About this file

Summary

This is an Environmental Management General Permit issued by the City of Tallahassee for the COT UUPI Water & Sewer & COT Gas Utility General Permit (Permit Number TEM220057) for GEMINI ASSOCIATES LTD. The permit was issued on July 12, 2022, and is set to expire on July 12, 2025, with a possible extension date to be determined. The permit authorizes general development activities related to underground utility construction and maintenance by the City of Tallahassee's Water, Sewer, and Gas Group, including clearing, excavation, backfill, compaction, pavement removal and replacement, site restoration, minor line extensions, pump station repairs and replacements, service taps, and maintenance of public water, gas, wastewater, and reuse facilities. The permit encompasses stormwater management, erosion and sediment control, tree protection and removal, and landscape restoration requirements. Permittee and designated representatives must comply with pre-construction conferences (scheduled at least 48 hours in advance), notice of intent filings (at least 24 hours prior to work initiation), maintenance of on-site approved plans and permits, designation of a qualified Erosion and Sediment Control Officer, and posting of responsible personnel names. Inspector Tim Culbreth oversees the permit with office and cell contact numbers provided.

The permit conditions require comprehensive erosion and sediment control measures during excavation and backfill, including limiting clearing, sequential staging of trenching, daily closure and compaction, hay bales and filter fabric placement, and temporary or permanent vegetation establishment. Protected trees cannot be removed without separate permits and must be barricaded to prevent damage to critical protection zones. Final environmental inspection and compliance reporting, including as-built drawings, post-construction tree surveys, stormwater facility operating permits, and compliance statements, must be submitted approximately two weeks before requesting certificate of occupancy. The procedures manual specifies requirements for gas main placement (south and west sides of roads, 10 feet from pavement edge with minimum 3-foot cover), tree protection zones, particularly for canopy roads where boring may be required to avoid tree removal, and restoration standards using seeding, sodding, or sprigging with specified seed mixtures and fertilizer rates. Internal notification procedures are established for spill reporting to the Environmental Services Department and relevant state agencies, with specific timeframes and contact protocols for various incident classifications.

APPENDICES

ARTICLE I – GENERAL

I.1 INTRODUCTION: The Land Development Code (LDC) of the City of

Tallahassee requires that various City departments and other public utilities obtain permits for most of their activities. The purpose of the LDC is to regulate development activities, and in the process curb substandard practices by following accepted engineering methods. A General Permit provision was included in the LDC (5-

57) to allow local governments and public utilities to perform their daily operations without the need to constantly obtain permits for individual minor projects. The following Procedures Manual is based on the City of Tallahassee LDC (Chapter 5, Article III) and delineates the features as they pertain to the Potable Water, Wastewater, Reuse Water and Gas Engineering, Operations and Construction entities of the Underground Utilities & Pub l i c In f r as t ruc tu re Department and the Electric and Gas Utility [hereinafter referred to as the Water, Sewer, and Gas Group], City of Tallahassee Public Utilities.

I.2 SCOPE: The work completed by the Water, Sewer, and Gas Group, on a regular basis, includes clearing and grubbing, excavation, backfill, compaction, pavement removal and replacement, site restoration and cleanup, minor line extensions, pump station repairs and replacements, service taps and the maintenance and repair of various public water, gas, wastewater and reuse facilities. Clearing activities under this General Permit does not include the removal of protected trees, as defined in the Land Development Code.

This Procedures Manual pertains to utility construction or reconstruction of underground water lines and services, sanitary sewer lines and services, forcemains and gas mains and services [LDC, 5-57 (b) (4)], relocation of existing utilities required for development activity for which an approved environmental management permit has been obtained, but only when such relocation is performed concurrently with the permitted development activity and is consistent with the approved site plan [LDC, 5-57 (b) (5)], installation of gas mains and services within a new subdivision, while under construction by others, according to an approved EMP and prior to final approval and recordation of the subdivision by the City, maintenance and/or construction activity that would not cause a net increase of 3,000 square feet or more of impervious area [LDC, 5-57 (b) (8)] and routine daily maintenance of existing facilities or non-routine emergency maintenance requiring immediate response to protect public health, safety, and welfare [LDC, 5-57 (b) (10)]. The introduction of up to 3,000 square feet of new impervious area is contingent upon compliance with the maximum lot coverage provisions of the Code and the official capacity accounting record for receiving stormwater management facilities (if any).

