E. BASIS OF AWARD
1. The proposals will be evaluated in accordance with FAR 15.101-1 based on the Best Value Trade-Off (BVTO) source selection process. Award will be made to the offeror who represents the best overall value to the Government and has been determined to be responsible in accordance with FAR Subpart 9.1. Implicit in this process is the Government’s willingness to accept other than the lowest priced offer, if the added benefits of a higher priced offer outweigh the additional cost or price involved. The Government intends to award one FFP contract at the conclusion of non-pricing and pricing evaluations.
2. Subject to the provisions contained herein, the Government will evaluate proposals to determine the offeror that is responsible in accordance with FAR Subpart 9.1, whose proposal is responsive to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation represents the best value to the Government, considering both price and non-price factors.
3. The technical evaluation team, using reasoned judgment, shall evaluate proposals by identifying significant strengths, strengths, significant weaknesses, weaknesses, uncertainties, and deficiencies in each offeror’s proposal and assigning a combined technical/risk rating to each offeror’s proposal for each technical factor.
Definitions
Significant Strength is an aspect of an offeror's proposal that has appreciable merit or appreciably exceeds specified performance or capability requirements in a way that will be appreciably advantageous to the Government during contract performance.
Strength is an aspect of an offeror's proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
Significant Weakness is a flaw in the proposal that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001
Weakness is a flaw in the proposal that increases the risk of unsuccessful contract performance. See FAR 15.001
Uncertainty is any aspect of a non-cost/price factor for which the intent of the offer is unclear (e.g. more than one way to interpret the offer or inconsistencies in the proposal indicating that there may have been an error, omission, or mistake).
Deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
See FAR 15.001
A risk as it pertains to source selection, is the potential for unsuccessful contract performance. The consideration of risk assesses the degree to which an offeror’s proposed approach to achieving the technical factor or subfactor may involve risk of disruption of schedule, degradation of performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance.
3. There may be contained within the evaluation factors certain mandatory or minimum requirements to be met for evaluation. There are also contained within the described factors requirements for the submission of certain documents. Failure to satisfy any mandatory or minimum requirement may result in a determination that a proposal is unacceptable.
4. The Government intends to select one offeror for an award without discussions, but reserves the right to hold discussions if the Government determines that to do so would be in its best interest. Therefore, an offeror’s proposal should contain the offeror’s best terms from a technical and pricing standpoint. The Government reserves the right to conduct discussions if it is determined by the Contracting Officer/Source Selection Authority (SSA) to be necessary.
5. In evaluating propsoals and making an award decision, the Government will credit only information pertaining to the offeror itself and to its subcontractors and coventurers in an an offeror that is a joint venture, only as provided below in the selection factors. The Government will not credit the offeror with experience, past performance, or other characteristics or capabilities of firms that are merely related to the offeror (parent companies, subsidiaries, and other subsidiaries of the same corporate parent) without proof that the same, or most of the same, personnel and financial resources are available to the offeror and the firm whose information is submitted in response to the selection factors.
F. EVALUATION FACTORS
FACTOR 1: CORPORATE CAPABILITY
FACTOR 2: CONSTRUCTION EXPERIENCE
FACTOR 3: PRELIMINARY SCHEDULE
FACTOR 4: PAST PERFORMANCE
FACTOR 5: PRICE
Relative importance of the evaluation factors: For evaluation purposes, the Corporate Capability (Factor 1), Construction Experience (Factor 2), and Past Performance (Factor 4) are equal to one another, and when combined, are significantly more important than Preliminary Schedule (Factor 3). Corporate Capability (Factor 1), Construction Experience (Factor 2), Preliminary Schedule (Factor 3) and Past Performance (Factor 4) make up the non-pricing aspects of an offeror’s proposal, and when combined, are approximately equal in importance to the Price (Factor 5) aspect of an offeror’s proposal in the selection process.
FACTOR 1: CORPORATE CAPABILITY
Proposal Submission Requirements:
The Corporate Capability portion of an offeror’s proposal will be limited to six (6) pages in length, not including registrations, licenses, letters of intent, or the Performance Distribution Statement. Information provided that exceeds the page limit will not be evaluated.
