SYNOPSIS
PROJECT SYNOPSIS
Create New Electrical Requirements Contract
Project No. AD001636P
DESCRIPTION OF WORK:
The work shall be located at various locations on Fort Hood, TX. The exact location will be shown by the Contracting Officer. Building(s) will and will not be occupied during performance of work under this Contract. The Contractor shall provide all plant, supervision, labor, materials, equipment, supplies and transportation necessary to complete this scope of work. Except as provided elsewhere in this contract, all work shall comply with applicable State, local and Federal laws and regulations, industry and construction codes and standards, manufacturer’s specifications and recommendations, and all contract special provisions, terms and conditions.
The purpose of this contract will be used to provide miscellaneous electrical services to all areas of the Fort Hood Military Reservation at Fort Hood, Texas, encompassing the tasks identified in the bid schedule (Tech Exhibit - A), and includes the installation of new or replacement of existing vacuum circuit breakers, single and three phase primary overhead and underground electrical distribution lines, wood and steel poles, down guys, overhead guys, anchors, cross arms, insulators, new and rebuilt pole and pad mounted transformers, fused cutouts, lightning arrestors, steel reinforced concrete transformer pads, gang operated air switches, primary and secondary electrical metering, single and three phase overhead and underground secondary, roadway lighting, high mast lighting, flood lighting, ball field lighting, solar lighting fixtures, pole-mounted obstruction light fixtures, steel reinforced concrete base foundations for steel poles, lighting controllers, continuity testing of ammo bunkers, ammunition holding areas and railheads, static ground testing for fuel tankers, static ground installations for fuel tankers, lightning aerial rods, painting of static grounding points, service risers, service laterals, wiring gutters, panel boards, circuit breakers, fused safety switches, switch racks, dry type transformers, conduits, trenching, primary and secondary conductors and cables, extra heavy duty power cords, receptacles, outlets, hand holes, core drilling, tele-power poles, interior and exterior light fixtures, emergency back-up fixtures and lamp supply units, exit signs and light switches.
As-built drawings in CAD format are required at the conclusion of each project (task order), as identified in the contract's special provisions and specifications. Additionally, Tech Exhibit - T shall be completed at the conclusion of each project (task order) for all electrical points of interest identified on Tech Exhibit - T that is applicable to each project (task order).

Solicitation documents, including Tech Exhibit and Attachments, specifications, and miscellaneous data, will be furnished to the contractor in Adobe PDF format on the Federal Business Opportunities website ( https://www.fbo.gov/ ). After award, one set of Adobe PDF contract drawings and PDF specifications will be furnished to the Contractor on CD. Reference publications will not be furnished. Contractor shall immediately check furnished drawings and notify the Government of any discrepancies.
A project construction sign will not be required for this project unless specified otherwise. Contractor shall keep all permits and other documents required to be on the job site in a 3-ring binder or posed on a bulletin board within the construction area.

Bid Opening will be conducted in QA Conference Room, Building 4610 Engineer Drive, Fort Hood, Texas.
1. Pre-requisites for Specialty Trade licensure and certification:
The contractor shall provide documentation to support that it possesses the qualifications to, or can acquire assets to, demonstrate journeyman (or master license) qualifications in the following trades: The Contractor shall provide written verification of being in the normal business of air conditioning construction as a prime contractor for a minimum of 5 years performing HVAC work, utilizing the NAICS 238220, Plumbing, Heating and Air-Conditioning Contractors. In responding to this solicitation for bids, the bidder shall provide copies of certifications/training identified above and below as a part of the bid. Current Texas Refrigeration Certification is required. Failure to provide this documentation will render the bid non-responsive and no further consideration will be given to that bidder for award of this contract. No substitution of the individual possessing the required pre-qualifications will be authorized without the written approval of the Contracting Officer, and no time will be allowed for the contractor to acquire the required training/certification after the contract is awarded.
2. Work Experience:
The prime contractor shall demonstrate that it possesses general construction contract management by providing at least three examples of relevant work experience in an awarded contract similar to the requirements stated in this solicitation. Documentation shall be submitted with the bid and include the contract number, the date of contract award, the customer's name and contact information, the awarded dollar value, a description of all work elements included in the contract, the number and type of specialty trades needed to complete the contract, and the period of time allocated for completion of the work.
Federal work experience is preferred; however, the Government will accept work experience from both State and institutional and commercial contracts as well. No residential work experience will be considered appropriate for this purpose. Failure to provide this documentation will render the bid non-responsive and no further consideration will be given to that bidder for award of this contract.
SUBCONTRACTOR LIST
Offerors shall submit a list of proposed subcontractors as an attachment to their bid. If offeror does not intend on utilizing subcontractors (self-perform), offeror shall state so in their bid. Failure to provide this listing or statement will render the quote nonresponsive and eliminate the offer from further consideration for award.