Activities within preservation or conservation areas are prohibited unless separately permitted or exempt per Chapter 5-57 ( c ). This exemption allows routine maintenance activities for existing utilities within protected features provided such activities do not interfere with the beneficial functioning of the conservation or preservation feature. Prior to undertaking maintenance activities under this exemption, the Water, Sewer and Gas Group representative shall contact the Growth Management Department senior environmental inspector and environmental biologist for review and approval of the proposed activities. See Article IV of this manual for a list of preservation and conservation features.

Under no condition shall any particular work be executed under this General Permit that is not addressed in a detailed manner in this document.

I.3 RESPONSIBILITY: It shall be the responsibility of the Water, Sewer, and Gas

Group to see that all personnel in a supervisory capacity have a manual in their possession at all times or are able to access an electronic copy, and strictly adhere to the features stated herein. It is also understood that should any procedural repeat violations occur, the Director of the Growth Management Department may revoke the General Permit resulting in the requirement to file individual Environmental Management Permit or right-of-way placement permit applications. If any negative environmental impacts are foreseen during the initial survey for the utility main extensions or other work conducted by the Water, Sewer, and Gas Group, the Water, Sewer, and Gas Group representative shall ask for an inspector of the Growth Management Department to meet on site for further review and environmental mitigation techniques.

I.4 PLACEMENT OF GAS MAINS: All future gas mains shall be laid on the South and West sides of all roads and streets, ten (10) feet from the edge of pavement, or the back of the curb (if applicable) as per the Tallahassee Area Utility Coordinating Committee’s (TAUCC) Placement Guide. This requirement may be waived at the discretion of appropriate personnel from the Gas Utility, because of congestion at or about the above-mentioned corridor. The mains shall have a minimum of three

(3) feet cover from the existing natural ground level within rights-of-ways, as per the requirements of the Department of Transportation and Public Service Commission.

I.5 SEQUENCE OF CONSTRUCTION

1. Notify Growth Management of the construction start date.

2. Install erosion and sediment control.

3. Install tree barricades as needed.

4. Perform the construction of water, sewer, reuse, or gas facilities.

5. Stabilize all disturbed area.

6. Remove erosion and sediment control devices after completion of all construction work.

ARTICLE II – EROSION AND SEDIMENT CONTROL DURING

EXCAVATION AND BACKFILL

II.1 EROSION AND SEDIMENT CONTROL: Prior to the commencement of any activity that results in ground disturbance, personnel shall place in position adequate means of erosion and sediment control. No changes shall be made to the existing topography or vegetative cover type along the route of the water, gas, reuse or sewer main construction. Cross-sections, construction sequence, and maintenance procedures for silt fences and other erosion and sediment control measures can be found in the Florida Stormwater Erosion and Sedimentation Control Inspectors Manual, and a selection is provided in the Appendices. Erosion and Sediment control shall be accomplished by the following means:

a) Limiting the amount of clearing necessary.

b) Sequentially scheduling (staging) the excavation, thus limiting the removal of vegetation, and decreasing the area and duration of exposure of cut and open trench. Staging shall be done such that no more trench shall be excavated than pipe can be laid in a single working day. All the excavated material shall be stockpiled on the upgrade side of the trench.

c) Daily closure, compaction, grading, sod, and/or seed and mulch.

d) The trench line must be backfilled and compacted at the end of each work day with the exception of a small pit for the pipe end and active bore locations.

e) Soil from bore pit excavations that remain open overnight shall be covered with tarp and/or Visqueen.

f) Placing hay bales on the downstream side as needed to capture sediment from the proposed excavation, and securing them in place appropriately with stakes.

g) Placing filter fabric on the downstream side as needed to capture sediment from the proposed excavation. Under no circumstance shall trenching for the silt fencing be allowed within the critical protection zone of all desirable and protected trees.

h) Permanent or temporary vegetation, or a combination of these measures shall be employed as quickly as possible after the land is disturbed. Temporary vegetation and mulches can be most effective under conditions where it is not practical to establish permanent vegetation. Such temporary measures shall be employed immediately after rough grading is completed if a delay is anticipated in obtaining the finished grade.

See Appendices for diagrams from “Florida Stormwater Erosion and Sedimentation Control Inspector’s Manual” for silt fences, staked silt barriers, and storm drain inlet protection.

II.1 PLACING BACKFILL: The backfill shall be tamped in six-inch lifts to the surface. Tamping and compaction shall be accomplished with a mechanical tamper of an approved type. The following guidelines shall be strictly adhered to for compaction and density tests:

1) Density tests shall be required at five hundred (500) feet intervals, at a depth of eighteen (18) inches, plus one (1) density test at each bore pit.

