Organizational Conflict of Interest (OCI)
A potential OCI as defined in FAR Subpart 9.5 has been identified and is anticipated to occur if the performance of work under contract, W56HZV-14-C-0154, is not completed prior to the release of the
Request for Proposal (RFP) for the Route Clearance Interrogation System (RCIS) Type 1 Vehicle.
In order to eliminate an actual OCI, JCB is prohibited from participating as a prime or sub- contractor, or as a consultant to any third party in the RCIS Type I RFP W56HZV-15-R-0156 or the resultant contract.
Any information needed for this RFP should be sought from the Government, not JCB.
The term "JCB" herein means (i) the organization, (ii) all business organizations with which it may merge, join or affiliate, now or in the future, and in any manner whatsoever, or which hold or may obtain, by purchase or otherwise, direct or indirect control of it, (iii) its parent organization (if any) or its present or future subsidiaries, associates, affiliates, or holding companies, and (iv) any organization or enterprise over which it has direct or indirect control (now or in the future) or (v) consultant to any third party.
This prohibition applies explicitly to JCB and may impact subcontractors that have performed work under contract W56HZV-14-C-0154. A subcontractor that has performed work under this contract may still participate in the RCIS Type I RFP provided it submits with its proposal a mitigation plan that describes its strategy to prevent, avoid, or neutralize any potential OCI from occurring in response to the final Request for Proposal (RFP) W56HZV-15-R-0156 (or any derivative RFP) and the resultant contract.
The Contracting Officer reserves the right to review and audit OCI mitigation plan(s) as needed, and to reject mitigation plan(s) if the OCI, in the opinion of the Contracting Officer cannot be avoided, or mitigated.
