About this file

This document is a Technical Questions and Solicitation Responses Tracking Sheet for a VA construction project at the Murfreesboro medical facility. The solicitation (36C77625B0035) is a 100% Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside for constructing a Sleep Disorder Clinic and Specialty Clinics, involving minor construction work. Key technical details include extensive modifications to an existing building, including window replacements, low voltage systems integration, potential hazardous material (asbestos) removal, and system upgrades for security, access control, nurse call, and audiovisual infrastructure.

The tracking sheet contains 117 detailed technical questions and responses covering scope of work, system specifications, phasing requirements, and technical clarifications. Critical project elements include replacing windows with blast-resistant systems, integrating new technology systems with existing infrastructure (using brands like Axis, CCure 9000, and Rauland Responder 5), managing asbestos removal, and ensuring compatibility with existing VA campus systems. The project will require separate superintendents, safety officers, and quality control managers, with work to be performed outside normal business hours and with specific requirements for system installations, demolition, and integration.

The new administration has indicated that they intend to impose tariffs on many imported goods. Under the Buy American Act components of end products that are sold to the federal government can also be subject to tariffs. These tariffs will most likely cause a significant escalation in material and equipment prices at the time of implementation not only for imported goods, but also items produced domestically that compete with imported goods. Tariffs may also delay the receipt of material/equipment processing times at the ports of entry. The potential monetary and schedule impacts are impossible to quantify prior to any action being taken by the administration. If tariffs are instituted after award of a contract, will the Government provide relief through a contract modification for any unforeseen cost escalations and/or schedule delays created by tariffs?
If after the contract is awarded, the contractor becomes liable for an increase (or receives a reduction) in a federal excise tax or duty “which was not otherwise anticipated,” the contract price may be adjusted accordingly.

To recover under FAR 52.229-3, the contractor generally must show that:

The tariff was not in effect or anticipated at the time of award;

The tariff is a federal duty or tax covered by the clause;

The tariff directly increased the contractor’s cost of performance;

The contractor timely notifies the contracting officer of the change; and The contractor can substantiate the increased costs attributable to the tariff.

Please advise if there will be any exceptions for materials or system equipment from the BAA.
The process of requesting exceptions to the Buy American Act is detailed in the provision at FAR 52.225-12, Notice of Buy American Requirement—Construction Materials Under Trade Agreements, and the clause at FAR 52.225-11 Buy American—Construction Materials under Trade Agreements, in the solicitation. The VA anticipates that any of the materials or systems necessary for the project will comply with the BAA requirements.

Could you please confirm if this is the intended approach?

Going over the building vs. the windows installed similarly to the recent window replacements at the Renovate 1B project (Blue Cord) and Building 5 (DMC) I'm referring to the method where the existing window cladding covering the concrete-filled hollow metal frames remains, and only the operable window portions are removed and replaced with the new blast-mitigated window system with integral blinds.

This is correct. The frame set inside the existing aluminum frame is what should be replaced. Similar to Ward 1B as mentioned.

In the drawings:

There are:

Qty. 30 of the E size windows (plans show to change 20)

Qty. 29 of the A size windows (plans show to change 26)

Qty. 18 of the C size windows, plans match

Qty. 8 of the D size windows, plans match

Qty. 2 of the B size windows, plans match

The drawing labels (A) and (E) do not match up with the different window sizes accurately as they are on the building. Some of the windows are not shown on the drawings at all vs what is actually there.

Sheet AE01.01B Plan C in areas G11 and G12 shows Qty. 3 windows on the plan but no mention of replacing or existing window to remain.

Sheet AE 01.01C Area D Copy/print G25A shows a window in the wall but no mention of replacing or existing window to remain.

Sheet AE 01.01C Area D Work G026F shows a window in the wall but no mention of replacing or existing window to remain.

Just wanting to check as much as possible before we begin that we are covering this correctly. There are also some of the windows they are calling out to remain that are in pretty poor condition, even to have a wall built interior to cover them up.

The 10 E windows not shown as replaced will be covered up will a wall and resealed. The windows will remain in place.

Window A shall be replaced as noted on the plan

Windows in G11 and G12 are to remain as is shown on the documents

Window outside of Copy print area isn’t actually a window and is currently covered up.

Window that is adjacent to G-026F shall be replaced as window E.

From YKK engineering:

YKK cannot provide an integral blind on the basement windows (20) because the minimum height of the window would have to be 20” whereas these are 12 5/8” tall.

A Frosted Glazing film on window C will be acceptable. See updated Glazing section 2.13 B.

114
Will obscure glass be okay to provide privacy or do we want to provide normal vision glass and just leave off mini blinds for the basement windows?
A Frosted Glazing film on window C will be acceptable. See updated Glazing section 2.13 B.
