AMENDMENT 0005
AMENDMENT 0005
Fire Island Inlet and Shores Westerly to Jones Inlet, New York
Beach Erosion Control and Navigation Project
- Option 4: Beach Placement at Overlook Beach
Solicitation No. W912DS‐24‐B‐0003
The purpose of this amendment is to answer the following questions posed by potential bidders:
Question 1. Please advise when the Government anticipates issuing Award and Notice to Proceed.
Answer 1. The Government anticipates awarding the contract in May and issuing the Notice to Proceed by the end of September 2024.
Question 2. With two dredge environmental windows (inside/outside Sore Thumb) and large scale mobilization, when will clock start ticking for contract days if NTP is issued within an environmental window?
Answer 2. The contract performance period begins when the NTP is acknowledged by the contractor. The contractor can commence the mobilization phase (beach and water) when the NTP is acknowledged.
Dredging of the inlet east of the Sore Thumb demarcation line, as stated in the Water Quality Certificate, is allowed. Dredging of the inlet west of the Sore Thumb demarcation line, as stated in the Water Quality Certificate, is prohibited from September 15 until November 15.
Question 3. Do contract days count during and environmental window?
Answer 3. Yes, if the contractor is allowed to work. If the NTP is issued and acknowledged by the end of September, the contractor is allowed to perform the mobilization phase of the contract and possible commence dredging in the contract dredging area that is east of the Sore Thumb demarcation line. The contractor should sequence his work so that the inside portion (east of the demarcation line) of the inlet is completed no earlier than November 15 to avoid a delay in beginning dredging of the outside portion (east of the demarcation line) of the dredging area.
Question 4. The Contract allows for 50 days to mobilization and demobilize. 50 days to mobilize and demobilize 20,000 – 35,000lf of subline and multiple boosters is not nearly enough, especially during the required poor weather seasons. We request the Government include a more realistic 60 days for each activity (120 total (60 days for mobilization and 60 days for demobilization)). The days currently allowed are not sufficient to complete mob, dredging and demob.
Answer 4. The Water Quality Certificate Permit # 1‐4799‐00134/00001 has an environmental window that limits the number of days dredging and beach work can be performed. The contract performance period is hereby increased by 5 calendar days, from 106 Calendar days to 111 calendar days.
SECTION 01 11 00 SUMMARY OF WORK, PART 1 GENERAL, paragraph 1.1 COMMENCEMENT, PROSECUTION AND COMPLETION OF WORK is hereby revised as follows:
a. The Contractor shall be required to (i) commence work under this contract within five (5) calendar days after the date the Contractor receives the Notice to Proceed, (ii) prosecute the work diligently, and (iii) complete the entire work ready for use, not later than 111 calendar days after the date the Contractor receives the notice to proceed. The Government may exercise Option 1 (Gilgo Beach Placement) within five (5) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work. If Option 1 is exercised, an additional twenty three
(23) calendar days will be added to the performance period. The Government may exercise Option 2 (Gilgo Beach Placement) within five (5) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work. If Option 2 is exercised, an additional fifteen
(15) calendar days will be added to the performance period. The Government may exercise Option 3 (Gilgo Beach Placement) within five (5) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work. If Option 3 is exercised, an additional fifteen (15) calendar days will be added to the performance period. The Government may exercise Option 4 (Overlook Beach Placement) within sixty five (65) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work. If Option 4 is exercised, an additional eight (8) calendar days will be added to the performance period. The Government may exercise Option 5 (Overlook Beach Placement) within sixty five (65) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work. If Option 5 is exercised, an additional three (3) calendar days will be added to the performance period. Option 5 can only be exercised if Option 4 is exercised. The time stated for completion shall include final cleanup of the premises. (FAR 52.212‐3)
b. All work shall be in accordance with the drawings and specifications or instructions attached hereto and made a part thereof, or to be furnished hereafter by the Contracting Officer or Contracting Officer Representative (COR) and subject, in every detail, to his supervision, direction, and instructions.
Question 5. Bidders must understand the awarded scope of work sooner than currently stated within the contract.
The stair‐step award timeframe approached for the options does not work. We request all awardable options be awarded at the same time, and sooner than currently stated. Contractor should know if options including Overlook are awarded at time of Base Award or within 30 days of Base Award to properly price pipe and execute mobilization and subline installation. Areas of the Borrow area contain course sand. Having multiple Options Line Items within this contract complicates pricing as the contractor do not know what options or in what order they will be awarded, resulting in unknown number of riser moves, unknown pipeline length/routes and booster placements, while not knowing where on the beach the course material is to be placed and at what pipeline lengths (it is more difficult/costly to pump course material further).