An offeror should provide a detailed narrative that demonstrates the offeror’s understanding of the overall scope of work for the project and describes the offeror’s corporate capability to completing the work.
The Offeror shall submit the following:
a. Kuwait Commercial Registration Certificate (business license): A copy of a current Kuwait Commercial Registration Certificate (business license) in the offeror’s name in English or translated into English. In the alternative, in the event that the offeror’s licensure or authorization to perform construction in Kuwait, permitting it to perform the work required by this solicitation, is in some form other than a Commerical Registration Certificate, the offeror must provide documentary proof of each and every element of such licensure or authorization and a full explanation as to how its licensure or authorization, currently in effect, complies with the laws of Kuwait. The requirement of the previous sentence applies to any form of licensure or authorization other than a Commercial Registration Certificate in the name of the prime offeror itself (the same legal entity), including the commercial registration of one or more coventurers in an offeror that is a joint venture if that is sufficient for performance of the resulting contract under the laws of Kuwait.
b. Letters of Intent: The offeror shall submit a Letter of Intent signed by each major subcontractor it intends to employ. A major subcontractor is defined as a subcontractor that will perform twenty percent (20%) or more of the total dollar value of the project. Notice regarding subcontractors: The Government recognizes that an Offeror/Prime Contractor often utilizes major subcontractors to perform portions of the work. The offeror shall submit a Letter of Intent signed by each major subcontractor it intends to employ.
A major subcontractor is defined as a subcontractor that will perform twenty percent (20%) or more of the total dollar value of the project.
Each Letter of Intent must:
(1) be written on the subcontractor’s company letterhead;
(2) be addressed to the offeror;
(3) describe and agree to a specific scope of work without caveats or disclaimers; and
(4) be executed by the subcontractor’s authorized representative.
After award, the Offeror shall not change major subcontractors for which it submitted a Letter of Intent without the Contracting Officer’s written approval. Approval will not be given unless the contracting officer considers the proposed substitute to be equal or better in all respects to the originally proposed major subcontractor and that the substitution is in the best interests of the Government.
c. Self-Performance: The proposal shall contain a Performance Distribution Statement that identifies the type and percent of work to be performed by the offeror and any major subcontractor(s), supporting that the offeror will perform at least 20% of the work. See Attachment B for instructions for completing the required Performance Distribution Statement.
d. Base Access: An offeror should explain how it will comply with relevant base access procedures, such as:
i. Kuwait Ministry of Defence (KMOD) requirements for access to Kuwait military installations.
ii. Kuwait Air Force security requirements for access to Al Jaber Air Base (AJAB), Kuwait.
iii. Plan to control access to the work site.
iv. Plan for obtaining base access for personnel, subcontractors, and construction materials and equipment.
e. COVID-19 Pandemic’s Impact on Contract Performance:
A possible challenge with this project is dealing with the effects of COVID-19 outbreak during performance.
Government contractors have experienced curfews, quarantines, base shut-downs and similar restrictions due to the pandemic. Secondary impacts to contract execution include, but are not limited to, supply chain disruptions, subcontractor delays, closed government offices, and the degradation of trade services for construction.
The offeror should:
i. Describe its experience(s), during the pandemic, with restrictions on base access and secondary impacts (as described above) and the efforts made to mitigate the impact on contract performance;
ii. Explain its knowledge of Kuwaiti law, regulations and visa restrictions regarding COVID-19 and the impact of these measures on contract performance;
iii. Explain its knowledge of the contractual obligations for staffing critical positions. The offeror should propose a solution if, or when, a critical employee such as a project manager, quality control manager, or safety manager requires extended personal leave due to COVID-19; and
iv. Explain its plans and procedures for the following: 1) screening employees returning from leave or who are known to have had contact with infected individuals, 2) dealing with employees who show COVID-19 symptoms and 3) mitigating the effects of an outbreak of COVID-19 in a close-quarters labor camp.
