To replace original RFP on page 44. Updated June 2024. Special Notes regarding FAR 52.229-3: Federal, State and Local Taxes:
Offerors are hereby notified that under the State of Rhode Island General Laws, Title 44 – Taxation, Chapter 18 - Sales and Use Taxes — Liability and Computation, Section 44-18-30(5)(ii), in the case of contracts entered into with the federal government, its agencies, or instrumentalities, the contractor may purchase such materials and supplies (materials and/or supplies are defined as those that are essential to the project) that are to be utilized in the performance of the contract without payment of sales or use tax. Therefore, the contractor’s purchase of such building and construction materials within the State of Rhode Island to be incorporated into the real property belonging to the U.S. Department of Veterans Affairs (VA) is subject to the exemption from The State of Rhode Island Sales and Use Tax. To take advantage of the tax exemption the successful offeror under this solicitation must complete the “State of Rhode Island – Division of Taxation Sales and Use Tax, Contractor’s Exempt Purchase Certificate” when it purchases construction materials for this contract and keep on file as required by The State of Rhode Island Tax Law.
Notwithstanding FAR 52.229-3, all bids received in response to this solicitation are presumed to reflect this tax exemption, and therefore should not include The State of Rhode Island Sales and Use Tax on sales of materials for incorporation into VA real estate under this contract.
