Storm Water Permitting Requirements for Construction Projects at Fort Gordon

Obtaining the applicable stormwater management permit(s) associated with land disturbance activities is a critical requirement for all Fort Gordon projects. The following information and references provide general guidance and guidelines to help assist site designers in understanding and meeting the Federal, state, local and Fort Gordon permitting requirements for projects regulated the NPDES Construction Stormwater, Land Disturbance Activity and NPDES MS4 permits.

The Fort Gordon Cantonment area falls under the jurisdiction of the state of Georgia’s Environmental Protection Division (EPD) and the City of Augusta-Richmond County LIA (Local Issuing Authority). The US Environmental Protection Agency (EPA) granted the GA EPD authority to administer its own National Pollutant Discharge Elimination System (NPDES) program and to issue NPDES Construction General Permits under the Federal Clean Water Act. The GA EPD has the authority to certify a county or municipality as a certified LIA under the state’s Erosion and Sedimentation Control Act. As such, the GA EPD has delegated the Augusta-Richmond County as a certified LIA and the authority to administer Land Disturbance Activity (LDA) permits; and to oversee the land disturbance activity permit program with the oversite of the Georgia Soil and Water Conservation Commission (GSWCC). The Augusta-Richmond County LIA reviews ES&PCP for approval, conducts site inspections and enforcement for construction activities which are conducted at Fort Gordon within the LIA’s respective boundaries.

3. Submittal Process

DPW-ED files all required permit submittals. LDA and NPDES permits both require electronic permitting. The A-E should NOT file for permits through the LIA eFile system or through the GAEPD GEOS system for projects on Fort Gordon. Once DPW has approved the design as ready for submission to the LIA, the following steps are followed.

a. Submit a Fort Gordon LDA Permit Application to DPW-ED. Include all digital exhibits required by the application. Ensure that all exhibits are complete and up to date.

b. Submit one full-size (24” x 36”) hard copy set of the designs and CD with final electronic files to:

Delaine Scott DPW Environmental Compliance Branch- Environmental Div.

IMGO-PWE

15th Street, Bldg. 14600 Fort Gordon, Georgia 30905-5040

Main Office: 706-791-8976

c. Submit payment for the LIA review submittal. Projects cannot be submitted to the LIA before this payment is received. A check can be submitted to DPW-ED for the LIA submittal fees and/or paid electronically by contacting the Augusta Richmond County Planning and Development Department directly (POC - Terri Turner 706- 821-1796). Submit a copy of the receipt along with the other required exhibits to

DPW-ED.

d. Once electronic files, hard copies and payment are received and complete, DPW – ED will eFile the LDA Permit Application through the LIA eFile system.

e. If the project is over one acre and requires a NPDES NOI, the DPW will upload the project files into the GAEPD GEOS system to file the NOI. After the NOI has been submitted to GAEPD and the fees have been received, there is a 14-day waiting period prior to commencement of construction activities. The design professional will be responsible to provide a check to DPW-ED made payable to: EPD – Construction Land Disturbance Fees. DPW-ED will provide a copy of the NPDES NOI to the LIA for inclusion in the project review.

f. Projects that encroach within the 25-ft stream buffer, may require an EPD stream buffer variance (SBV) prior to commencement of land disturbance activities. The A-E of record is required to submit a written State waters determination request along with the technical justification and applicable portion(s) of ES&PCP to DPW- ED. DPW-ED will submit the A-E’s written State waters determination request to the LIA. The LIA will conduct a State waters determination. If the LIA determines that a stream buffer variance is required for the project, the LIA will provide written correspondence to the DPW-ED. DPW-ED will complete the EPD stream buffer variance application and submit the stream buffer variance request package to EPD for review and approval.

g. Projects that impact wetlands, conduct dredge and/or fill activities within Waters of the US are required to obtain a USACE 404 permit. The A-E of record is required to complete USACE Pre-Construction Notification (PCN) form, a copy of the wetlands delineation and any additional supplemental information and technical justification to be included in the PCN package and submit to DPW-ED. DPW-ED will review and submit the PCN package to the USACE Savannah District for review and approval.

h. The LIA has 45 days to review the LDA package (can happen concurrently with SBV and 404 permit reviews if the project also requires those permits). The LIA will review the submittal and either approve or deny the package. If the project requires a NPDES NOI, SBV or 404 Permit, the LIA will not give final approval of the project until copies of those items are submitted as part of the full project package. If the LIA denies the package submittal, deficiencies and comments are to be addressed and a revised package re-submitted to the DPW-ED for resubmittal to the LIA (these may be submitted electronically.) Once the package is approved by the LIA, the A-E will submit seven full size hard copies of the drawings to the DPW-ED. DPW-ED will hand carry the hard copies of the entire package to LIA for issuance of the permit.

i. Once ALL required permits have been obtained, DPW-ED will conduct a stormwater pre-construction meeting with the project manager and representatives of the contractor to include the contractor’s certified Level IA (Blue Card) erosion control site personnel prior to DPW remitting the LDA permit.

Helpful Information and Lessons Learned

a. Work with Ft Gordon DPW as early as possible in the design process. The 35% review meeting is not too early.

b. A State of Georgia GSWCC Level II Certified Design Professional licensure is required to design the Erosion & Sediment Control drawings and calculations.