Question 5a. Will the Government please make the award timeline for all options the same, and from Base award?
Question 5b. Will the Government please make the award of options at time of Base award or within 30 days of base award, allowing contractor to understand the full scope prior to mobilization?
Answer 5. Amendment 0003, Section 01 11 10 Summary of Work, Part 1 General, 1.1 a., and Section 00 10 00 Solicitation Contract Form, Note to Bidders state that Options 1, 2 and 3 may be exercised within five (5) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work. Overlook Beach Option, which remains unchanged, states that Overlook Beach Option will be exercised within sixty five (65) calendar days of receipt by the contractor of the Notice to Proceed for the Basic work. Therefore, all beach placement at Gilgo Beach is expected to proceed from east to west.
Question 6. Please clarify that the Overlook template design berm height is 8.5’ + 0.5’ tolerance, and not 8’ +1’ tolerance as with the Gilgo design.
Answer 6. Amendment 0003, Section 31 24 00.00 18 paragraph 3.2.6 Design Template, Option 4 (Overlook Beach Option) states a berm height of 8.5’ plus 0.5’ tolerance. Section 31 24 00.00 18 paragraph 3.2.6 Design Template states an elevation of 8’ feet berm height as depicted on the beach placement drawing. Section 32 24 00.00 18, paragraph 1.3.1 Beach Fill Placement states a tolerance of 0.5 feet as depicted on the beach placement drawing.
Question 7. Please allow contractor to determine the order of work at their discretion, while assuring completion of the channel portion. Without this discretion, as written there would need to be multiple delays around safe sea conditions to move the dredge, risers and equipment around. With accurate quantity management, the contractor can manage the order of work with Government approval.
Answer 7. Section 35 2023, paragraph 3.2.1 Order of Work is hereby revised as follows: The contractor is allowed to determine the order of work at their discretion, provided the contractor provides the Government with a dredged channel of‐14 feet in depth plus 2 feet allowable overdepth at the conclusion of dredging. The contractor will be allowed to manage the order of work with the Government approval provided the contractor can assure the Government of accurate quality management.
Question 8. What criteria determines if options will be awarded?
Question 8a. if it is funding related, and base is only awarded, then the beachfill will be cut short when the 750k CY run out, as the current template currently needs 1.04m cy. Please confirm.
Question 8b. if it is quantity related, then is it the Governments intent to build to the currently designed template, by awarding options?
Question 8c. What will be the minimum density cy/lf of the beach?
Answer 8. The availability of Government funds will determine which options (Gilgo Beach Placement) will be exercised, if any. The availability of State funds (Town of Babylon) will determine if Overlook Beach Options will be exercised, if any. Refer to Amendment 0003 for details concerning the base work and optional work, including the design templates.
Question 9. The contract beach template currently holds 1.04 m cy based on the Government provided surveys, not including any recent erosion. The Base Bid Item must be at least this qty or the template within the contract must change prior to bid. The contract template cannot change after award of options without an RFP. Also, Section 31 24
00.00 18 Page4, Paragraph 1.3.1 Beach Fill Placement states “The Basic Work must be completed before Optional Work can be performed”. Going back to the start of the beach fill after the base work is impractical and uneconomical, and brings risk and additional cost to the Government and the contractors.
Question 9a. Will the Government please delete the phase, “The Basic Work must be completed before Optional Work can be performed”, of further clarify.
Question 9b. Please confirm that the Government’s intent is for option quantity to be added simultaneously with the Base quantity within the base footprint, not extending the beach length wise or to recover/refill already completed sections.
Question 9c. Please confirm that the Government’s intent is not to restart the fill process at the eastern limit for each awarded option. The contract currently reads that the base must be completed before any option.
Question 9d. If awarded, can the Overlook option work take place prior to the Basic Work for ease of mobilization?
Question 9e. What is the Government intent for placement location of the Base qty and each Option?
Question 9f.: If base only is awarded, 750k cy does not complete the beach at the current template design and the beach will be cut short. Please advise.
Answer 9a. The contractor is required to complete all work awarded for Gilgo Beach Placement (basic and optional work if exercised) before the Overlook Beach Option can be performed.
Answer 9b. Amendment 0003 provided the design layout of the Basic Work and optional work for Gilgo Beach Placement based on the most recent topographic and hydrographic survey data.
Answer 9c. Optional work (Options 1, 2 and 3) scheduled for placement at Gilgo Beach may be exercised within five
(5) calendar days of receipt by the contractor of the Notice to Proceed for the Basic Work.
Therefore, the Gilgo Beach Placement can be performed from east to west.
