TECHNICAL QUESTIONS AND SOLICITATION #: 36C77624R0096
RESPONSES TRACKING SHEET PROJECT TITLE: Boise Construct Primary Care/Mental Health Building
# RECEIVED ANSWERED CONTRACTOR QUESTION VA RESPONSE
1 05/22/24 08/01/24 Concerning the subject project presolicitation that was posted to Sam.gov, in the first part of the description it states “minor” construction project, and then later in the description it states the magnitude of construction is between $20 and 50 million.
It’s my understanding that that “Minor” projects were capped at $20 million.
Is this a minor project, capped at $20 million or is the stated magnitude of $20 – 50 million correct?
This is a Minor project, and the stated amounts are correct. The Minor Construction threshold was increased from $20,000,000 to $30,000,000 in the National Defense Authorization Act for Fiscal Year 2024 (Public Law 118-31).
2 07/22/24 08/01/24 Due to the instability in our current economy such as price escalations, procurement issues, and vendors unable to reasonably hold prices for more than 30 days, please change the contract type to a fixed-price contract with economic price adjustment pursuant to FAR 16.203.
In accordance with FAR 16.202 and 52.216-1, this requirement will remain a firm-fixed-price contract.
3 07/22/24 08/01/24 Due to the instability in our current economy such as price escalations, procurement issues, and vendors unable to reasonably hold prices for more than 30 days, please reduce the price-hold period to 30 days.
The Government standard concerning price-hold period is 90 calendar days and will not be altered.
4 07/22/24 08/01/24 Will the government pay for materials stored per VAAR 852.232-70 and FAR 52.232-5? We have experienced PCAC Contracting Officers refusal to pay for materials stored on site during these periods of material shortages and the need to expedite procurement of materials when available to meet schedule obligations and prevent project delays. This is an important factor in preparing Price proposals.
In accordance with contract terms and conditions, contractors should not prepare proposals assuming the Government will approve monthly progress payments for material and/or equipment procured by the contractor and stored on the construction site, as space is available, or at a local approved location off the site.
Payment of stored materials and/or equipment is at the Contracting Officer’s discretion and will be handled on a case-by-case basis during the contract and under such terms and conditions as the Contracting Officer approves.
5 07/22/24 08/01/24 Please confirm that any designers or consultants who provided professional services for the construction documents, including reports, are precluded from pursuing this project as a Prime contractor, Mentor-Protégé partner, or subcontractor.
Any member of the design team of this project is not permitted to be part of the construction team.
6 07/22/24 08/01/24 Please confirm that any bonding provided by an SDVOSB/VOSB contractor must be through an SDVOSB/VOSB or SBA/VA APPROVED Mentor-Protégé partnership under the SBA/VA Mentor-Protégé program in which the partnership has been approved prior to the proposal due date.
The bonding requirements must be met for this project, within the applicable tier, per the applicable clauses, provisions, and instructions to offerors.
7 07/22/24 08/01/24 Please confirm that if this project is awarded to an SDVOSB/VOSB, a large business not part of an SBA/VA APPROVED Mentor-Protégé team under the VA Mentor- Protégé program cannot provide a bid guarantee or a payment & performance bond for an SDVOSB/VOSB.
The bonding requirements must be met for this project, within the applicable tier, per the applicable clauses, provisions, and instructions to offerors.
8 07/23/24 08/01/24 Who is the Contracting Officer’s Representative for this project?
Michael Diller is the COR for this project.
9 07/23/24 08/01/24 Is this project tax exempt? No. See Special Note regarding FAR 52.229-3 Federal, State, and Local Taxes in the solicitation. It is solely the responsibility of the offeror to include all state and local sales or use taxes for construction materials, and all other applicable taxes, in their proposal price.
10 07/23/24 08/01/24 Please confirm that this project is not considered design build where the contractor is responsible for design.
Confirmed. This project has already been designed.
11 07/15/24 08/01/24 On RFP Page 12 of 81 it states the offeror must submit a complete breakdown of the division pricing for Line Items 0001- 0004 using the provided Division Cost Breakdown form. This form includes tabs for each division, and each tab seems to require a detailed division breakdown including each individual item in the estimate. Our company relies on a trusted estimating software that’s been around for decades, and we simply do not trust an Excel workbook developed by others to assemble our estimates, especially for a project of this magnitude and complexity. Who will be liable for calculation errors in this workbook? Attempting to include this type of detail on this form by the bid deadline would be extremely cumbersome, as subcontractor quotes invariably will come in right up to the last minute. Also, this Excel form does not follow our company’s standard estimating and accounting procedures of calculating our markup costs. Lastly, this form does not provide a means to break out estimated costs for the add alternates CLINs 0002 – 0004. We believe that requiring this level of detail to be provided on this form with the proposal presents an unnecessary burden to the offerors on this competitive acquisition. Our estimating software has the capability of generating a report that provides the same level of detail as the Government’s Division Cost Breakdown form. We respectfully request the Government allow us to submit a Division Cost Breakdown report generated by our trusted estimating software, or confirm that offerors are only required to fill out the Summation tab of this form. Or, at a minimum, please consider allowing this form to be submitted 24 hours after the proposal time to allow offerors adequate time to transfer the numbers from their own trusted estimating platforms to this form.
The VA will accept the division pricing breakdown on an alternate form as long as equivalent information is provided.
The contractor is responsible for ensuring there are no calculation errors in their breakdown, even if using the provided Excel workbook.
12 07/22/24 08/01/24 The RFP indicates that the Division Construction Cost Breakdown Spreadsheet is required for each CLIN. Please confirm that this is required and not only for the Base Bid.
Yes, the division pricing breakdown is required for all four line items. How this is accomplished is up to the contractor. The workbook provided can be altered or a custom breakdown can be submitted.
13 07/22/24 08/01/24 Will the VA consider extending the due time for the Division Cost Breakdown Spreadsheets as confirming bid numbers on bid day can be time consuming?
As the VA is allowing an alternate form to be used (see response to question 11), we will not be allowing additional time to submit the division pricing breakdown.
14 07/23/24 08/01/24 Please confirm if the VA will be enforcing the requirement set forth in specification section:
4.2 52.211-12 LIQUIDATED DAMAGES—CONSTRUCTION
(SEPT 2000)
(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $1,120.00 for each calendar day of delay until the work is completed or accepted.
(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
Yes, the VA will be enforcing this requirement.
15 07/22/24 08/01/24 Are there any “Buy American” requirements for equipment and products on this project?
Yes. See the provision at FAR 52.225-12, Notice of Buy American Requirement—Construction Materials Under Trade Agreements, and the clause at FAR 52.225-11 Buy American—Construction Materials under Trade Agreements, in the solicitation.

Given the size and scope of this project, a single QC person is an appropriate level of staffing.
22 07/22/24 08/01/24 In regard to the RFI above, we request that those requirements be waived, as there will be a high-cost impact to the project considering this is a Bid-Build non overly complex project.
