The purpose of this amendment is to provide answers to RFIs submitted for the MATOC solicitation.
RFIs for MATOC IDIQ Solicitation 36C25920R0104 Question 1 - The solicitation documents read as the Design-Bid-Build task orders being a ‘1-step’ and that the design-build task orders being a ‘two-step’. Could you help us understand what that process would entail since the offeror has to provide a letter of commitment from the A/E firm in “Factor 2: Design Experience” Is there the potential for Task Order requiring A/E Renderings or design-development documents?
Response: The way this is working is that there will be TO’s for Bid Build and Design Build. If the TO is for a Design Build you will provide us with a Letter of Commitment for the A/E you are teaming with. There will not be TO’s for Design only.
Question 2 - For D-B Task orders can you provide a level of expectation for the design build level of effort? Will there be ‘bridging drawings’ provided with the RFPs completed to a certain percentage of complete, typically 35-55%, or will the Design Builder Offeror expect that there will be MEP, structural, civil etc. that must be started at 0%?
Response: Typically, we have at least a 35% Design for Design Build Projects.
Question 3 - In the previous RFI responses someone mentioned this requirement. The solicitation calls for a list of MATOC contracts and resultant Task Orders from the contractor. Is the Prime Contractor to provide a list of all MATOCs and Task orders we have been awarded somewhere in the proposal?
Response: The following statement is not in the solicitation “The solicitation calls for a list of MATOC contracts and resultant Task Orders from the contractor.” Please refer to Factors 1 through 3 in the solicitation for what is required to be submitted.
Question 4 - FACTOR 4: Capacity- Additionally, offerors will be evaluated on the volume of work awarded by the VA during the 12 months before the closing date. Can you elaborate on what we are expected to provide for this evaluation?
Response: This is deleted Question 5 - No personnel requirements are being requested. How can the VA ensure the firms are qualified if no personnel questions are being asked?
Response: This is not a requirement for this solicitation. It is the contractor’s responsibility to hire qualified personnel.
Question 6 - No bonding requirements are being requested. How can the VA be sure the SDVOSB’s admitted into the MATOC will have the bonding capacity to perform the work?
Response: Bonding will be required for all TO’s Question 7 - No financial responsibilities are being required. How can the VA be sure the prime contractors will be able to pay their subs and employees in a timely fashion?
Response: Before we award, we complete a responsibility determination on all projects.
Question 8 - Subcontractor performance is being weighted as favorably as the offeror. This opens the qualification pool up to literally any SDVOSB with a connection to subcontractors. A letter of commitment isn’t even being required for subcontractors (only A/Es).
It seems unfair to allow offerors into a 5-year contract based upon subcontractor experience.
Response: See solicitation page 15, Factor 2: Design Experience - The offeror may utilize experience of a subcontractor that will perform major or critical aspects of the requirement to demonstrate design experience under this evaluation factor.
Question 9 - Factor 2 is wholly focused on scope that will not be awarded under any task orders. Yes, design build task orders will be issued, but NO design only task orders will be issued. The offers should be graded on D/B experience, not design only experience.
Response: If you are teaming with an A/E for the Design Build Projects we need to be able to determine if they are qualified.
Question 10 - Please consider extending the Bid Date to allow employees time to vote.
Response: We are extending due to additional questions.
Question 11 - Amendment 5 there is an important question (Question 8) as to whether the project is tax exempt. The response was Government projects are tax exempt. This may lead a contractor to believe that the materials they purchase are tax exempt. However, in the past, the Government has been unable to pass their tax-exempt number on to us as a contractor if we purchase the materials. If the Government purchases the materials, then the materials are tax exempt. This could cost the contractor thousands of dollars as their bid would not include tax on materials. I am sorry to ask late, but I feel it is very important to clarify and to know if in the case of this and future projects if the Government would pass along their tax-exempt number to a contractor.
Response: All awards are tax exempt, and a tax-exempt certificate will be furnished upon request.
Question 12 - Is the minimum magnitude for Factor 2 Design Experience of $150,000 is the Design cost or the Construction cost.
Response: That is for the design cost.