Answer 9d. The contractor is required to complete the basic work and Gilgo Beach options, if exercised, before Overlook Beach Option can be performed, if exercised.
Answer 9e. Amendment 0003 provides the perimeters of the basic work and optional work.
Answer 9f. Amendment 0003 revised the design template of the base bid, including the dimensions of the placement area.
Question 10. The required Order of Work calls for the channel to be dredged first. Will the government allow all of the material east of the Sore thumb be done concurrently with the channel, even though some of the required material is in adjacent Deposition Basins. This would simplify and reduce the mobilization cost, while reducing the number of pipeline riser setups. This would also result in the contract being completed sooner.
Answer 10.
Question 11. The contract requires contractors to complete a survey of the entire placement area on 100’ stations prior to dredging to determine if the beach design template requires any modifications.
Question 11a. How long will the Government need to review this survey and to release any changes?
Question 11b. Will the Government please change this survey to be completed on 500’ stations, not 100,? Most “Pre‐Construction” surveys are completed on 500’ stations, which provides ample coverage to determine quantities needed.
Question 11c. This is a multi‐day survey likely performed by a subcontractor. Will the Government please add a CLIN Bid Item for this survey?
Answer 11. The contractor is required to perform a survey of the entire placement area prior to the commencement of dredging, analyze the survey data, and share the survey data with the Government to determine if the beach design template requires any modifications. The contractor can perform the survey at 500‐foot intervals. The Government will not be adding a CLIN Bid Item for this survey.
Question 12. Contract Drawings show the Gilgo beah slope. Spec Section 01 11 00 Paragraph 1.2.2 and Section 31 24 00.00 18 paragraph 3.2.8 (4) state a step down at‐1.0’ to 1:15. Please clarify.
Answer 12. Amendment 0003, revised Section 01 11 00, paragraph 1.2.2 Beach Placement Specifications state the following: Placement along 9,300 feet of Gilgo Beach shoreline: The berm will extend 260 feet seaward from the baseline (southern edge of Ocean Parkway) at an elevation of +8.0 feet NAVD from baseline station 93+00, continuing westward to approximately baseline station 0+00. The landward extent of the berm will tie into the exiting dune. A seaward slope of 1‐foot vertical on 20‐foot horizontal will extend from the seaward end of the berm to minus 1‐foot elevation NAVD, then a slope of 1‐foot vertical on 15‐foot horizontal will extend to the ocean bottom (grade). The beach fill shall commence with a 300‐ foot taper east of station 93+00, if Option 1 is not exercised, and be completed with a 300‐foot taper west of station 0+00.
Amendment 0003, revised Section 31 24 00.00 18, paragraph 3.2.8 Placement of Dredged Material states the following: (4) It is expected that in placing the sand fill hydraulically, most of the silt and other fines being pumped will be washed into the ocean and dissipated by wave action. Ponding of the dredge effluent will not be allowed.
However, baffles or dikes to control the flow of the dredge effluent will be required. The final seaward slope of the sand fill to be placed below El. +3.0 ft NAVD shall be the uncontrolled hydraulic slope of the material placed by the dredging process, estimated to be a 1 vertical to 20 horizontal until‐1.0 feet elevation, then slope down 1 vertical to 15 horizontal to the ocean bottom.
The dredge effluent shall in all cases return directly to the ocean and not to the inshore side of the fill.
Question 13. Please conform that there is no Bird Restriction at the tip of Democrat Point during the allowable dredging window. Large landside machinery is needed on Democrat Point to regularly move dredge anchors.
Answer 13. The environmental window period for birds, as stated in the New York State Department of Environmental Conservation Water Quality Certificate, commences from April 1 to August 31. Dredging of the inlet will be performed outside of the environmental window for birds; therefore, there will be no bird restriction zone area on Democrat Point. The contractor will be able to utilize large machinery on Democrat Point to move dredge anchors.
Question 14. There are numerous obstructions within the Borrow Area. Please include within the Contract Drawings all known obstructions from previous projects within the Borrow Area for all contractors to be aware of the need to work around.
Answer 14. Amendment 0003 provides information from the contractor who performed work for the Corps during the last two dredging cycles of Fire Island Inlet in 2018/2019 and 2021/2022/2023 concerning lost buoy moorings in the Fire Island Inlet channel and deposition basins. Map 1 (Project: 015771 Fire Island Inlet) survey dated March 3, 2019 shows the magnetometer survey results of 2018, the given U.S. Coast Guard potential obstructions, and the 14‐foot contour MLLW. Map 2 (Project: 015995 Fire Island Inlet Contract 1), dated March 21, 2023, shows the magnetometer survey results of 2018, the given U.S. Coast Guard potential obstructions, the 14‐foot grade contour, and the areas where the contractor hit something hard highlighted in blue. Map 3 (Project: 015771 Fire Island Inlet) shows the magnetometer survey results of 2018, the given U.S. Coast Guard potential obstructions, and the areas where the contractor hit something hard highlighted in blue.
