PART 1 GENERAL
This section is part of the implementation of RCRA of 1976 as amended (42 USC 6901) which requires that EPA designated items be used to the maximum extent practicable.
Additional information is available at http://www.epa.gov/epawaste/conserve/tools/cpg/products/index.htm
1.1 REFERENCES
The publications listed below form a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only.
U.S. NATIONAL ARCHIVES AND RECORDS ADMINISTRATION (NARA)
40 CFR 247 Comprehensive Procurement Guideline for Products
Containing Recovered Materials
1.2 OBJECTIVES
Government procurement policy is to acquire, in a cost effective manner, items containing the highest percentage of recycled and recovered materials practicable consistent with maintaining a satisfactory level of competition without adversely affecting performance requirements or exposing suppliers' employees to undue hazards from the recovered materials. The Environmental Protection Agency (EPA) has designated certain items which must contain a specified percent range of recovered or recycled materials. EPA designated products specified in this contract comply with the stated policy and with the EPA guidelines. The Contractor shall make all reasonable efforts to use recycled and recovered materials in providing the EPA designated products and in otherwise utilizing recycled and recovered materials in the execution of the work.
1.3 EPA DESIGNATED ITEMS INCORPORATED IN THE WORK
http://www.epa.gov/epawaste/conserve/tools/cpg/products/index.htm
Various sections of the specifications contain requirements for materials that have been designated by EPA as being products which are or can be made with recovered or recycled materials. These items, when incorporated into the work under this contract, shall contain at least the percentage of recycled/recovered materials and postconsumer content specified in the corresponding EPA Recovered Materials Advisory Notice (RMAN) unless adequate justification (non-availability) for non-use is provided. Questions may be directed to the JBLM Sustainable procurement Program Coordinator via the Contracting Officer's Representative. Questions may be directed to the JBLM Sustainable procurement Program Coordinator (Building 1210) via your Contracting Officer or their representative.
When a designated item is specified as an option to a non-designated item, the designated item requirements apply only if the designated item is used in the work.
When claiming a justification for non-use as noted above, the contractor shall complete and submit the JOINT BASE LEWIS-MCCHORD SUSTAINABLE ACQUISITION EXCEPTION FORM (including copies of all supporting evidence) to the Contracting Officer or their representative. This form is available from the contracting official or the JBLM Sustainable procurement Program Coordinator (Building 1210, (253) 966-6466, usarmy.jblm.imcom.dpw-green-procurement@mail.mil).
The contractor shall submit the completed form via email (with copies of supporting documents attached) and include the following address in the carbon copy (“cc”) line of the email:
usarmy.jblm.imcom.dpw-green-procurement@mail.mil. The contractor shall keep attached file sizes to a minimum to avoid transmission errors associated with JBLM security. If use of email is not possible, the contractor shall coordinate the submission of these documents with the Contracting Officer’s Representative and ask that they forward copies to the JBLM Sustainable procurement Coordinator (Bldg 1210, 966-6466).
When specifying non-compliant products, the designer or requirements generator shall submit a justification of non-use as described below using the JOINT BASE LEWIS-MCCHORD SUSTAINABLE PROCUREMENT EXCEPTION FORM. This justification shall specify the reason for non-use (price, performance, or availability) and include all supporting evidence. The completed form shall be sent via email (with copies of supporting documents included) to the Contracting Officer’s Representative. Be sure to include the following address in the carbon copy (“cc”) line of the email: usarmy.jblm.imcom.dpw-green-procurement@mail.mil. Keep attached file sizes to a minimum to avoid transmission errors associated with JBLM security. If use of email is not possible, coordinate the submission of these documents with the Contracting Officer’s Representative and ask that they forward copies to the JBLM Sustainable procurement Coordinator (Bldg 1210, 966-6466).
1.4 EPA PROPOSED ITEMS INCORPORATED IN THE WORK
Products other than those designated by EPA are still being researched and are being considered for future Comprehensive Procurement Guideline (CPG) designation. It is recommended that these items, when incorporated in the work under this contract, contain the highest practicable percentage of recycled or recovered materials, provided specified requirements are also met.
1.5 EPA LISTED ITEMS USED IN CONDUCT OF THE WORK BUT NOT INCORPORATED IN
THE WORK
There are many products listed in 40 CFR 247 which have been designated or proposed by EPA to include recycled or recovered materials that may be used by the Contractor in performing the work but will not be incorporated into the work. These products include office products, temporary traffic mailto:usarmy.jblm.imcom.dpw-green-procurement@mail.mil mailto:usarmy.jblm.imcom.dpw-green-procurement@mail.mil mailto:usarmy.jblm.imcom.dpw-green-procurement@mail.mil mailto:usarmy.jblm.imcom.dpw-green-procurement@mail.mil control products, and pallets. It is recommended that these non-construction products, when used in the conduct of the work, contain the highest practicable percentage of recycled or recovered materials and that these products be recycled when no longer needed.
