About this file
This document is a VA Notice of Limitations on Subcontracting—Certificate of Compliance for Services and Construction form (VAAR 852.219-75), dated January 2023. The form requires offerors to certify compliance with specific subcontracting limitations for different contract types: services (50% maximum subcontract to non-certified firms), general construction (85% maximum), and special trade construction contractors (75% maximum). The certification specifically applies to subcontracting with Service-Disabled Veteran-Owned Small Businesses (SDVOSBs) and Veteran-Owned Small Businesses (VOSBs) listed in the SBA certification database.
The document outlines strict requirements and potential penalties for non-compliance, including referral to the VA Suspension and Debarment Committee, potential fines under the Small Business Act, and possible prosecution for fraudulent certification. Offerors must complete, sign, and return this certification with their bid, quotation, or proposal, and failure to do so will result in the offer being deemed ineligible for evaluation and award. The form is specifically associated with solicitation 36C25225B0002 for a chilled water piping project at the Department of Veterans Affairs Veterans Health Administration.
