About this file

This justification and approval document concerns the acquisition of proprietary Acrovyn corner guards for use at the VA Pittsburgh Healthcare System facilities. The VA requires Acrovyn corner guards in various colors and sizes to standardize finishes throughout restrooms, laboratories, and clinical areas for ease of maintenance and to promote infection control. Only Acrovyn brand corner guards meet the agency's performance criteria related to durability, chemical and stain resistance, and bacterial and fungal growth resistance. The contracting officer determined this will be a sole source procurement under a larger construction project that will be competitively awarded as a 100% Service-Disabled Veteran Owned Small Business set-aside, thus ensuring a fair and reasonable price.

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C244-23-AP-3927

1. Contracting Activity:

a. Department of Veterans Affairs, VISN 04, VAPHS, University Drive Campus, Pittsburgh, PA 15215

1. Nature and/or Description of the Action Being Processed: Acquisition of proprietary Acrovyn Corner Guard in color Brushed Stainless (exeterior Corners) / Irish Cream 997 (All other corners). Acrovyn is the standard application throughout VAPHS due to the C/S Acrovyn 4000 Model Series has shown to be most durable and simple solution throughout facilities to protect from damage. Acrovyn 4000 Model Series is resistant to certain bacterial & fungal growth (per ASTM G 22-76 & G 21-96) and chemical resistant (per ASTM D 543). The other factors are that wall guards, and corner guards are a large item that must have maintained stock in order to be replaced on a regular basis as space is limited having a standard allows for a quick replacement. It is necessary to maintain a large stock on all wall guards as they must be replaced for the following reasons: damaged walls, water breaks, patch and repairs by our Maintenance and Repair Shops. Any form of deficiency in a flooring, walls and ceilings must be immediately addressed by our M&R Shops due to Safety and Infectious Control standards.

This Sole Source Product is for Acrovyn Corner Guard to be used in this project, which will be approximately

2. Description of Supplies/Services Required to Meet the Agency’s Needs: The VAPHS uses Acrovyn Corner

Guard throughout all facilities on both the University Drive and Heinz Campuses. Acrovyn has qualities, as noted below, that are key factors in the standardization. This allows for quick replacements to be completed by our M&R with no adverse side effects to our patients. The wall base is used across the campuses are designed with the following performance criteria:

a. Construction: Acrovyn Corner Guard is self-adhesive with a nose radius 3/32” (2mm)

i. Engineered PETG: Extruded material should be high impact Acrovyn 4000 with shadow grain texture, nominal .078" (1.98mm) thickness. Chemical and stain resistance should be per ASTM D543 standards as established by the manufacturer. Colors to be indicated in the finish schedule from one of manufacturer’s standard color range.

ii. Recycled PETG: PVC-free regrind retainer.

iii. Fasteners: All fasteners to be non-corrosive and compatible with aluminum retainers. All necessary fasteners to be supplied by the manufacturer.

b. Styles:

i. 90-degree angle only

ii. Odd-degree angles

iii. 1-1/2” Wing Size

iv. 3-1/2” Wing Size

c. Physical Characteristics:

I. Engineered PETG Corner Guards to be Acrovyn 4000 by Construction Specialties: Surface mounted guards consisting of a continuous retainer with snap-on Acrovyn 4000 cover. Color matched end caps to be provided for both partial and full height applications. Attachment hardware shall be appropriate for wall construction.

PRODUCT PERFORMANCE AND TECHNICAL DATA

i. Installer qualifications: Engage an installer who has no less than 3 years experience in installation of systems similar in complexity to those required for this project.

ii. Manufacturer’s qualifications: Not less than 5 years experience in the production of specified products and a record of successful in-service performance.

iii. Code compliance: Assemblies should conform to all applicable codes including IBC, UBC, SBCCI, BOCA, Life Safety and CA 01350.

iv. Fire performance characteristics: Provide engineered PETG wall protection system components with UL label indicating that they are identical to those tested in accordance with ASTM E84 for class 1 characteristics listed below:

1. Flame spread: 25 or less

2. Smoke developed: 450 or less

v. Impact Strength: Provide assembled wall protection units that have been tested in accordance with the applicable provisions of ASTM F476.

vi. Chemical and stain resistance: Provide wall protection system components with chemical and stain resistance in accordance with ASTM D543.

vii. Color match: Provide wall protection components that are color matched in accordance with the following:

1. Delta Ecmc of no greater than 1.0 using CIELab color space. (Specifier note:

viii. Construction Specialties' colors are matched under cool white fluorescent

ix. lighting and computer controlled within manufacturing tolerances. Color may

x. vary if alternate lighting sources are present).

xi. Single source responsibility: Provide all components of the wall protection system manufactured by the same company to ensure compatibility of color, texture and physical properties.

Delivery, Storage and Handling

i. Deliver materials to the project site in unopened original factory packaging clearly labeled to show manufacturer.

ii. Store materials in original, undamaged packaging in a cool, dry place out of direct sunlight and exposure to the elements. A minimum room temperature of 40°F (4°C) and a maximum of 100°F (38°C) should be maintained.

iii. Material must be stored flat.

Project Conditions

i. Materials must be acclimated in an environment of 65°-75°F (18°-24°C) for at least 24 hours prior to beginning the installation.

ii. Installation areas must be enclosed and weatherproofed before installation commences.

3. Statutory Authority Permitting Restricted Competition:

( X ) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements

( ) Unusual and Compelling Urgency ( ) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services ( ) International Agreement ( ) Authorized or Required by Statute ( ) National Security ( ) Public Interest

4. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the

Use of the Authority Cited Above (applicability of authority): The acquisition is authorized pursuant to 10 U.S.C. 2304 (c)(1), and is implemented by FAR 6.302-1 (c), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Any action to increase competition for the suppliers of Acrovyn Vinyl 4000 Model series would cause an undue hardship on the VA Pittsburgh Healthcare System. VAPHS has been making a conscious effort to standardize the finishes throughout the restroom, laboratory and clinical areas to make them more resistant to infectious pathogens and easier for the limited custodial staff to maintain.

The installation of material finishes other than Acrovyn would require duplication of maintenance materials and could expose our veteran patient population to dangerous pathogens unnecessarily.

6. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: This item is being sole sourced under a larger construction project that will be competed as a 100% Service-Disabled Veteran Owned Small Business (SDVOSB) set aside.

Therefore, competition will be provided on the base contract which will lead to a fair and reasonable price.

7. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: Further market research was not conducted based on the same content provided in paragraph 6 above.

8. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A

9. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A

10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to