2) Density tests shall be performed using a sand cone or drive tube method, only.

3) Any trench that falls within five (5) feet of the edge of pavement shall require compaction to 100% Standard Proctor.

4) If extending lengths of trench fall beyond five (5) feet of the edge of pavement, compaction to 95% Standard Proctor shall be required.

i) The compaction shall meet the following requirements:

Minimum required densities, expressed as a percentage of the maximum density as determined by ASTM D698 (Standard Proctor Moisture – Density Test), shall be as follows for the indicated areas:

(i) Florida Department of Transportation (FDOT) Road

Rights-Of-Way: Per FDOT specifications.

(ii) Leon County Roads Right-Of-Way: Per Leon County specifications.

(iii) All other street right-of-way, paved areas, sidewalks, and areas frequently subjected to vehicular traffic:

Depth Below Base Percent Compaction 0' - 3' 100 3' - 10' 95 10' + 90

The Florida Stormwater Erosion and Sedimentation Control Inspector’s Manual shall be referred to for proper erosion control management, and for the purpose of covering situations not covered herein. Also, supervisory personnel shall be experienced and/or trained in the proper application of these procedures.

The site/right-of-way shall be cleaned, show minimum indication of development activity, and left in an acceptable manner before departure to the satisfaction of all authorities having jurisdiction.

II.2 DITCHES: The Water, Sewer, and Gas Group shall not change the function, slopes, flow lines, or shape of any drainage ditch. Erosion of disturbed ditches shall be contained by using point-source control measures, whereby a combination of hay bales and silt fences are placed just at the inlet of ditches and culverts to prevent the transport of sediment deeper into their relative points of discharge. In addition to the above measure, controls as outlined in II.1 shall be used. Removal of such controls shall not occur prior to the establishment of a vegetative-cover similar to, or better than, the existing ditch prior to construction activity.

II.3 MAINTENANCE: The above mentioned measures undertaken after the excavation of trenches shall be subject to periodic inspection by the Growth Management Department through the routine examination of stake supports for hay bales and/or silt fencing and filter fabrics. Also, once in place the erosion controls shall remain until stabilization along the trench has been achieved. Completed projects shall be inspected periodically for a period of one (1) month, or until proper vegetative cover has been established, whichever period is greater. The frequency of inspections shall be twice a month and after every rain event to ensure the integrity of erosion control devices and continued vegetative growth. In cases where visible damage is apparent in the erosion control devices, adequate measures shall be taken to immediately repair and/or replace, as deemed appropriate. The type of seed used to establish a vegetative cover shall concur with the season.

The Florida Stormwater Erosion and Sedimentation Control Inspector’s Manual shall be referred to for proper erosion control management, and for the purpose of covering situations not covered herein. Also, supervisory personnel shall be experienced and/or trained in the proper application of these procedures.

ARTICLE III – VEGATATIVE MANAGEMENT

III.1 PROTECTED TREES: The following trees are protected and shall not be removed, impacted or damaged without receiving an approved environmental management permit [LDC, 5-83].

a. Any dogwood (Cornus florida) tree of four inches DBH or greater;

b. Any hardwood or long leaf pine tree of 12 inches DBH or greater;

c. Any tree of 18 inches DBH or greater;

d. Any tree four inches DBH or greater which is located in the lot perimeter zone of any development site except for sites being developed for detached single-family dwellings. The lot perimeter zone is the building set back or 20 feet, whichever is less;

e. Any patriarch tree

f. Any tree within a canopy road tree protection zone;

g. Any tree in a wetland;

h. Any tree planted to meet replanting, reforestation, or landscaping requirements;

i. Any exceptional specimen trees, identified by the city urban forester, city landscape architect, or city environmental biologist.

j. Any tree of 2-inch or greater DBH on pre-developed (or vacant) lots.

Landscaping trees that are planted under a mitigation plan as part of a previous environmental permit are addressed as protected trees.

Patriarch trees are those trees designated as a patriarch or state champion tree by the State Division of Forestry.

DBH, diameter at breast height, means the diameter of a tree measured at fifty-four (54) inches above the naturally occurring ground level. Trees with gross abnormalities or buttressing at breast height should be measured above and immediately adjacent to the irregularity. Trees that fork at breast height should be measured below breast height and recorded as a single trunk. Trees that fork below breast height will be recorded as separate DBH for each stem.

