Question: Is the Summary Section included in the page limit for the volume/file? Is the Summary section evaluated? If so how is it evaluated? 2 Afghanistan

RFP

Section B CLIN 0003AA Setting the Theater RFP Section L Content, Regional Capabilities

RFP Section B CLIN 0003 does not show separate "Setting the Theater" CLINs for both CENTCOM and Afghanistan.

RFP paragraph L.2.(ii)(1)b. Regional Planning and Performance Capabilities

If there is no separate "Setting the Theater" CLIN for Afghanistan please advise if the CENTCOM performance contractor is responsible for Afghanistan planning, or if offerors should include an organic Afghanistan planning capability. Public

A separate CLIN will not be established. AFG is an active theater and as such the performance KTR will be responsible for all planning associated with LOGCAP requirements. Any tasks related to planning capability will be accomplished through Project Planning/Estimates, WBS 02.01.04 or the specific WBS for any activated services. Setting the Theater for CENTCOM will not include AFG.

Contractor Demobilization

RFP Section I ¶ I-255 252.225-7997 Contractor Demobilization (Deviation 2013-O0017)

(a) Please advise if paragraph I-255 applies to Afghanistan only, or if this clause applies to all GCC areas of operation.

At paragraph I-255 (d)(9) the clause states, "The Contractor is liable for all cleanup, clearing, and/or environmental remediation expenses incurred by the Government in returning a Government facility to its original condition. "

This language, requirement and Government expectation is not clear.

(b) Please confirm environmental remediation expenses are cost reimbursable.

(c) Please confirm all wastes related to support of Government operations is USG waste.

(d) Please confirm all hazardous wastes related to support of Government operations will be disposed via a USG hazardous waste generator number, and provide direction on what procedures the Government desires offerors to use for this requirement.

(e) For solicitation purposes, will the Government provide a "plug number" for offerors to use in Volume V (Cost/Price) for this requirement? If not please describe what environmental conditions exist and the Government's expectations for offerors to use to meet Volume II (Technical/Management) and Volume V requirements.

4 Exclusions Clause RFP, Section L, Volume (v), para 8, page 100

Paragraph 8 states that Offerors should ensure that the cost narrative contains the Offerors written verification that it carried out due diligence in determining the appropriate exclusions in H.3 were taken into account in developing its proposal."

H.3 Exclusions Clause is not provided in the draft RFP.

H-3 in the current draft covers 5152.225-5914 COMMODITY SHIPPING

RFP Section C ¶ C-3 5152.225-5904 5904 Monthly Contractor Census Reporting (ECC-A)

This section requires to provide monthly employee census information to the Contracting Officer, by province. This may not be applicable to all AORs (because not all locations will have provinces).

Please clarify to what geographical locations this requirement applies. Public

Government Furnished Contractor Support

RFP Section H, ¶ H-1 5152.225-5908 Government Furnished Contractor Support

Government Furnished Contractor Support (GFCS) effects both the offerors approach and anticipated costs of performance.

Please confirm the final solicitation will identify the GFCS available for every (or each) GCC/ASCC. Public

Yes. This will be incorporated into a future draft and will be theater/mission specific.

CPAF and CPIF Task Orders

RFP, Section A, ¶ Paragraph 10 Section I Clauses ¶ I-162 252.216-7004, ¶ I-163 252.216.7005, & ¶ I-213 52.216-10

Paragraph 10 states "... task orders may utilize fixed price, cost reimbursable, and time-and materials or labor-hour capabilities."

The RFP does not state either award fee or incentive fee task orders are contemplated.

(a) Please advise if award fee and or incentive fee task orders are contemplated, and if so will their use require a change order to incorporate such capability (capabilities) into the contract.

If these task order types are contemplated;

For incentive fee task orders -

(1) Please confirm the Government will specify the incentive fee arrangement (i.e., target fee, minimum fee, maximum fee, and the fee adjustment formula) when CPIF type task orders are contemplated; and

(2) Recommend the incentive fee for CPIF task orders be based on cost only due to the additional administrative costs borne by both the USG and contractor for more complicated incentive fee arrangements.

For award fee task orders -

(3) Please advise what award fee structure will be used.

If neither of these task order types are contemplated,

(b) Please confirm these clauses will be removed from the solicitation. Public

The USG does not intend to incorporate any FAR 16.4 Incentive Contract types into the basic contract or task orders awarded through solicitation W52P1J-16-R-0001. The USG will maintain the capability to convert to these types of arrangements or include in future task orders. Removal of clauses is being considered.

