About this file
This document is a Questions and Answers (Q&A) file for a federal solicitation that is a 100% 8(a) Small Business set-aside procurement under NAICS Code 561210. The solicitation offers a contract opportunity with an extended offer receipt date of November 14, 2025, after the government agreed to a two-week deadline extension to allow offerors more preparation time.
Key details include site visit requirements for multiple locations in Laredo, TX during October 15-17, 2025, with specific times and meeting locations for sites like the World Trade Land Port of Entry, George P. Kazen Courthouse, Colombia Land Port of Entry, Border Patrol Headquarters, Juarez Lincoln Land Port of Entry, and Convent Land Port of Entry. The procurement requires past performance questionnaires for three different projects completed within the last five years, with a maximum of four representatives allowed to attend site walks. Offerors can include past performance from sister companies, and teaming agreement partners are not considered subcontractors. The solicitation clarifies that both the prime 8(a) contractor and teaming partners can submit relevant past performance information.

Answer
In Section L.12, page 279, paragraph 8, instructions for Factor 2 note that “the offeror is defined as the entity that is submitting the offer – and not its subcontractors.” Would GSA please clarify/expand the definition of “offeror” in the quoted sentence to include sister companies (subsidiaries owned by the same parent company as the offeror)? Many federal contractors in the construction business are small business LLCs with sister companies that share the same leadership executives, the same best practices and operating procedures, the same lessons learned from past contracts, and the same corporate systems and support services. As such, in terms of past performance, projects performed by sister companies can be good representations of the offeror’s capabilities and good indicators of future performance. And if the sister company proposes to provide support to the prime contractor on this project (for example, in the form of part-time subject matter expertise or full-time employee transfer), the sister company’s past performance can help demonstrate the capabilities offered by the prime contractor’s (offeror’s) organization.
Answer FAR Part 2 "Offer means a response to a solicitation that, if accepted, would bind the offeror to perform the resultant contract.
In Section L.12, page 280, paragraph 2, instructions for Factor 2 note that “Past performance will be considered relevant if… (2) The contract is/was in place for at least two consecutive years [and] (3) The contract was completed within five years from the closing date of this solicitation.” For contracts with a base year and multiple option years, may we consider an ongoing contract “complete” and meeting the stated requirements 2 and 3 if the base year and option year one are complete?
Answer Yes. The offeror must have references to submit 3 different projects within the last 5 years of the closing date of this solicitation cumulatively demonstrating that the offeror has successfully performed contracts for similar services.
The first paragraph in Section L.8 (page 271) notes that site visit times may vary depending on the number of attendees. Is there a limit to the number of individuals we can have attend the site walk and if so, what is that limit?
Answer The number of registered offerror to attend the site walk is up to 4.
Page 1 of the solicitation notes that the offer receipt date is 11/02/2025. We kindly ask that due to the robust nature of this RFP and our desire to put forth a thoughtful, complete, comprehensive, and cost competitive proposal in response, the government consider extending the proposal due date by an additional 3 weeks. This additional time will allow for additional competition at the prime and subcontract level, ensuring best available pricing for the government, as well as sufficient time to process the information learned at the various site walks and via the answering of all submitted RFIs, resulting in the most thorough response possible.
Answer The government extended the offer receipt date to 11/14/2025.
Section L.12 Technical Proposal Instructions. Factor 2 Past Performance. Experience "The offeror is defined as the entity that is submitting the offer and not its subcontractors" Evaluation of Joint Venture Offerors: "For offers from Joint Ventures, projects shall be submitted from all firms listed in offerors submittal for L.14 Joint Ventures, Partnerships and other teaming arrangements, A minimum of 1 Past Performance project must be submitted from each member of the joint venture. An offeror shall also submit a Past Performance record for a Joint Venture, Partnership or other teaming arrangements in which they were a party and must clearly specify their role and contribution to the joint venture.
Section L.14, Joint Ventures, Partnerships and other teaming arrangements, Joint Ventures. This section states, "Partnership or other teaming arrangement must provide documentation supporting their arrangement to include the name, address, and point of contract for each participant. The documentation shall include a description of the roles and responsibilities of each participant to include the employer-employee relationship of key personnel."
Does "other teaming arrangement" equate to a Teaming Agreement between the 8(a) prime and its partner?
Answer Yes.
14 Does GSA consider a Teaming Agreement partner as a subcontractor?
Answer No.
Under a Teaming Agreement can both the offeror (i.e. 8(a) Prime) and the TA partner submit relevant past performance to meet minimum submittal requirements, and will GSA consider the collective past performance and experience of the TA offeror and partner?
Answer Yes.
