About this file

This is a Recovered Materials Determination Form used for federal procurement compliance related to environmentally preferable purchasing requirements under FAR 11.002(c).

The form applies to the "Demolition IDIQ CCSFS/PSFB & Annexes" procurement and consists of three components: Part 1 (Design/Procurement), Part 2 (Construction), and a Waiver Form. Part 1 requires the specifying authority to identify whether EPA-designated items apply to the procurement by selecting from comprehensive product categories including construction products (insulation, carpet, concrete, roofing materials, etc.), landscaping products (compost, mulch, plastic lumber), park and recreation products, non-paper office products, paper and paper products, vehicular products (oils, retread tires), transportation products (cones, barricades, delineators), and miscellaneous products (pallets, signage, sorbents). Upon completion of Part 1, the specifying agent must certify either that no EPA-designated items are included, that EPA recycled content requirements have been specified for all designated items, or that exemptions apply with documented justifications. The form is not required for construction purchases under $2,000 or other purchases under $3,000. Part 2, completed upon delivery of goods and services, requires contractor/supplying agent certification that EPA recycled content requirements have been met, with the same exemption options available using justifications for non-availability (competitive sourcing, reasonable timeframe), unreasonable pricing (life-cycle cost analysis), or failure to meet performance standards per NIST guidelines. The Waiver Form provides a template for documenting individual exemptions with required signatures from the design/specifying agent, requiring organization's technical representative, and contracting officer, along with detailed rationale including vendor information and cost analysis per 42 USC 6962(c)(1).