GCC/ASCC

awards to one contractor Attachment, Source Selection Process Chart

During the November 2016 Industry Day a Government chart (Source Selection Evaluation Criteria) indicated "• No Offeror will receive more than two" GCC/ASCC.

The current Process Chart provides an opportunity for an offeror to receive 3 awards - one from Group 1, one from Group 2 (less CENTCOM), and Afghanistan.

Request confirmation that one offeror may receive up to three awards. Public

The chart depicts the current source selection process, which will be conducted in three groupings. Offerors are eligible to receive awards in accordance with the criteria. Ref. page 101 of draft RFP for narrative.

11 Overtime

RFP Section I ¶ I-39, 52.222-4 Contract Work Hours and Safety Standards – Overtime Compensation

FAR Subpart 22.305 states FAR Clause 52.222-4 should not be used in solicitations and contracts performed outside of the United States.

Please confirm this clause is not considered active for services performed OCONUS Public

This clause is not considered applicable to OCONUS services to the extent provided by its implementing regulation.

Offerors should be aware that certain OCONUS locations are subject to this clause. See FAR 22.305(d).

12 Overtime

RFP Section I ¶ I-217, 52.222-2 Payment for Overtime Premiums

The contract is performance based and also requires contractors to comply with local law. This clause potentially restricts/delays contractors in meeting task order requirements and is not consistent with the objective of performance based contracting.

Recommend clause be removed. Public

The clause will not be removed. Its prescribing regulation, FAR 22.103- 5(b), requires its use in cost-reimbursement contracts exceeding the simplified acquisition threshold. The two exceptions are generally not applicable.

Personnel Accountability and Recovery

RFP Section H ¶ H-4 5152.225-5915 Contractor Accountability and Personnel Recovery

Clause (2) states that "The contractor is responsible to take all necessary steps to locate and investigate the unaccounted for employee(s) whereabouts to the maximum extent practicable".

The term "all necessary steps" is vague and open ended. It might be construed to include hiring of private security firms if the requirement includes investigating the location of unaccounted employees in areas not accessible to contractors without force protection escorts.

(a) Please advise what the Government's intention is for this requirement;

and

(b) Please advise if there is a limit to the contractor's responsibility; and

(c) If there is a limit to the contractor's responsibility clarify the requirement in this clause; or

(d) If there is not a limit to the contractor's responsibility confirm the Government is aware costs related to the performance of this clause are allowable. Public

The USG intends to build a clause matrix that specifies applicability of clauses to a task order, theater, etc.

Allowability is determined based on specific circumstances. USG cannot provide the requested blanket intent other than what is set forth in the clause.

Proposal Instructions RFP, Section L, Paragraph iii.11.

Question: The Government states that for any adverse contract performance, the Offeror should “provide all the required information listed in paragraph ii.6.” However, paragraph ii.6 does not exist.

Please clarify the Governments requirement. Did the Government mean paragraph iii.6? Public Yes. This will be corrected in an updated version.

15 RFP RFP, Page 1, SF 33, block 1

Box 1 states that this contract is a rated order under DPAS (15 CFR 500). Is it necessary to rate the basic contract under DPAS? If so, will the Task Orders carry the DO-A6 (Ammunition) rating as the basic contract?

Workers with Disabilities

RFP Section C ¶ C-2, 5152.225-5902 Fitness for Duty and Medical/ Dental Care Limitations;

¶ I-241, 52.222-36 Equal Opportunity for Workers with Disabilities

Clause 5152.225-5902 establishes medical standards for contract employees deploying to CENTCOM AOR. Other clauses in the RFP provide similar standards for other GCC/ASCC.

Clause FAR 52.222-36 prohibits discrimination against qualified individuals on the basis of disabilities.

Please confirm Clause 5152.225-5902 establishes qualifications for personnel working on LOGCAP contingency task orders and there is no conflict between Clause C-2 and Clause I-241; i.e., if an individual is not qualified under Clause 5152.225-5902, the individual is not qualified under the terms of FAR Clause 52.222-36.

What is the estimated timeline for the approval of the acquisition strategy for LOGCAP V? Do you anticipate significant changes? Public

Strategy is in the approval process. Significant changes are not anticipated.

20 General Draft RFP

The Draft RFP is very Afghanistan centric. Throughout the document Afghanistan specific requirements are intermingled. Would be helpful to breakout specific requirements for each GCC. Public

21 Teaming Draft RFP

It appears that the over/under teaming prohibition has been removed. Can you clarify in the RFP if it is allowable to bid as a prime on one GCC and as a partner (or as a sub) with another contractor on a separate GCC? Public

Prime KTR are required to bid on and be determined acceptable for all GCC in order to be eligible for award.