The lot perimeter protection zones are all areas of a development site which fall between a property line and the minimum building setback as required by the zoning code. Since all minor mains are installed within the rights-of-way of all roads and streets, trees within the lot perimeter protection zone may be encountered only during the installation of service lines.

If any of the protected trees listed above are to be impacted by construction or are required to be removed, a separate environmental permit will be obtained from the Growth Management Department before construction or any tree removal.

III.2 TREE REMOVAL: The Water, Sewer, and Gas Group shall make every effort to avoid tree removal. The following constitute tree removal:

a) The actual removal of a protected tree.

b) Any unmitigated development impact to the critical protection zone of a protected tree. The critical protection zone is defined in III.3.

c) Any encroachment within the critical protection zone of a protected tree

(grading activities, building pad placement, construction material storage, driving, or parking of heavy equipment).

d) Any damage to thirty (30) percent or more of the crown of a protected tree within the vertical projection of its critical protection zone.

III.3 TREE PROTECTION: Tree protection shall be accomplished by placing barriers around each protected tree to prevent the destruction or damage to roots, stems, or crown of such trees. Tree barriers satisfy the dual requirements of locating a protected tree, and, delineating the minimum length of the bore. A typical tree barrier is shown in the Appendices. These barriers shall remain in place and intact until such time as construction/installation operations are complete. Barriers may be removed temporarily to accommodate construction needs, provided that the manner and purpose for such temporary removal will not harm the tree and is approved by the Growth Management inspector and the project’s arborist. Where development activity is necessary within the CPZ, protective girdling of the tree trunk, shall be utilized.

The CPZ is defined as all areas within a circle of one (1) foot radius measured from the bark, for every one (1) inch of diameter of tree measured at DBH.

III.4 CANOPY ROAD TREE PROTECTION ZONE: All lands within one hundred

(100) feet of the center lines of the following roads, or which later comes within the corporate limits of the City are hereby declared to be canopy road tree protection zones:

(i) Meridian Road from its intersection with Seventh Avenue to the State

Line

(ii) Magnolia Drive-Centerville Road-Moccasin Gap Road from their intersection with Seventh Avenue to State Road 59

(iii) Miccosukee Road from its intersection with Capital Circle to

Moccasin Gap Road

Street to W.W. Kelley Road

(v) Old Bainbridge road from its intersection with Raa Avenue to Capital

Circle

All trees within the canopy road tree protection zone are protected trees, irrelevant of their diameter. Their removal is disallowed. The removal of underbrush within this zone is also prohibited, except as specified in a vegetation management plan which shall be submitted to and approved by the Director of Growth Management, or his/her designated representative. This plan shall outline specific planting and maintenance operations designed to restore or maintain the natural vegetation component of a specific canopy road section consistent with the objectives of the City of Tallahassee Land Development Code. This plan shall be worked out in conjunction with the Growth Management Department.

If the tree line is very close to the proposed utility main for an extended length, in effect precluding open trenching, boring may be considered for that length. Bores shall generally be a minimum of thirty-six (36) inches of cover, and a minimum of forty-eight (48) inches of cover in the CPZ of trees with a DBH of eighteen (18) inches or more. Bore pits shall not be allowed within the CPZ of a tree. If the Water, Sewer, and Gas Group determines boring to be infeasible, surveys shall be conducted for alternate routes.

All the features stated in III.3, Tree Protection, included in this article shall be strictly adhered to.

ARTICLE V – CLEANUP AND RESTORATION

Note: Requirements are applicable to the Water and Sewer Group

V.1 CLEANUP: Cleanup is an essential part of the work. As the work progresses and is completed, the site shall be cleaned of all signs of operation. This cleanup shall be done as promptly as practicable and shall not be left until the end of construction period.

Upon completion of backfill, the site will be cleaned of all signs of operations.

This cleanup shall be done promptly; at no time shall the site be left in a condition as to cause safety, erosion, or unsightly hazards.

V.2 RESTORATION: Any grass, shrubbery, or planting removal to accomplish the work shall be satisfactorily replaced. All areas disturbed during work shall be restored to a condition equal to or better than that existing prior to beginning work, or as directed by the Growth Management Inspector. Special situations may require restoration efforts beyond grassing and mulching.

Included in restoration is the protection of road shoulders, ditch banks, and other natural or artificial slopes subject to rapid erosion. Except where soil-cement rip-rap is shown, this protection shall be by grassing and mulching. A satisfactory stand of grass shall be obtained by sprigging, sodding, or seeding over entire work site.

