About this file

This file is a FAR 52.212-2 evaluation clause for commercial products and services that establishes the criteria and process for evaluating offers in this solicitation for Comprehensive Business Financial Capability Assessment Licenses.

The Government will award the contract to the responsible offeror whose conforming offer provides the best value based on three evaluation factors: technical capability, past performance, and price. Technical evaluation will assess how well the proposed product meets the Government's needs and delivers best value for accomplishing all technical specifications. Past performance will be evaluated using multiple sources including the Contractor Performance Assessment Reporting System and other Government and non-Government sources, with consideration given to relevant subcontract experience. Price evaluation will be based on competitive firm-fixed-price quotes calculated as a Total Evaluated Price (TEP) encompassing all Contract Line Item Numbers, including options. The Government will also evaluate the option to extend services under FAR 52.217-8 by calculating 50 percent of the Option Year 4 quote price and adding it to the TEP; however, offerors should not include FAR 52.217-8 pricing in their quotes. The Government reserves the right to determine offers with significantly unbalanced option prices as unacceptable. Quotes must be received no later than May 4, 2026, at 1000 Eastern Daylight Savings Time, with late submissions ineligible for consideration. Award will be made by written notice of acceptance to the successful offeror, creating a binding contract without further action required.

52.212-2 Evaluation—Commercial Products and Commercial Services.

As prescribed in 12.205(a)(2), insert a provision substantially as follows:

EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (DEVIATION DATE)

(a) Evaluation factors. The Government intends to award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation technical specifications will be most advantageous to the Government (price and other factors considered) and will be conducted in an efficient and minimally burdensome fashion.

The following factors will be used to evaluate offers (not in any particular order of importance): (i) technical capability, (ii) past performance, and (iii) price.

(1) Technical. Technical evaluation will be based on how well the proposed product meets the Government’s needs and presents the best value to the government for accomplishing all technical specifications.

(2) Past performance. Past performance will be considered from a wide variety of sources both inside and outside the Government. This may include reviewing performance information reported to the Contractor Performance Assessment Reporting System, as well as other sources of information. Subcontract experience within the technical specifications may be considered.

(3) Price. The offeror’s Firm-Fixed-Price quote will be evaluated using FAR Overhaul part 12.203. Price evaluation will be based on competitive quotes. If competition does not exist, the offeror shall submit other than certified cost and pricing data as outlined in DFARS clause 252.215-7010.

The Government will also evaluate the offeror’s Firm-Fixed-Price quote to determine a Total Evaluated Price (TEP). The TEP shall include all Contract Line Item Numbers (CLIN), including all option CLINs. As part of the price evaluation, the Government will evaluate its option to extend services under FAR 52.217-8 by calculating the price of one half of the Option Year 4 quote price and add it to the TEP. The offeror shall not include the FAR 52.217-8 pricing in its quote. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(b) Basis for award. The Government intends to award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government (price and other factors considered).

(c) Offers. An offeror’s quote must be received no later than May 4, 2026, 1000 Eastern Daylight Savings Time. Quotes received after this time will be considered late and may not be considered for award.

A written notice of award or acceptance of an offer, emailed to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offeror’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