52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT--CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American --Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers. (1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested--
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.
52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.
The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-
(c) The amount of the bid guarantee shall be 20 percent of the bid price or $3,000,000.00, whichever is less.-
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.
52.233-2 SERVICE OF PROTEST (SEP 2006)
(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from

52.236-27 SITE VISIT (CONSTRUCTION) (FEB 1995) – ALTERNATE I (FEB 1995)
(a) The clauses at 52.236-2, Differing Site Conditions, and 52.236-3, Site Investigations and Conditions Affecting the Work, will be included in any contract awarded as a result of this solicitation. Accordingly, offerors or quoters are urged and expected to inspect the site where the work will be performed.

From the Main Gate Entrance, proceed to the Santa Fe Avenue Overpass. At the second light, turn left onto Santa Fe Avenue. Continue along Santa Fe Avenue to Engineer Drive. Turn left at Engineer Drive and park in the DPW West Parking lot.
Enter Building 4610 at the West double doors, turn left to the waiting area. Attendees will be escorted in to the QA Conference room.
(d) Participants are asked to notify the Government of their intent to attend this site visit and pre-bid conference by sending an email to the Contract Specialist at the following email address. 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 15 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than the date of completion identified in each task order (Since this is a requirements contracts, no specific completion date can be given herin for completion of work. Such completion dates will be identified in each individual task order). The time stated for completion shall include final cleanup of the premises.
See Note: Government period of performance is calculated based upon the table of performance periods not inclusive of supply or logistical considerations. Contractor shall provide documentary evidence for variation from Government proposed timelines. Where Contractor supply chain or equipment availability differs from actual construction period, Contractor shall provide documentary evidence to support variance from Government proposed performance period including firm commitment date for installation. Failure to conform to firm commitment date for installation shall be considered Contractor delay.
52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)
(a) If the Contractor fails to complete the work within the time specified in the task order, the Contractor shall pay liquidated damages to the Government in the amount of $575.00 for each calendar day of delay until the work is completed or accepted.
(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
52.219-18 NOTIFICATION OF COMPETITION LIMITED TO ELIGIBLE 8(A) CONCERNS (JUN 2003)--
ALTERNATE I (APR 2005)
(a) Offers are solicited only from small business concerns expressly certified by the Small Business Administration (SBA) for participation in the SBA's 8(a) Program and which meet the following criteria at the time of submission of offer--
(1) The Offeror is in conformance with the 8(a) support limitation set forth in its approved business plan; and
(2) The Offeror is in conformance with the Business Activity Targets set forth in its approved business plan or any remedial action directed by the SBA.
(3) The offeror's approved business plan is on the file and serviced by .
(b) By submission of its offer, the Offeror certifies that it meets all of the criteria set forth in paragraph (a) of this clause.
(c) Any award resulting from this solicitation will be made to the Small Business Administration, which will subcontract performance to the successful 8(a) offeror selected through the evaluation criteria set forth in this solicitation.
(d)(1) Agreement. A small business concern submitting an offer in its own name shall furnish, in performing the contract, only end items manufactured or produced by small business concerns in the United States or its outlying areas. If this procurement is processed under simplified acquisition procedures and the total amount of this contract does not exceed $25,000, a small business concern may furnish the product of any domestic firm. This paragraph does not apply to construction or service contracts.
(2) The insert name of SBA's contractor will notify the Mission Installation Contracting Command - Fort Hood Contracting Officer in writing immediately upon entering an agreement (either oral or written) to transfer all or part of its stock or other ownership interest to any other party.