1. Sprigging: Apply 4-8-4 (NPK) fertilizers at the rate of 600 pounds per acre by means of mechanical spreaders, to area to be sprigged. Live sprig, which match existing grass, with roots uninjured, shall be immediately planted in rows. Distance between rows and between the plant in rows shall not exceed one foot. After planting, entire area shall be compacted lightly be means of culti-packers, tractors or rollers. After sprigging, permittee shall water sprigs as required. Sod shall be water as specified for sprigging. Water shall be provided by permittee, at his expense whenever necessary to assure sustained growth and vitality.

2. Sodding: Immediately before sod is placed, 4-8-4 fertilizers shall be applied at a rate of 600 pounds per acre by mechanical spreaders or broadcasting and raking. Sod shall be watered as specified for sprigging.

In areas where sensitive water bodies are receiving site runoff, an acceptable fertilizer will be used at the minimum acceptable rate.

3. Seeding: All areas to be seeded shall be fertilized with 12-8-8 dry fertilizers at the rate of 800 to 1,000 pounds per acre and thoroughly worked into the soil. Grass seed shall be a mixture of 20 parts of Bermuda and 80 parts of

Pensacola Bahia seed, applied with mechanical distributors of the rate of 100 pounds per acre. During the months from October to January, the grass seed mixture shall be 50 parts winter rye and 50 parts Pensacola bahia seed.

All seed and fertilizer used shall meet the requirements of the State Department of Agriculture and all applicable State laws.

The construction crews shall maintain adequate moisture and provide such care as is necessary in seeded areas to ensure an adequate growth of grass.

All areas and spots that do not show a prompt growth shall be replanted at intervals of 10 days. Such water and replanting shall continue until a good growth of grass is established over the entire construction area. Sod shall be watered as specified for sprigging.

Prevention and repair of erosion in construction areas and such replanting as necessary to repair damage to seeded or grassed areas shall be the responsibility of the Water Utility.

Seeded areas shall be uniformly mulched in a continuous blanket immediately following seeding and compacting operations, using at least 1- 1/2 tons of hay or straw per acre. Hay with noxious seeds or plants will not be acceptable. Rotted, brittle, molded hay will not be accepted. It is intended that mulch shall allow some sunlight to penetrate and air to circulate, at the same time shading the ground, reducing erosion and conserving soil moisture.

Thickness of covering shall be adequate to hold soil, but sufficiently loose and open to favor development of grass. Immediately following spreading of mulch, material shall be anchored to soil by means of a seed drill, dish harrow set to cut only slightly, or other suitable equipment which will secure mulch firmly and prevent loss or bunching by wind or rain, or may be anchored with string lines placed at sufficient intervals. On slopes where machinery cannot be used, mulch may be retained in place by hand spading, string lines or non-metallic open weave fabric.

Unless rain is imminent, mulched areas shall be watered immediately after placing. Upon completion, surface or mulched areas shall be free from clods of earth, bumps, or water holding pockets and to required grades.

4. Hydro-Seeding: Under this method, the seed and fertilizer, and mulch when required, shall be distributed over the area to be seeded as a slurry composed of water, seed and fertilizer, and including mulch material. The types of seed and fertilizer and the requirements for seed, fertilizer and water as specified in Section 18.5 shall apply to this work.

This equipment for mixing and the slurry and for applying the slurry over the areas to be seeded shall be capable of applying a uniform slurry over the entire area.

The mulch material shall be included in the slurry mixture and shall be applied at the rate of 1,000 pounds of mulch material per acre. Mulch material shall consist of wood cellulose fiber material especially prepared for this purpose.

It shall be prepared in such a manner, that it will contain no growth-inhibiting or germination-inhibiting factors and shall be dyed an appropriate color for readily determining the rate of spread by visual observation. The slurry shall be uniform and homogeneous forming a blotter like ground cover, impregnated uniformly with grass seed, allowing the absorption of water and permitting rainfall and watering to percolate to the undersoil.

5. Maintenance: Once properly installed, erosion and sediment controls must be maintained until a permanent vegetative ground cover is established.

Any work site or portion thereof, where work is not being performed as a part of the current phase of work, shall be stabilized. All disturbed areas shall be permanently stabilized through the establishment of appropriate vegetative ground cover upon completion of all work activities, on the site. The Water, Sewer and Gas Group will be responsible to make daily inspections of the work site. Once a permanent vegetative site has been established, these inspections may cease.