Level of work effort detail Draft RFP

It appears that neither the Draft RFP, nor the Draft PWS, provides a sufficient level of detail to allow for a basis of estimation on work effort required. Will it be included in the final RFP? Public

USG will populate the requirements template (activated sites/services, site specific requirements, and workload) in future RFP.

paragraph 9

DRFP indicates that performance task orders awarded at the time of the basic contracts will consist of a one (1) year base plus four (4) one year option periods. What will be the standard for performance task orders awarded after the award of the basic contract? Base plus four one year option periods? Public

Task orders awarded after basic contract award will be based on the mission/requirements. Annual assessments will be conducted to determine suitability for competition.

paragraph 9

Is there an indication as to when a performance task order exceeds a certain level (either monetarily or scope based) that a second contractor would be required to be brought in to perform in a GCC initially identified as having only one contractor? i.e only one contractor at base award vice two or more. Public

There are no predetermined limits. The USG intends to align new work to the contractor responsible for Setting the Theater and will obtain necessary approval to operate similar to a single source environment. However, the USG reserves the right to (re)compete requirements or award task orders based on the operational environment.

paragraph 9

What is the strategy beyond the base plus 4 option periods for option years 5 through 9? Will every GCC/ASCC be recompeted amongst LOGCAP V successful contractors? Public

The setting the theater task order includes options up to ten years of performance. Performance task orders include options up to five years of performance. Decisions on executing options, and/or re-compteting task orders, will be based on the operational environment and IAW FAR 17.207.

26 General I-230 Earned Value Management System

Is it the governments intent for the offeror to operate in compliance with EVMS on all contracts greater than $100M, not just construction and engineering contracts? Public

Acknowledge. This topic is under review. Current USG intent is to operate in compliance with EVMS for construction and engineering efforts.

27 Quality Standards PWS Paragraph 02.02.01 Program Management Office.

Office of Federal Procurement Policy, Pamphlet Number 4, Supplement No.

2 to OMB Circular No. A-76, at paragraph 6-1.b states, “To aid contractors in developing a quality control program, the contracting officer must provide the government Quality Assurance (QA) Surveillance plan along with the Invitation for Bids or Request for Proposal.”

(1) Please confirm the Government will provide the LOGCAP V Quality Assurance Surveillance Plan (QASP); and

(2) Please confirm any geographic combatant command (GCC) QASP variants of the LOGCAP V QASP will also be provided.

Public The USG will take into consideration, and will make a decision on releasing the QASP prior to issuing the solicitation/RFP.

Adverse Contract Performance

RFP, page 98, Section L, Proposal Instructions,

(iii) Volume III - Past Performance, (11) Adverse Contract Performance, (b) and (f)

Paragraph (b) states, "Provide a copy of any Contract Deficiency Report (CDR) or Quality Deficiency Report (QDR)."

Please confirm

(a) CDR is described by DFARS Subpart 204.270-2(c) and DFARS PGI 204.270-2(c); and

(b) QDR refers to AR 702-7 and CFR Title 41 (vol. 2) subpart 101-26.8 .

If so,

(1) contractors do not have access to CDRs and QCRs (DD Form 1716 and GSA SF 368, refer).and

(2) Please describe what contract evaluation documents - other than CPARS ratings - are desired from contractors.

29 Close Out

PWS Paragraph 02.02 Post Activation

At paragraph 02.01 the draft PWS addresses Setting the Theater - Pre Activation" requirements, and at paragraph 02.02 the draft PWS addresses "Management Support - Post Activation" requirements. The draft PWS does not address all life cycle requirements of a contract, specifically requirements related to actions following the end of the period of performance; i.e., contractor closeout actions such subcontract closure, payment of other lagging costs, task order actions not yet definitized, etc.

Recommend the Government provide a separate closeout WBS and PWS direction/intent for the contractor’s role to support USG FAR 4.804, Closeout of Contract Files, actions. Public The USG does not intend to provide a separate closeout WBS.

Earned Value Management

RFP Section I ¶ I-230, 252.234-7002 Earned Value Management System (EVMS)

The Earned Value Management System (EVMS) is designed for contracts providing services in general or for contracts supporting construction in contingency environments for three primary reasons;

(1) Most contingency construction projects are below the EVMS thresholds, and

(2) The very nature of contingency operations typically ensures emergent conditions are intrinsic to service/construction conditions. These emergent conditions and compressed time periods available for providing required services/construction negate the EVMS advantages. contract where the primary functions are to provide services.

(3) The effort to implement and administer EVMS for contingency construction projects will result in a larger contractor footprint on site and will increase total project costs to the USG for minimal/negligible benefit.

