About this file

This document is Amendment 09 to Solicitation 75H70125R00026 for the Pueblo Pintado Health Center Construction project. The amendment modifies the solicitation by updating the Small Business Subcontracting Plan requirements and providing responses to 14 contractor questions covering topics such as water rates, subcontracting plan submission timing, document page numbering, utility arrangements, and site logistics. Key changes include allowing Large Businesses to submit Subcontracting Plans after Source Selection but before contract award, confirming that external documents like CPARs do not require page numbering, and clarifying contractor responsibilities for temporary utilities, worker accommodations, and excess soil removal.

The underlying contract is a Firm Fixed Price construction project for the Indian Health Service to build a 125,884 gross square foot health center on tribal trust land near Pueblo Pintado, New Mexico. The facility will serve approximately 6,000 American Indian & Alaskan Natives across multiple communities, providing expanded outpatient, community health, and ancillary services. The project is fully designed as a bid-build procurement, unrestricted and open to businesses with average annual revenues under $45 million. The construction duration is 730 calendar days, with the site located approximately 89.80 km west/southwest of Cuba, NM, and will cost over $10 million.

SUMMARY OF CHANGES

A. In Section I, delete FAR clause 52.219‐9 Small Business Subcontracting Plan – Alt II (Nov 2016) (Sep 2023).

B. Incorporate by reference FAR clause 52.219‐9 Small Business Subcontracting Plan (Jan 2025).

C. Provide the following Questions and Responses:

1. Question: The contractor is responsible for costs of construction water. What are the water rates for

Pueblo Pintado?

Response: The contractor should reach out to the Navajo Nation Department of Water Resources to inquire about water rates. See below for POC:

Marjorie Natonabah, Senior Office Specialist Navajo Nation Department of Water Resources Technical, Construction & Operation Branch Navajo Route 12 NE Former NTUA Hqtrs Road, Bldg. 2905 PO Box 678 Fort Defiance, Arizona 86504 Ph: (928) 729‐4159 Cell: (505) 701‐7477 Fax: (928) 729‐4421 www.watercode.navajo‐nsn.gov

2. Question: With the design‐bid‐build nature of the procurement, typically qualified subcontractors will not receive vendor pricing for major components until the last minute. The Subcontracting Plan cannot be started until the bids are in and all proposals can be evaluated to assess qualifications and pricing. This will require the offeror to exclude many qualified bids that would otherwise benefit the government with a more cost‐competitive price in an effort to complete and return these administrative deliverables in time to meet the deadline. Because of this, many government entities instead either allow offerors to submit this type of data within 24 hours of bid submission. Others do not require this until after source selection but prior to final award. Therefore, with these circumstances, and the mutual interest of securing a best value, cost competitive pricing for the government, we respectfully request the government either allow these deliverables to be submitted within 24 hours of the proposal, or as a condition preempting award as the successful offeror.

Response: Subcontracting Plans should be submitted after Source Selection and Best Value Determination, but prior to contract award. This applies to Large Businesses only. Change Section L.11.2.2.d (Volume II, Factor 5: Price) to the following: In accordance with FAR 19.704, in the event that a Large Business is the anticipated awardee, the Large Business offeror shall submit Attachment J14, Subcontracting Plan prior to award. The Subcontracting Plan will be reviewed and negotiated in accordance with FAR 19.705‐4. Large Businesses shall comply with FAR Clause 52.219‐9, Small Business Subcontracting Plan (Jan 2025).

3. Question: Please confirm that CPARs, bid bonds and other external documents are not required to have page numbering, etc, as this would require manipulation of a document not owned by us; rather the intent is to number contractor‐generated narratives.

Response: The documents identified in the Question are not required to have page numbering and are not counted towards the page limitation.

4. Question: Please identify in which factor of the technical proposal the Teaming Arrangements for Key Subcontractors shall be placed, as they are referenced multiple times. We are assuming Factor 2: Technical Approach.

Response: Teaming Arrangements may be included anywhere in Volume I; however, their location must be identified in the proposal’s Table of Contents. Teaming Arrangements do not count towards the page limitation.

5. Question: Please identify whether the subcontracting goals listed in J14 Subcontracting Plan are based off the total value of the acquisition or the subcontracted value.

Response: The goals are based off the total value of the acquisition.

6. Question: Are subcontractors required to have a NM contractor’s license?

Response: Contractor’s should reach out to the the state of New Mexico to determine contractor license requirements. The Indian Health Service (IHS) does not require such a license on this project; however, if New Mexico requires it at the state level, then the contractor will be required to obtain one.

7. Question: Regarding the LP Gas Tanks for the site, are these an owner furnished item or will the contractor/subcontractor need to provide them.

Response: Contractor to provide and install.

8. Question: Temporary water will be required for various work activities during construction. Are tap fees required to temporarily bring water to the job site from nearby water lines? Will water usage be paid for by the owner or contractor?

Response: Water needs to be arranged by the contractor through the NTUA. Cost will be paid by the contractor.

9. Question: Temporary electrical will be required for various work activities during construction. Are any utility fees required? Will electrical usage be paid for by the owner or contractor?

Response: Temporary Electrical needs to be provided by the contractor through arrangement with the Jemez Electrical Co‐op. Cost for installation of temporary power and power usage is to be paid by the construction contractor.

10. Question: Per Amendment 7, the Navajo Nation has previously allowed trailers on site for workers during construction. Can you confirm this project will allow for that? Additionally, is there a specific location on the property where we can set up a temporary camp?

Response: Contractor needs to assume they have to make an arrangement with the local tribal chapters for a lease of land if they choose to install trailers for living. Cost of leasing land, land preparation, trailers, installation of power, water or other services needs to be arranged through the local utilities and is to be paid by the contractor.

11. Question: Per Amendment 7, liquidated damages are not included in the project. However, in the RFP solicitation under section E.3.a.4, 10% of funds may be withheld. Can you please clarify this?

Response: Liquidated damages, which refer to agreed‐upon pre‐established daily rates that are charged to the contractor for such damages, are not in this contract. Section E.3.a.4 refers to a withholding of the contractor’s progress payment (up to 10%) that the Contracting Officer may impose if the contractor has not completed the work satisfactorily by the time of the agreed upon end date of the contract. This withholding is returned to the contractor once the work has been satisfactorily completed. The reference to liquidated damages in this section only applies if the liquidated damages clause is included in Section I;

in this solicitation, it is not included.

12. Question: Will a stockpile location be provided for excess dirt from excavation? Our assumption is that this will remain on site at the conclusion of the project.

Response: Excess soil at the conclusion of construction is to be removed and disposed of by the construction contractor.

13. Question: We request the Period of Performance be adjusted to 900 days.

Response: The Period of Performance remains unchanged at 730 calendar days.

14. Question: Does all exported dirt need to be removed from the Pueblo?

Response: A large portion of the soil is intended to be used for grading but it’s common to allow stockpiling during construction. Contractors shall remove unused excess soil at the end of the contract.
