About this file
This document is an amendment to a solicitation for the construction of an organizational level maintenance hangar and base infrastructure at Al Jaber Air Base in Kuwait. The amendment revises drawings, pricing proposal instructions, and contract requirements. Offerors must submit proposals by October 8, 2021 with a preliminary project schedule and five-page narrative. The schedule must include milestones from award to notice to proceed within 20 days, preconstruction submittals, procurement of long lead items, testing and commissioning, and completion within the period of performance. The narrative should explain the schedule logic and durations. The amendment also adds a requirement for offerors to comply with the two percent federal excise tax in accordance with FAR provisions and clauses. The U.S. Army Corps of Engineers Middle East District is the issuing agency for this solicitation to construct facilities at Al Jaber Air Base in Kuwait.

d. Section 00 73 00 Special Contract Requirements: The following Compliance with 2% federal excise tax section has been added.
K. COMPLIANCE WITH TWO (2) PERCENT FEDERAL EXCISE TAX
Federal Acquisition Regulation (FAR) provision 52.229-11 and FAR clause 52.229-12 are included in Section 00 45 00 and 00 72 00 of the solicitation and resultant contract. This provision and clause concern the imposition of a two
(2) percent Federal excise tax withholding on any resultant contract award or payment request. Contractor should read the provision and clause fully to understand how this may apply to them.
Note: U.S. Army Corps of Engineers (USACE) Transatlantic Middle East District (TAM) does not have the means of withholding the excise tax at this time. As a result, contractors are expected to comply with the instructions and to properly complete and return the W-14 at proposal submission, and with each pay application. The amount due for each withholding will be confirmed by USACE, BUT WILL NOT BE WITHHELD. It is the contractor’s responsibility to calculate this tax liability and remit payment, or set aside for future payment to the Internal Revenue Service (IRS). Whether the contractor makes immediate payment, or sets aside monies for future payment to the IRS, is the contractor’s discretion, based on its analysis of the regulations regarding the excise tax. In the future event that USACE is able to withhold the excise tax during contract performance, it will notify the contractor and make such a withholding; no advance notice is required prior to the withholding. Under no circumstances is USACE liable for any excise tax liability not paid by the contractor. The contractor is liable for the tax, to the extent required by law, regardless of whether USACE makes a withholding.