For these, and similar viable reasons, it is recommended EVMS requirements be waived for this contract. Public

Acknowledge. This topic is under review. Current USG intent is to operate in compliance with EVMS for construction and engineering efforts.

Operational Energy Initiatives

PWS 03.01.02

Operational Energy Initiatives

The task requires the contractor to identify opportunities for reducing energy requirements. FAR 52.248-1 Value Engineering establishes the Value Engineering Change Proposal (VECP) process. VECP provides an opportunity for contractor incentives.

Recommend this paragraph include/authorize the use of FAR 52.248-1.

FAR 52.248-1 is included in the RFP. The USG does not consider the requirement of PWS 03.01.02 to fall under the intent of the clause.

Past Performance Evaluation approach

Comment. The RFP states "The relative order of importance assigned to the evaluation factors is: Technical/Management is more important than Past Performance".

Question. Will the Government consider either: (1) making Past Performance the most important evaluation factor, or (2) making Past Performance and Technical/Management equally important (with both more important than the other evaluated factors)?

Technical is the highest rated factor. This strategy is in the approval process.

The RFP states: "For each task order proposal, the offeror shall provide separate summaries identifying total costs, total fees, and total cost plus fee proposed for each Performance Work Statement (PWS) paragraph and site activated in Technical Exhibit A.1 by performance period."

Question: Will the Government provide Technical Exhibit A.1 by performance period so that we fully understand the meaning of Site A, B and C? In other words will the Government provide the definitions for Site A, B and C? Public

The site codes "A", "B", and "C" are placeholders. Actual requirements will be released with final RFP. The sites and services activated are listed in the Technical Exhibit A.1. The contractor will assume these services will be carried through all performance periods.

Firm Fixed Priced Task Orders

Section A, paragraph 10 FAR Subpart 11.7 Variation in Quantity

What method will the Government use to adjust the quantities of individual FFP services after award?

For example, if the estimated quantity for a service is X, and the actual requirement is Y, and Y is greater than X, will the Government use a change order for each individual service or will the Government use a general (section H) variation of quantities clause similar to FAR Clause 52.211-16?

The various clauses identified in FAR 11.703 are not applicable to this effort. The USG intends to incorporate required clauses for each contract type. The process for implementing changes to the contract is still under review.

Section L requires separate cost/price proposals (with some limited exceptions for certain portions as stated therein) for the CPFF efforts, partly due to the expected size and complexity of the proposals. At this time, the limited pricing information required for the FFP efforts are such that it does not appear necessary to require each task order pricing to be on a separate pricing file (i.e., spreadsheet).

Indirect Rate Caps

For a potential 10-year contract to be performed in austere overseas locations involving flexible requirements in contingency situations, capping the contractor's indirect rates does not appear reasonable. Request deletion of the attachment and the rate cap.

Clarification on proposals for performance task orders

Draft RFP states that, "The Offeror shall prepare and submit separate cost/price proposals for each of the task orders identified below in accordance with this RFP. " Listed below are only 3 identified task orders (A, B, and C). Does this mean that there is no requirement to bid all active task orders and that only those performance task orders being made at time of basic contract award will need to be proposed and all others will be worked post award? The Government is still in the process of finalizing its requirements, so "A", "B", and "C" were placeholders. The final RFP will identify those requirements for which pricing is required, with the expectation that such requirements will be part of the initial award unless revised by a subsequent amendment. Any subsequent work not included in the RFP as amended will be solicited and awarded as provided for under this solicitation and resulting contract.

64 General M.c.Factor 3- Small Business Participation

Can the government confirm that the objective is 15% of total contract value and not 15% of subcontracted dollars? Is the objective to achieve this amount in each pricing exercise per GCC? This is a significant amount for certain GCCs which already require substantial subcontractor participation due to sponsorship requirements. If this number remains, the USG will likely receive CENTCOM TO responses in which 70-80% of the work is subcontracted out. Will the USG consider reducing this requirement or making the requirement 15% of subcontracted dollar? Public

This could imply the contractor awarded CENTCOM will have "Setting the Theater" responsibility for Afghanistan which would be different from the contractor awarded Afghanistan.

Which contractor is responsible for "Setting the Theater" for Afghanistan? Public

WBS 02.01 Setting the Theater is a pre-activation requirement.

Afghanistan will be considered a post-activation requirement. Since AFG is an active theater the performance KTR will be responsible for all planning associated with LOGCAP requirements. Any tasks related to planning capability will be accomplished through Project Planning/Estimates, WBS 02.01.04 or the specific WBS for any activated services. Setting the Theater for CENTCOM will not include AFG.