Evaluation Procedures, Adjectival Ratings and Descriptions:
An offeror’s corporate capability will be evaluated in its entirety to determine the offeror’s understanding of the requirements and its capability to execute the requirements of the solicitation. The Government will also evaluate the extent of the offeror’s consideration of the inherent challenges that are specific to this project scope, schedule, and location.
In evaluating an offeror’s corporate capability, the Government will evaluate each segment as follows:
Corporate Capability: The Government will evaluate proposals to determine the completeness and feasibility of an offeror’s corporate capability and its understanding of the overall scope of work and anticipated challenges.
The Government will evaluate an offeror’s corporate capability based on the following aspects:
a. Kuwait Commercial Registration Certificate (Business License): The Government will ensure the offeror’s commercial registration certificate, or other documentation and explanation as permitted to satisfy this element above, are current, valid, and accurate. “Current” means that the certificate will be in effect through 31 December 2021. If the certificate will expire prior to 31 December 2021, the proposal shall include the offeror’s plan to extend the certificate. “Valid” means in effect. “Accurate” means if the name of the offeror differs in any way from the name on the business license, the offeror shall have explained the discrepancy and provided legal documentation showing that it will be authorized to operate in Kuwait and to perform the requirements of the solicitation using documents provided to prove its licensure and authorization.
b. Letters of Intent/Subcontractors: The Government will ensure Letters of Intent are provided for any major subcontractor(s). The Letters of Intent must be written on company letterhead, be addressed to the offeror, contain no caveats or disclaimers, be written in English, or transcribed in English, and be signed by an officer or authorized representative of the subcontractor. Letters of Intent, licenses, and partnership agreements, joint venture agreements, if not written in English, must be accompanied by an English translated copy with a signed statement, in English, by an authorized representative who can bind each entity that the English translation is true and correct.
c. Self-Performance: The Government will evaluate the percentage of work to beperformed by the offeror, as documented on the Performance Distribution Statement to ensure that it is 20% or more.
d. Base Access: The Government will evaluate the extent of an offeror’s understanding of the relevant security requirements of the Kuwait Ministry of Defence for access to Kuwait military installations and of the Kuwait Air Force for access to Al Jaber Air Base. The Government will evaluate the offeror’s site access and base pass acquisition plans for completeness, reasonableness, and feasibility.
e. COVID-19 Pandemic Impact: The Government will evaluate the offeror’s capability to manage the effects and impacts of the pandemic. The Government will evaluate the feasibility and robustness of an offeror’s plans to mitigate the effects and impacts of a COVID-19 outbreak during contract performance.
Greater Weight Considerations:
Greater weight may be given to proposals that demonstrate the following:
a. Self-performance of forty percent (40%) or more of the work, documented on the Performance Distribution Statement.
b. Experience with obtaining base access and badges, as well as understanding and complying with security and escort requirements to Al Jaber Air Base, either as a prime or subcontractor, within the last 3 years.
c. Experience with obtaining access to Kuwait military installations through the Kuwait Ministry of Defence within the last 3 years.
d. Offeror has demonstrated successful performance of a (past or current) US Government construction contract in a Gulf Cooperation Council (GCC) state(s) during the COVID-19 pandemic and has explained how it employed sensible mitigation measures to minimize the impact on the work of the pandemic and the Host Nation government’s response to it.
A single technical rating will be assigned to the corporate capability of an offeror’s proposal. The ratings will include consideration of risks in conjunction with a proposal’s significant strengths, strengths, weaknesses, significant weaknesses, uncertainties, and deficiencies. The Factor 1 evaluation will utilize the combined technical/risk ratings and the risk descriptions as follows:
Table 1. Combined Technical/Risk Rating Method
Color Rating Adjectival Rating Description
Blue
Outstanding
Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Purple
Good
Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Green
Acceptable
Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Yellow
Marginal
Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Red
Unacceptable
Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
FACTOR 2: CONSTRUCTION EXPERIENCE
Proposal Submission Requirements:
Offerors shall provide a separate narrative (not a part of Construction Experience Forms, Attachment C), not to exceed twenty (20) pages, that outlines how lessons learned and established practices and solutions from their construction experience and/or the construction experience of their management personnel will enable them to successfully perform the requirements of this solicitation.
