About this file

This document is an Amendment (Amendment 07) to a federal solicitation for the National Multiple Award Construction Contract III (NMACC III) Pool One project. The amendment extends the proposal submission deadlines, moving the non-price proposal due date from April 22, 2025, to April 29, 2025, and the price proposal due date from April 30, 2025, to May 7, 2025, both at 4:00 PM PST.

The amendment also introduces new Homeland Security Acquisition Regulation (HSAR) requirements related to contract terminations for contracts over $1,000,000, specifically for the United States Coast Guard (USCG). It includes provisions for contractors to maintain work products for at least one year after notification of potential contract termination and establishes a potential civil penalty of up to $25,000 per day for non-compliance. Additionally, the amendment updates the response to a vendor question about material price protection, clarifying that FAR Clause 52.229-3 allows recovery of tariffs imposed after contract award under certain conditions.

Task Order Announcement

INSERT HSAR 3049.9001 Policy (USCG) and HSAR 3049.9002 Contract Clause (USCG):

HSAR 3049.9001 Policy (USCG).

(2) the date the Commandant notifies the vendor that maintenance of such work product is no longer required.

(c) Work Product Defined. The term “work product”—

(1) Means tangible and intangible items and information produced or possessed as a result of a contract referred to in subsection (b); and

(2) Includes—

(i) Any completed end items;

(ii) Any uncompleted end items; and

(iii) Any property in the Contractor's possession in which the United States Government has an interest.

THE FOLLOWING QUESTIONS WERE RECEIVED IN RESPONSE TO THE

SOLICITATION:

PPI 42: With the current chaos surrounding tariffs, we are having a difficult time getting pricing from vendors. Most vendors are only willing to hold their pricing for 7 days. Given the length of time that it will take the Coast Guard to evaluate offers, we request that some sort of material price index language or similar protection be included in this contract. In the absence of some sort of material price protection, contractors will have no choice but to include a huge material price escalation factor in their bids. Please advise.

Delete PPI 42 answer: We recognize the existence of price instability, and we appreciate your request to insert specific language and terminology to define how material prices are adjusted based on market and economic prices/indices. Unfortunately, the ongoing instability surrounding tariffs does not impact this firm fixed price project, so we ask that Offerors’ initial proposals contain the Offeror’s best terms from a price (and technical standpoint).

Replace PPI 42 answer: FAR Clause 52.229-3, which is included in your Base Contract for National Multiple Award Construction Contract (NMACC III), allows recovery of tariffs imposed after contract award at 52.229-3(c) “The contract price shall be increased by the amount of any after-imposed Federal tax, provided the Contractor warrants in writing that no amount for such newly imposed Federal excise tax or duty or rate increase was included in the contract price, as a contingency reserve or otherwise.” A tariff qualifies as an “after-imposed” Federal tax, if tariff is instated after the award date of the contract. Tariffs imposed after proposal submission, but before contract award, will not be considered newly imposed under FAR 52.229-3.
