About this file
This document is a justification and approval for other than full and open competition for a federal contract opportunity with the Department of Veterans Affairs. The justification is for a sole source procurement of Stonhard flooring systems for use in various construction and renovation projects at the VA Pittsburgh Healthcare System facilities. Stonhard flooring has been the standard flooring used throughout VAPHS facilities due to its durability and resistance to pathogens, which requires less maintenance than other flooring options. As the flooring system is already in place across locations, using another flooring product would require duplication of maintenance materials and could expose patients to health risks. The justification argues that seeking competition would cause undue hardship on VAPHS operations. The related federal contract opportunity is for renovations to an examination room on the University Drive campus under a 100% Service-Disabled Veteran Owned Small Business set-aside, aiming to provide competition at the contract level while allowing for the sole source of the Stonhard flooring product.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The VAPHS uses Stonhard
Flooring Systems throughout all facilities on both the University Drive and Heinz Campuses.
a. Stonhard has been found to have the best performing results through the installation of various other products specified and installed at VAPHS.
b. The durability means less maintenance for our Facilities Maintenance and Repair Shops.
c. Stonhard product is a complete multilevel system that permits it to be installed on uneven, pre-existing conditions and pre-existing flooring.
d. It is very easy to routinely clean and disinfect by the custodial staff using common products eliminating the need to stock numerous different cleaning products.
e. All products have been authorized by Infectious Control, Safety, Patient Safety and EMS.
4. This item is being sole sourced under a larger construction project that will be competed as a 100%
Service-Disabled Veteran Owned Small Business (SDVOSB) set aside.
5. Statutory Authority Permitting Restricted Competition:
( X ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements
( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert
Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest
6. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The acquisition is authorized pursuant to 10 U.S.C. 2304 (c)(1), and is implemented by FAR 6.302-1 (c), Only one responsible source and no other supplies or services will satisfy agency requirements.
7. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Any action to increase competion for the suppliers of the Stonhard Flooring Systems would cause an undue hardship on the VA Pittsburgh Healthcare System. VAPHS has been making a conscious effort to standardize the finishes throughout the restroom, laboratory and clinical areas to make them more resistant to infectious pathogens and easier for the limited custodial staff to maintain. The installation of material finishes other than Stonhard would require duplication of maintenance materials and could expose our veteran patient population to dangerous pathogens unnecessarily.