GSWCC (Georgia Soil & Water Conservation Commission).

c. The “Georgia Stormwater Management Manual, Stormwater Quality Site Development Review Tool” spreadsheet is required as part of the calculations.

d. Drawings size to Augusta/Richmond County is 24” x 36”.

e. Use the current erosion & sediment control details from the Georgia Manual for Erosion & Sediment Control (Green Book).

f. Use the latest Georgia Stormwater Management Manual for stormwater design (Blue Book).

g. Provide a narrative of the site in the Hydrology Report. The narrative shall include the following information:

I. Site Information, total project area, total disturbed area, total surface drainage area, pre & post impervious area

II. Downstream Storm Water Network Analysis (simply a paragraph describing the downstream storm water system).

III. Describe how the design provides stormwater storage IV. Describe how the design provides stormwater pre-treatment V. Provide information on any temporary sediment basins

h. A “Water Quality Chart” is required on the cover of the ES&PC plan set that lists the following:

I. Stormwater quality feature number II. Stormwater quality feature location (sheet number) III. Type of stormwater quality feature (basin, check dam, hydrodynamic separator) IV. Manufacture of unit V. Unit model number if applicable VI. Flow capacity (CFS)

i. On the plan view, show all proposed storm piping as two black lines, to scale, with hatch and flow arrows. Label the size and material on plan view. Show all existing storm piping as two gray lines, to scale, with hatch and flow arrows. Label the size and material on plan view. (This is a DPW-ED request to aid in expediting plan reviews)

j. Richmond County / City of Augusta mandate that the minimum storm water piping size is 18” RCP.

k. Provide the GPS coordinates of the proposed Construction Exit (CO) on the cover sheet. Also, ensure the CO layout on the plan view is exactly as shown in the detail.

Show all dimensions on the CO on the plan. They must match the detail exactly.

l. Show design data at all outfalls or tie-in on the plan sheet.

m. Very important to note: All roof run-off must be pre-treated, even if the project is just a renovation and no additional rooftop is added.

n. Be sure to note that the LIA’s requirements for eFile are different than the requirements for Ft Gordon DPW as well as COE CAD standards AEC CAD standards. See the list of items at the bottom of the “Land Disturbance Permit Application_FtGordon.docx”

o. A/E to pay LIA prior to Ft Gordon DPW submittal to LIA. LIA will provide a form to pay with a credit card via a fax transmittal.

Fort Gordon Permit Process

Project Proponent or Contracting Agency, 4283, or 1391.

Any project disturbing land within 200 feet of State Waters will require Land Disturbance Activity (LDA) permit, projects equal to or over 1 acre require Stormwater Construction (NPDES) permitting and an LDA. At any time in the life of a project the 1 acre threshold is exceeded an NPDES permit is required. Projects disturbing 5000 sq ft or more will also have to address Post Construction Stormwater Management to the (MS4) and Energy Independence Security Act Requirements for Stormwater. All permitting requires an Erosion Sedimentation Pollution Control Plan (ES&PCP), Hydrology Report (HR), NPDES Checklist, and permit fees to both the Local Issuing Authority (LIA) and the GA EPD.

The Director of Public Works is the Permit Authority for all Erosion and Sedimentation Control requirements at Fort Gordon.

**LIA’s perform the State review for Clean Water Act for Erosion and Sediment Control they have been delegated this Authority by the GA EPD and GA Soil and Water Conservation Commission.

1. ES&PCP and HR The ES&PCP and HR must be submitted to DPW/Environmental Division (ED) Bldg 14600 for review (21 days) and approval. DPW/ED unapproved ES&PCPs will be returned to proponent to address DPW-ED review comments, implement necessary ES&PCP revisions and re-submit to DPW/ED for review and approval.

*If the project disturbs 50 acres or greater, the A-E’s technical justification along with a copy of the will be submitted to EPD for review and project approval. Once written approval has been provided by EPD, DPW/ED will conduct the ES&PCP and HR review and approval.

2. DPW-ED ES&PCP Submittal to LIA DPW/ED approved ES&PCPs, HRs and LIA permit fees will be submitted to the applicable LIA (Richmond/Columbia /McDuffie Co.) for review and approval. (45 days) The LIA’s will review and either approve or deny the submittals.

3. LIA Review LIA approved ES&PCPs will be permitted via the LIA’s issuance of an LDA permit. The LIA will notify DPW/ED if ES&PCP submittals have be unapproved/denied. DPW/ED will forward the comments to the POC for denied submittals. The POC must address the comments and/or necessary revisions to the ES&PCP and submit a copy of the revised plans to the DPW/ED with LIA’s required re-submission fee.

The review process will then restart. (21 to 45 days).

4. Submission of NOI DPW/ED will submit a Notice of Intent (NOI) to EPD via the Georgia EPD Online System (GEOS) 14 days prior to work to initiating construction activities/land disturbance.

The LDA permit requires a pre-con meeting prior to work and issuance.

5. Submission of Stormwater Permit Fees Stormwater fees are $80.00 per disturbed acre ($40 per acre to EPD and $40 per acre to the LIA).

Permit fees are to be paid in two separate checks, one to the LIA one to the GA EPD. A third fee and check for the LIA review fee is required also based on size.

6. Stormwater Permit Issuance Once the ES&PCP has been approved, the NOI has been submitted, and all applicable fees have been paid, the LIA issues the (LDA) permit to the DPW/ED. DPW/ED will provide the permit to the POC at the PRECON Meeting.

7. Project Completion For all permitted construction projects a Notice of Termination (NOT) must be submitted to EPD and the LIA once completed. DPW/ED and LIA must perform final site-inspection to determine compliance with all erosion control requirements before NOT is submitted (site inspections, monitoring, etc. must continue until the NOT had been filed and all construction project records must be maintained by the DPW/ED for three years after completion of project). No project will be released until site has achieved final stabilization, copies of records provided to DPW/ED and the DPW submits an NOT.

Stormwater Permitting Process for LDA and NPDES SUBMIT TO DPW/ED DPW/ED submits to LIA LIA approves and issues and NOI to Georgia EPD LDA, Project may commence.
