AMENDMENT 0007
Amnedment 0007 Solicitation No. W912DS-24-B-0003
The purpose of this amendment is to extend the Bid Opening and answer the following questions posed by a potential bidder.
Bid opening is hereby extended to 09 May 2024 at 2:00 P.M. EST.
Question 1. If options are awarded, can we build and start beachfill at the eastern limit of the awarded options working towards the Base footprint. This provides the best results for the Government and best execution method building beach from east to west.
Answer 1. Yes. Answer 9c, concerning optional work in Amendment 0004, states that the Gilgo Beach Placement can be performed from east to west.
Question 2. Will the contractor be allowed to work inside of the inlet in Deposition A, B and C during offshore weather delays, while ensuring the Federal Channel completion based on volumes needed?
Answer 2. The contractor will be allowed to work inside the inlet in Deposition Basins A, B and C during the presence of offshore weather, which may affect dredging the outside portion of the dredging area, provided the contractor provides the Government with a dredged channel as stated in Section 35 20 23, paragraph 3.2.1 Order of Work.
Question 3. 106 days for the Base work is not enough considering 60 days mob and 60 days demob and a couple months of dredging. Please allow 160‐180 days for Base mob, dredging and demob. The 60 days mobilization is the critical path and needs to be fully included in the allowable days for the Base work.
Answer 3. The Water Quality Certificate Permit # 1‐4799‐00134/00001 has an environmental window that limits the number of days dredging and beach work can be performed. In Amendment 0004, SECTION 01 11 00 SUMMARY OF WORK, PART 1 GENERAL, Paragraph 1.1 COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK was revised as follows:
SECTION 01 11 00 SUMMARY OF WORK, PART 1 GENERAL, paragraph 1.1 COMMENCEMENT, PROSECUTION
AND COMPLETION OF WORK
a. The Contractor shall be required to (i) commence work under this contract within five (5) calendar days after the date the Contractor receives the Notice to Proceed, (ii) prosecute the work diligently, and (iii) complete the entire work ready for use, not later than 111 calendar days after the date the Contractor receives the notice to proceed. The Government may exercise Option 1 (Gilgo Beach Placement) within five (5) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work. If Option 1 is exercised, an additional twenty three (23) calendar days will be added to the performance period. The Government may exercise Option 2 (Gilgo Beach Placement) within five (5) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work. If Option 2 is exercised, an additional fifteen
(15) calendar days will be added to the performance period. The Government may exercise Option 3 (Gilgo Beach Placement) within five (5) calendar days of receipt by the contractor of the Notice to Proceed for the
Basic Work. If Option 3 is exercised, an additional fifteen (15) calendar days will be added to the performance period. The Government may exercise Option 4 (Overlook Beach Placement) within sixty five (65) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work. If Option 4 is exercised, an additional eight (8) calendar days will be added to the performance period. The Government may exercise Option 5 (Overlook Beach Placement) within sixty five (65) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work. If Option 5 is exercised, an additional three (3) calendar days will be added to the performance period. Option 5 can only be exercised if Option 4 is exercised. The time stated for completion shall include final cleanup of the premises. (FAR 52.212‐3)
b. All work shall be in accordance with the drawings and specifications or instructions attached hereto and made a part thereof, or to be furnished hereafter by the Contracting Officer or Contracting Officer Representative (COR) and subject, in every detail, to his supervision, direction, and instructions.
Question 4. The Government is not providing enough days to complete by the April 1 window if all options are awarded, due to the Government not including number of mobilization days (60 days). Please add at least 60 days to the Base.
Answer 4.
SECTION 01 11 00 SUMMARY OF WORK, PART 1 GENERAL, paragraph 1.1 COMMENCEMENT, PROSECUTION AND

The Government may exercise Option 3 (Gilgo Beach Placement) within five (5) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work.
The contract performance period begins when the NTP is acknowledged by the contractor. The contractor can commence the mobilization phase (beach and water) when the NTP is acknowledged. Dredging of the inlet east of the Sore Thumb demarcation line, as stated in the Water Quality Certificate, is allowed.
Dredging of the inlet west of the Sore Thumb demarcation line, as stated in the Water Quality Certificate, is prohibited from September 15 until November 15.
Question 5. What is the required completion date and off the beach by date?.
Answer 5. The required completion date of the Basic Work will be determined when the Notice to Proceed is acknowledged. Based on the Water Quality Certificate (NYSDEC Permit #: 1‐4799‐ 00134/00001), the contractor is required to be off the beach by the end of March 2025.
Question 6. I found this note in the specifications. I am unable to find the certification. Can you direct me to the location?
Answer 6. Delete in its entirety Section 00 00 01, Cover Sheet, 5. NOTE THE CERTIFICATION OF NONSEGREGATED FACILITIES IN THIS SOLICITATION. Bidders, Offerors, and applicants are cautioned to note the "Certification of Nonsegregated Facilities" in the solicitation. Failure of bidder or offeror to agree to the certification will render his bid or offer non-responsive to the terms of solicitation involving awards of contracts exceeding $10,000, which are not exempt from the provisions of Equal Opportunity Clause.