ARTICLE VI – SANDMINE OPERATIONS

Note: The Gas Engineering, Operations, and Maintenance entities do not operate a sand mine.

VI.1 OPERATING CONDITIONS: Normal hours of operation are 7:00 AM to 5:30

PM Monday through Sunday. If the sand mine operation hours need to be extended due to priority scheduling of work or during emergencies, a Pit operator or designated operator shall remain onsite. This operator will ensure the proper and safe operation of the pit. All aspects of activities routinely undertaken by the Water, Sewer, and Gas Group in the excavation, stock piling o f material, backfilling and restoration of the sand mine shall be conducted in accordance with the procedures manual.

1. A minimum 6’ high chain link fence shall be maintained around the entire perimeter of the mining area and the said fence shall be posted with permanent and durable “No Trespassing” signs.

2. The area of high quality successional forest shall be protected from mining activities through the maintenance of the fence described above.

3. A 50’ wide buffer shall be maintained around the gravesites near the southwestern corner of the mining area and shall be protected from disturbance by the fence described above.

4. A 30’ wide type “B” buffer shall be maintained adjoining the westerly Right-of-

Way line of Rankin Avenue to serve as a visual screen. This area shall be protected from disturbance by mining activities through the maintenance of the above-mentioned fence.

5. There shall be no direct access allowed onto Rankin Avenue.

6. There shall be no mining activities allowed in Zone A or Zone B as shown in the Appendices.

7. Reclaimed areas of the sand mine shall be smoothly graded and planted with grass and/or small pine trees to return the land to a condition similar to the national forest, which is adjacent to the property.

a) The sand mine pit shall be reclaimed to meet the requirements of Rule

Chapter 16-C – 39, Florida Administrative Code, by backfilling with uncontaminated soil and clean debris, as defined by Chapter 403, Florida Statutes, and Chapter 17-701, F.A.C.

ARTICLE VII - MAINTENANCE OF UTILITY EASEMENTS

VII.1 DEDICATED OR PRESCRIBED EASEMENTS: Easements are granted for the purpose of conveying utilities across privately owned properties within City limits.

The right to enter upon these easements for the purpose of inspecting, repairing, maintaining or removing the utility lines and equipment is essential to their proper operation.

VII.2 OPERATING CONDITIONS: These utility easements will be periodically maintained through the process of mowing, removal of underbrush and the removal of voluntary growth trees within existing utility easements [LDC, 5-83(c)(8)]. If the existing utility should require repair, maintenance or removal; this work shall be conducted in accordance with this procedures manual.

VII.3 SATELLITE STORAGE AREAS: All areas that are used for the storage of material associated with excavation work shall comply with this procedures manual.

ARTICLE VIII

VIII.1 GAS LEAKS: The Gas Utility, as a Local Distribution Company (LDC), is governed by the State Department of Transportation (Title 49 Part 192) and the Public Service Commission (PSC). It is the Department's responsibility to report to the PSC all maintenance, repairs, and gas leaks.

Gas leaks are based on the grade of the leak. The grades are as follows:

#1 leaks are hazardous to the public and/or property and require prompt attention.

#2 leaks are not a threat to public or property at the time of detection, but justifies scheduled repair based on the potential of future hazard.

#3 leaks are considered to be non-hazardous and can be expected to remain.

For leaks classified as #1, whatever actions are deemed necessary on a continuing basis by the Department to contain the possible extent of hazard and protect life and property until the hazardous conditions no longer exist shall be conducted, including, but not limited to excavation within Special Zones, and/or tree removal. Time being of the essence in such situations, it may not be possible to obtain permits and/or coordinate the activities with representatives of the Growth Management Department. But once the hazard has been mitigated and/or successfully contained to the satisfaction of the Gas Department, Department of Transportation and the Public Safety Commission, measures shall be taken to replenish all damaged areas to the satisfaction of all Departments and citizens.

For leaks classified as #2 and #3 the Department has thirty (30) to ninety (90) days to conduct repairs and/or reevaluate. This gives the Gas Department sufficient time to work in conjunction with the Growth Management Department to acquire any permits, if required, to mitigate the hazards, if any.

A vegetation survey shall be conducted above and adjacent to gas mains and services that were subjected to leakage. Any areas noted with arrested growth, such as brown grass, leafless trees or wilted vegetation shall be further checked by the bar hole test and gas indicator. The damaged vegetation shall be replenished/replaced to the satisfaction of the persons and Departments involved.
