About this file
This is a memorandum requesting a DO-N5 Law Enforcement priority rating for task orders under the National Multiple Award Construction Contract III (NMACC III) for electrical infrastructure components. The request focuses on procuring electrical transformers, switching gear, shore tie components, and line isolation monitors critical to supporting U.S. Coast Guard cutter operations. The components are essential for shore power systems that enable cutters to connect to electrical infrastructure while in port, which reduces crew watch standing, prevents unnecessary wear on shipboard generators, and allows for critical maintenance.
The document outlines detailed contracting procedures for the NMACC III contract, which includes a base year and nine one-year option periods with a total aggregate contract capacity of $4,000,000,000. The contract covers construction services across the United States and its territories, with a minimum order amount of $10,000,000 and no maximum order limit (though contractors are not obligated to honor orders exceeding $250,000,000). The solicitation includes three contract pools (Pool 1, Pool 2, and Pool 3) with specific ordering periods, and provides comprehensive contact information for multiple construction firms eligible to compete for task orders under each pool.

1. In adherence with the above references, this memorandum requests your approval as the delegated Authorized Component Official (ACO) to place DPAS priority ratings of DO-N5 LAW ENFORCEMENT for electrical transformers, switching gear, electrical shore tie components, and line isolation monitors required for task orders issued under each NMACC III IDIQ (Encl. 1) for the FD&CC. Each parent IDIQ has a period of performance end date of 05/06/2025. The contracting officer will include the required delivery date on each priority rated task order.
2. Task orders issued under the NMACC III IDIQs requiring electrical transformers, switching gear, electrical shore tie components, line isolation monitors, and equipment in Ref. (e) will support ship to shore power for cutters and small boats in support of mission activities conducted under the Department of Homeland Security (DHS) Approved Program DO-N5.

These components are critical infrastructure that support the U.S. Coast Guard’s law enforcement and border security missions conducted by the U.S. Coast Guard cutters.
Electrical shore tie infrastructure allows the cutters to connect to shore power. Shore power is required for cutters and small boats to moor at a pier for an extended duration. Doing so dramatically reduces the duty section required to remain onboard. Less watch standing allows unit personnel to complete critical maintenance and prevents unnecessary wear and tear on shipboard electrical generation components.
Impacts: When a cutter needs to run on generators while in port, they cannot attain “cold iron” status. Cold iron status is when a cutter’s power generation equipment is secured and not running. In turn the ship’s fire risk increases when not in a cold iron status and the port duty sections significantly increase without shoreside power. As an example, when a 270’ medium endurance cutter must have its shipboard generators energized while in port, the duty section increases from eight personnel to twelve personnel. Many of the other classes of cutters have similar requirements for increased personnel when not in a cold iron status.
Coast Guard cutters are not staffed to maintain this increased watch standing for in port periods resulting in crew fatigue.
In port periods are essential to complete critical maintenance on the cutter and its equipment, including preventative and corrective maintenance of engines, water systems, berthing, ballast tanks, fuel tanks, generators, and other equipment. If the cutter obtains its electricity through the operation of its shipboard generator(s), it can prevent much of this critical maintenance, including the maintenance of said shipboard generators. In turn this inability to conduct preventative and corrective maintenance can greatly increase the likelihood of a cutter suffering a massive failure underway while executing law enforcement missions. If a generator fails, the cutter is no longer fully mission capable and will likely be required to return to homeport. Therefore, it is extremely important the cutters can complete their maintenance during their respective in port periods. To complete their in-port maintenance properly, they require shoreside power.
Should an electrical component fail, Coast Guard surface assets would not be mission-capable and would significantly reduce its operational capacity to carry out its missions.
Since 2020, the CG’s Civil Engineering community has experienced long lead times for components listed in Ref. (e), extending construction and repair projects far beyond expected durations and leaving operational CG units without functioning shore power for an extended duration, many times exceeding a year.
The NMACC III IDIQ's primary purpose is to repair and maintain existing facilities. The USCG has mitigated the issue of long lead time for the critical infrastructure pieces by issuing electrical components as government-furnished equipment (GFE); however, the NMACC III contractors cannot warranty GFE items and, therefore, repair callouts during the Warranty Construction phase IAW 52.246-21, does not extend to these critical items.
To ensure shoreside power is available to the cutter, transformers, switching gear, line isolation monitors, and the equipment listed in Ref. (e) must be readily available for civil engineering construction projects. Without these components, the civil engineering community cannot provide a functioning shore power system to CG cutters and small boats in port. Furthermore, these cutter and small boat surface assets function as military weapon systems for the Coast Guard and are therefore required to meet U.S. Military requirements.
The shoreside infrastructure electrical components directly support the maintenance of these systems.
3. The supplies to be procured in support of this qualifying activity are eligible to be procured using a FPAS-rated order in that they either (a) are not commonly available in commercial markets for general consumption; (b) require major modifications when purchased for approved program use; or (c) are not readily available in sufficient quantity so as to cause no delay in meeting approved program requirements. Additionally, the civil engineering community will not use these items for administrative purposes. The supplies requested for DPA acquisition are critical to mission capability, national public safety, and law enforcement activities.
4. The contracting officer has determined a need for a priority rating to ensure timely installation of transformers, shore tie receptacles, switching gear, and line isolation monitors to ensure cutters can connect to shore power and extend the cutter’s time away from homeport.
It is important that the Coast Guard meets these homeport timelines to meet the Coast Guard’s long term strategic goals. Each IDIQ contains the clause at FAR 52.211-15 Defense Priority and Allocation Requirements (Apr 2008). Each rated task order will designate the required equipment from Ref. (e), invoke the DO-N5 priority rating, and contain a required delivery date.
5. FD&CC Contracting Officers placing task orders under the NMACC III IDIQ’s understand that in accordance with this approval, FD&CC Contracting Officers must include the following in EACH order:
a. The priority rating and program identification symbol in the appropriate section of the award form’s face page (e.g., Block 1 of Standard Form 26, Award/Contract; Block 1 of Standard Form 33, Solicitation, Offer, and Award; or Blocks 13a. and 13b. of Standard Form 1449, Solicitation/Contract/Order for Commercial Items).
b. The required delivery date or dates. FD&CC Contracting Officers understand they cannot use words such as immediately or as soon as possible.
c. The clause at FAR 52.211-15, Defense Priority and Allocation Requirements:
DEFENSE PRIORITY AND ALLOCATION REQUIREMENT (APR 2008)
This is a rated order certified for national defense, emergency preparedness, and energy program use, and the Contractor shall follow all the requirements of the Defense Priorities and Allocations System regulation (15 C.F.R. § 700).
6. FD&CC contracting officers understand that each order must be reported to CG913Policy@uscg.mil in accordance with Ref. (b) by the end of the quarter in which the rating was placed.
