JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. CONTRACTING AGENCY: U.S. Army Engineer District, Alaska, Contracting Division, P.O. Box 6898, JBER, Alaska 99506-0898.
2. DESCRIPTION OF ACTION: This is a Limited Sources Justification for Other than Full and Open Competition to include a sole source (brand name) specification for the Edwards EST3-Sixty fire alarm panels in solicitation W911KB-18-R-0006. The solicitation will be a competitive Request for Proposal resulting in a new firm-fixed price construction contract to be awarded with FY17 MILCON funds.
3. DESCRIPTION OF SUPPLIES/SERVICES: This Limited Sources Justification is for the inclusion of a brand name specification for Edward’s fire alarm panels in the solicitation and resultant LRDR CP#2 contract for Clear Air Force Station, Alaska (Clear). Clear’s existing fire alarm system is an Edwards system and all new building fire alarm systems require compatibility with the existing system.
Approval authority for this Limited Source Justification is the Procuring Contracting Officer.
4. AUTHORITY CITED: Other than Full and Open Competition is authorized pursuant to 10 U.S.C. 2304(c)(1), FAR 6.302-1(a)(2), when only one responsible source and no other supplies or services will satisfy agency requirements.
5. REASON FOR AUTHORITY CITED:
Background: Clear’s existing base wide fire alarm system is Edwards and new facilities are required to be compatable with the existing fire alarm system.
b. Justification: Facilities required to have a fire alarm notification system linked to the to the Clear fire department require system compatability. All new Missile Defense facilities are required to be linked to the installation fire department to protect life and mission critical equipment. Clear’s existing fire alarm system is manufactured by Edwards United Technologies. The LRDR facilites will require Edward fire alarm componets to ensure compatability with Clear’s existing fire alarm system. No other Contractor is proficient nor knowledgeable in the specific Edward system to be able to satisfy compatability with the existing system and satisfy the Government's requirement.
c. Impact: Failure to incorporate the requirement for compatibility with the Clear” existing fire alarm system will result in a failure to protect mission critical assets resulting mission failure.
d. Alternatives: None. Specification of a Edward fire alarm system for the LRDR CP#2 is essential to the Government’s requirements, precluding consideration of a product manufactured by another company.
6. EFFORTS TO OBTAIN COMPETITION: In an attempt to solicit offers from as many potential sources as practical, market research was conducted as described in paragraph 8 below. Effective competition is not anticipated for this system. There are no other known sources that have the capability to integrate with an existing Edward fire alarm system, therefore competition is not proposed for the acquistion of this system.
7. ACTIONS TO INCREASE COMPETITION: Based on information in paragraph 5, above, competition for the sole source brand name item to be included in solicitation W911KB-18-R-0006 is not feasible.
8. MARKET SURVEY: An internet search was performed to search for alternatives to this product as well as vendors. There was not a suitable alternative located. There are a substantial number of vendor who will be able to provide competitive quotes for the prime contractor selected for construction of this project.
9. INTERESTED SOURCE: In accordance with FAR 5.102(a)(6), this J&A will be posted with the solicitation when the solicitation is made available through the Government Point of Entry (www.fedbizopps.gov). Any sources that indicate interest as a result of the publication will be evaluated. To date, no other sources have written to express interest.
10. OTHER FACTORS:
a. Procurement History: Procurement History: The Edward Fire Alarm system has been provided under prior contracts at Clear Air Force Station.
b. Acquisition Data Availability: Not applicable.
c. Unusual and Compelling Urgency: Not applicable.
d. Subcontracting Competition: Subcontracting opportunities exist for suppliers, distributors, and/or installers. This is a restrictive specification that only precludes consideration of a product manufactured by another company. Subcontracting competition will be the responsibility of the Prime contractor awarded the contract.