Question 15. Spec Section 31 24 00.00 paragraph 3.2.1 states beachfill vertical tolerance of +0.5’. The contract drawings show +1.0’ vertical paid tolerance. Please confirm that +1.0’ is correct (Ele +9.0’).
Answer 15. Amendment 0003, Section 31 24 00.00, paragraph 3.2.1 Placement, is revised as follows: The material dredged from the designated dredging area shall be placed on the beach fill area to the specified limits and cross sections shown on the drawings provided. The material shall be deposited as evenly as practicable by the hydraulic method to form a comparatively smooth and uniform beach surface. A tolerance of 0.5 feet above and below Elevation +8.0 feet NAVD, measured vertically, will be allowed and paid for the basic work.
Question 16. Please clarify the magnitude range between $25M and $100M. Section 01 11 00 Page 4 Paragraph 1.4 FARS 36.204 indicates an estimate cost of approximately $15M to $50M.
Answer 16. Based on the plans and specifications available, the estimated cost is approximately $15 million to $50 million.
Question 17. With the addition of Options to this contract compared to past Fire Island Inlet projects, the dredging plan/approach is more complicated. Will the Government please allow a 2 week postponement to the bid date to allow further understanding and review of Governments responses to these inquiries?
Answer 17. Amendment 0003 have included some updated specification section and updated Beach Placement plans based on the most recent topographic and hydrographic survey data, which should simplify the solicitation and make it more comparable to past Fire Island Inlet projects.
Questions from another potential bidder:
Question 1. Please provide the XYZ data for the most recent channel survey.
Answer 1. Amendment 0003 includes the XYZ date for the most recent surveys of the channel and Gilgo beach placement area.
Question 2. The specs are unclear on the pay tolerance.
1. Section 31 24 00.00 1,3,1 states the following: No payment shall be made for material placed:
(1) Which was obtained from outside the designated dredging area below the maximum dredging limit of the dredging area, except as directed by the Contracting Officer or his representative.
(2) In excess of the quantity to the design grade plus the 0.5 foot tolerance.
2. Section 01 22 00.00 1.3 States the following:
The total amount of material acceptably placed on the beach (from designated areas of Fire Island Inlet) to be paid for at the contract unit price as shown on the price schedule (Section 00 10 00), must be measured by the cubic yards in place on the beach by computing the volume between the beach shown by a survey made before filling and beach surface shown on a survey after filling. The reference datum must be NAVD.
No payment must be made for material placed:
(1) In excess of the quantity to the design grade plus the 1 foot tolerance. Refer to the
Compensated Slope paragraph in section 31 24 00.00 18 BEACH FILL PLACEMENT foe exception regarding compensated slope.
3. The plans show a 1’tolerance.
Answer 2. Amendment 0003 includes the revised Section 31 24 00.00 18 and revised Section 01 22 00.00 10 paragraph 1.3. The tolerance is 0.5 feet.
Question 1. Is there a disturbance depth limitation in the borrow area?
Answer 1. The contractor is allowed to dredge to a depth of‐14‐feet plus 2 feet allowable overdepth. Question 2. Will the Owner provide the latest XYZ survey data?
Answer 2. Amendment 0003 provides the latest XYZ survey data for the channel and deposition basins and the Gilgo Beach Placement area.
Question 3. Is there a required discharge pipeline corridor from the Borrow area to the Beachfill site? Answer 3.
There is no required discharge pipeline corridor from the borrow area to the beachfill site.
Question 4. Does the Owner have coordinates for the staging area?
Answer 4. The Government does not have coordinates for the staging area. The contractors for the past two maintenance cycles received permission from the Town of Babylon to stage their equipment and material at Overlook Beach.
Question 1. We respectfully ask for a two week extension in the bid submission time.
Answer 1. The Government expects to provide at least 10 days between the release of Amendment 0003 and the Bid Opening date.
Question 2. If the contractor completes the beachfill before all borrow areas are dredged to‐14‐feet, what would be the plan of action?
Question 3. Could the owner elaborate on the acceptance of the borrow areas.
Answer 2 and 3. The contractor should expect to complete the beach fill before all borrow areas are dredged to ‐ 14 feet plus 2 feet of allowable overdepth based on the quantity of material available by the specification survey.
Question 4. Would the owner explain order of work for the borrow area.?
Answer4.
