The purpose of this amendment is to answer RFIs that have been received.
RFIs for MATOC IDIQ Solicitation 36C25920R0104 Question 1 - Regarding the solicitation found in the subject line above, on page 14 of the solicitation, it states: Submit a minimum of five (5) to a maximum of ten (10) recent and relevant construction or design build projects completed by the offeror as the prime construction contractor. We would like to ask the ‘minimum of (5)’ past performances be changed to a minimum of (3) past performances, will you change this requirement to (3)?
Response: No, A minimum of five (5) to a maximum of ten (10) recent and relevant construction or design build projects completed by the offeror as the prime construction contractor will remain.
Question 2 – Will you consider changing the Special standards of responsibility to the attached language?
Response – No we will not change the language.
Question 3 – What needs to be provided for EMR and safety in the Special standards of responsibility?
Response – For Safety provide OSHA Form 300A. For EMR provide a letter from NCCI with your rating.
Question 4 - Multiple other VISN’s including VISN 17 and VISN 1 have issued construction (NAICS 236220) MATOCs with project size ranges, allowing smaller companies and the more established SDVOSB firms to compete at a project size that works well for them. Is the Government able to increase the efficiency of this MATOC by subdividing the task orders into at least three project size categories/brackets? Our experience has shown that it is useful for the brackets to follow general size ranges used by the government. Examples include task orders under $2 million, task orders between $2 million and $10 million and task orders over $10 million.
Response – At this time and for this MATOC the VA will not be subdividing task orders in different categories/brackets.
Question 5 – Will the contractor be considered delinquent and receive a lower CPARS rating (less than satisfactory) if they choose to not bid all the task?
Response – See page 11, section f: Each Contractor is required to submit a reasonable number of good faith proposals for TOs. Contractors are not obligated to propose on all Task Orders; however, they are required to contact the Contracting Officer within two days of notification if they cannot participate in the walk through or submit an offer. Failure to provide this notification may impact future consideration for TOs and exercise of an option. CPARS are only done on the Task Orders performed.
Question 6 – The solicitation calls for a list of MATOC contracts and resultant Task Orders from the contractor. If the entity is a joint venture, will the experience of each member be considered or only the experience of the Joint Venture?
Response –Only the experience from the Joint Venture will be considered.
Question 7 – Will the government consider a project that is more than 50% complete by the contractor as Recent?
Response – No, only projects that are complete within the past five years from the date of issuance of the Request for Proposal (RFP). That date is 30 September 2022.
Question 8 – Is this project sales tax exempt? If the project is sales tax exempt can the government provide a sales tax exemption certificate?
Response – This will be handled on individual Task Orders (TO).
Question 9 – Where will the designated parking area be for workers accessing the construction site?
Response – This will be handled on the individual TO’s.
Question 10 – Will the Owner accept the use of the industry leading Procore Project Management software as the primary submittal and data tracking tool for this project?
Response – That is an acceptable software.
Question 11 – How soon after award is NTP expected to be issued? This project includes a long lead item that will need to be submitted and approved which could take several weeks before the order is placed.
Response – Notice to Proceeds (NTP) are usually issued within 10 days after award if there are long lead times for material, we may consider an Administrative NTP.
Question 12 – Due to current potentially significant tariffs being placed on the importation of building materials such as wood or steel by the current Presidential Executive Branch, if a tariff is placed after bid time and before award will the government consider a price escalation on a contract value for products such as steel or wood should the executive branch levee tariffs effecting such materials? Most of these materials would still have been Buy American compliant as the tariffs would increase pricing on all steel or wood materials, regardless of origin.
Response – No, a price escalation clause will not be included.
Question 13 – As a result of the effect of COVID-19 throughout the U.S., and the resulting Federal, State and local governments’ responses / requirements of safe distancing and potential advocations of working remotely and/or complete organization closures, please advise how the Government intends to address delays resulting there as it pertains to the current solicitation schedule for this and all future projects.
Response – This will be addressed on each task order if this issue should arise.
Question 14 – Will pay applications for materials secured on site or in a bonded warehouse be approved for payment?
Response – Any materials accepted by the VA will be paid for.
Question 15 – Due to the current economic inflation, Will the government reduce the amount of time that contractors must hold their numbers to 60 days? By reducing the inflation risk, the government will avoid escalations costs those general contractors and subcontractor must account for.
Response – Due to the review process for this type of contract we request that all proposals have an acceptable period of 120 days.
Question 16 – Will the government consider the inclusion of an Economic Price Adjustment Clause in accordance with Federal Acquisition Regulations (FAR), Subpart 16.203 "Fixed-price contracts with economic price adjustment" and the related contract clause language in FAR 52.216-2, 3, 4? We believe such a clause is appropriate for the following’s reasons:
· The contract involves an extended period of performance with significant costs to be incurred beyond 1 year after contract award begins due to long lead materials.
· The contract amount subject to significant fluctuations in price is substantial; for example: electrical wiring has had significant price fluctuation and the wiring on this project may not begin for up to 6 months while the generator is procured, and
· The economic variables for labor and materials are too unstable to permit a reasonable division of risk between the Government and the contractor, without this type of clause.
Response – No, Economic Price Adjustment Clause will not be included in the contract.
Question 17 – In accordance with 13 C.F.R. § 125.8(e), please confirm that the government will accept the experience from either member of an SBA approved Joint Venture to meet the requirements of the solicitation?
Response –Only the experience from the Joint Venture will be considered.
Question 18 – It is becoming increasingly difficult to obtain Past Performance Questionnaires from Contracting Officers on a project-by-project basis, especially when they have already filled out a CPARS evaluation for us. Considering this, will the VA accept completed CPARS evaluation forms in lieu of the provided PPQ?
42.1501 General.
(b) Agencies shall monitor their compliance with the past performance evaluation requirements (see 42.1502) and use the Contractor Performance Assessment Reporting System (CPARS) metric tools to measure the quality and timely reporting of past performance information. CPARS is the official source for past performance information.
Response – Per the solicitation page 16, Factor 3: Past Performance - If a completed Construction Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 1 for construction experience. If a completed Architect-Engineer (A-E) CPARS evaluation is available, it shall be submitted with the proposal for each project included in Factor 2 for design experience. If there is not a completed CPARS for either construction or A-E evaluation, then submit Past Performance Questionnaires for each project included in Factor 1 and 2 for both Construction Experience and Design Experience.
Question 19 – Is a single-phase solicitation or a two-phase RFP? I’m confused as the description states that it is a two phase, but the RFP asks for the price for the seed project to be submitted with the quals. I don’t know what the Govt means by “two phase” or if that was left in as a copy/paste error from another RFP.
Response – This solicitation is for a Firm Fixed Price IDIQ contract. The work that will be performed under the IDIQ contracts will be general construction, two-phase design build and other related work.
Question 20 – Will the sign in list be provided by the end of the week to contact subs that were present?
Response – The sign-in sheet is uploaded to the attachments.
Question 21 – Would the Government have any issues with a GC contacting the DOR?
Response – Contractors should not be contacting the Designer of Record for questions or pricing for the seed project. Any questions regarding the seed project should be sent to the Contracting office.
