should the Government choose to award the Options 1 and 2, the line item will be awarded as a negotiated modification to the contract/task order. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E and A/V.
f. If awarded, the FF&E and A/V modification will be awarded at least six months prior to the contract completion date. A minimum of six months is required for the Contractor to purchase, deliver and install the FF&E and A/V without impacting the overall completion date of the project. The Contractor's schedule must assume the award of the FF&E and A/V as a modification. No schedule extensions will be granted if the modification is awarded at least six months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than six months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor clearly demonstrates, in writing that (1) an accepted Final FF&E and A/V package was submitted within the approved schedule deadlines and (2) sufficient lead time for the FF&E and A/V is not available and the Government's award of the modification is in the last six months of the contract.
g. Adequate time for the installation of FF&E and A/V must be allotted in the Construction Schedule after all other trades have completed their work in the installation areas. The projected installation periods required by the vendors in the FF&E and A/V proposals must be honored in the construction schedule, with additional time allotted for complete FF&E and A/V punch lists, prior to building turnover. Overtime costs for FF&E and A/V installation must not be passed along to the government as part of the Options 1 and 2 costs, unless a compressed schedule has been required/approved by NAVFAC.
These notes apply to CLINs 0004, 0006, and 0007.
h. For CLIN 0004: Geotechnically Unsuitable Subgrade Soil Removal, temporary stockpiling, and Replacement: Unit price for all work in connection with the removal, disposal, and replacement of geotechnically unsuitable subgrade soil (i.e. soft subgrade soils) with imported structural backfill or imported aggregate as specified. Unsuitable subgrade soil determinations shall be made by the Government Geotechnical Engineer and approved by the Contracting Officer. The price shall include removal of geotechnically unsuitable soils encountered at the planned footing subgrades or identified during proof rolling of planned subgrades, disposal at the specified disposal facility, and backfilling the excavation with compacted imported structural backfill or imported aggregate.