Although an offeror may highlight any experience it has gained, an offeror’s narrative should pertain to experience within the last seven (7) years that involved overcoming challenges similar to those that can reasonably be expected in performing the Super Hornet Procurement B construction.
The offeror must explain how its experience enhances its ability to perform the Super Hornet Procurement B project.
For purposes of this portion of the evaluation, the focus is on the offeror’s experience in dealing with construction challenges, not on those project metrics required to conduct a past performance relevancy evaluation.
A project relevancy analysis will be completed under the Past Performance factor. The Construction Experience Narrative should address the offeror’s lessons learned and established practices and solutions for the following:
a. Hiring qualified laborers and maintaining a qualified workforce.
b. Procurement of long lead items.
c. Obtaining access to work locations (focus on leasons learned and troubleshooting strategies rather than duplicating material provided in response to Factor 1).
d. Obtaining permits and approvals, such as fire protection, utilities, etc.
e. Completing projects within an operational military facility.
f. Completing projects on or around an operational airfield.
Under this factor, the Government will consider the experience of major subcontractors when the offeror has provided letters of intent signed by the subcontractor in its proposal. If this requisite letter of intent is not submitted, the experience of a major subcontractor will not be considered. The offeror may include experience of one coventurer in an offeror that is a joint venture. The experience of subcontractors and coventurers includes lessons learned and established practices and solutions from the construction experience of their management personnel.
Offerors should explain the significance and impacts of the lessons learned and established practices and solutions included in their responses.
Evaluation Procedures, Adjectival Ratings and Descriptions:
Construction Experience: The Government will evaluate the offeror’s experience dealing with challenges on construction projects to determine how well these experiences have prepared the offeror to successfully perform the requirements of the solicitation. The weight assigned to the experience, consisting of lessons learned and established practices and solutions from the experience of any entity, whether the offeror, a major subcontractor, a coventurer, or the management personnel of any of those, will be dependent upon the extent to which the contractor has convincingly explained how that experience will be applied to avert and address construction challenges on the Super Hornet Procurement B project.
Greater Weight Considerations:
Greater weight may be given to proposals that demonstrate experience and lessons learned related to:
a. Constructing projects with similar scope to this project. The scope of Super Hornet Procurement B includes, but is not limited to: construction of aircraft maintenance and corrosion control hangars, utility infrastructure (such as the following systems: Fire Protection, Potable Water, Sanitary Sewer, Storm water Management, Site Grading, and Electrical Cable Routing), as well as construction of electrical switching stations and substations, and airfield pavements. The greatest weight will be given to projects including construction of aircraft maintenance or corrosion control hangars.
b. Obtaining permits and approvals from the appropriate Kuwait governing authorities in areas such as fire protection systems, building installation, and utilities.
c. Working on or around operational military or airfield facilities (preferably military airfield facilities) while minimizing impacts to end user operations.
d. Obtaining access to work locations on installations under the control of the Kuwait Military Forces.
Strengths and significant strengths may be assigned to offerors for superior responses with regard to the requirements of this factor that demonstrate ability to avert and address construction challenges on the Super Hornet Procurement B project that are not included in the enumerated greater weight considerations.
Offerors may use Construction Experience Forms (Attachment C) to submit information on specific project experience that is pertinent to greater weight considerations, but the Construction Experience Forms will only be considered to the extent they are referenced in the parts of the narrative to which they relate.
A single technical rating will be assigned to the construction experience of an offeror’s proposal. The ratings will include consideration of risks in conjunction with a proposal’s significant strengths, strengths, weaknesses, significant weaknesses, uncertainties, and deficiencies. The Factor 2 evaluation will utilize the combined technical/risk ratings and the risk descriptions as follows:
FACTOR 3: PRELIMINARY SCHEDULE
Offerors shall provide a single preliminary overall master schedule with approximately 100-150 activities or milestones. This schedule should provide sufficient detail to convey to the Government a complete understanding of the work associated with the contract documents and the Period of Performance (PoP) as described in the Scope of Work. The offeror shall include with its proposed preliminary schedule an accompanying schedule narrative that demonstrates the offeror’s understanding of the solicitation requirements.
