These questions pertain to the required 4 hour recurring inspections:

a. Are on-duty personnel working in a building sufficient to meet this requirement during normal duty hours?

b. What clearances are required for the individuals performing these inspections?

c. What specific buildings are required to be inspected?

d. Are checking mechanical, electrical and other equipment/ system rooms sufficient or does DOS want the inspections to physically check all floors and common areas in addition to building systems?

a. The contractor is responsible for ensuring that building systems are functioning properly 24/7. Building systems include, but are not necessarily limited to 1) Electrical generation and distribution, 2) HVAC,

3) Water supply, purifiction and distribution, 4) Fire alarm and suppression systems, 5) Sanitary sewer and waste water treatment plants, and 6) Elevators. The intent of this requirement is to ensure that these systems are observed by qualified personnel at a minimum of every 4 hours. If the personnel on duty in a particular building are qualified to make the determination that the systems are functioning properly and take appropriate action when needed, the requirement is met. If systems can be monitored remotely (ie.: by BAS) the qualification may be met so long as the staff monitoring the system act to correct all issues in a timely manner.

b. Personnel making the above inspections must have the clearance necessary to be unescorted in the building.

c. All buildings having the above referenced systems.

d. It is the contractor's responsibility to determine what level of inspection is required to ensure system functionality.

Section C SOW paragraph C.4, page C-

In order to price the requirements in paragraph C.4, it is necessary to know the manufacturer of the equipment and systems - to include the model and serial numbers. As an example, this information is needed in order to get a price from a vendor to provide certification training either at their location or on-site. In addition, some manufacturers (e.g. Caterpillar) cannot provide O&M manuals without knowing the model number, serial number and other specific information. To properly estimate work requirements bidders need to be able to review the O&M manual. This is important for all critical utility systems and installed equipment. Would the

Government make this information available? Alternatively, would the Government make O&M manuals and other manufacturer data available?

The definition of repair work and what the contractor is responsible for is not clear. For example, in paragraph C.4.O.7 it states

“…Repairs may be partial overhaul, reprocessing or replacement of all damaged parts/materials within a system that have deteriorated by weather/usage and could not be corrected through maintenance.

Total overhaul, reprocessing, or replacement of equipment/systems is considered repairs…” In this last SOW requirement there is conceivably financial no limit to what the Government may require as a repair. Would the Government provide quantified parameters that describe the monetary thresholds that apply to repair work?

There is no uppper price limit for repairs and maintenance on existing equipment. Direct labor and related costs for repair work shall be included in the firm-fixed-unit-prices [see Section L.16.2.2(17)], and all direct non-labor costs and related costs for the Baghdad Task Order shall be payable based on the actual incurred costs determined allowable by the Contracting Officer.

In paragraph C.4.P.3 it states “…If a call is received that in the opinion of the Facility Management Service Desk staff is not within the Scope of Services of this contract, it should be documented the same as all other calls and referred to the COR…” With no workload and no clear definition of the limits of liability for work orders and repair work, it is not clear what is not within the scope of services. Would the Government clearly define the scope of services parameters?

All repairs and maintenance to equipment and facilities listed in the

SOW will be done by the Contractor. If there is an event that causes significant work outside the Scope of Services as determined by the

Facilities Maintenance personnel to include the description of "light construction" then the Contractor and the COR may initiate a task order to be negotiated for the work involved. Other projects (e.g. installation of a new guard tower) that may exceed the limits of the Light Construction crew, may require a task order proposal to be negotiated or it may be competed.

L.16.2.2 Price Proposal

Instructions 1

The Government has requested the Detail Pricing Tables to be contained in a second folder (Excel workbook) containing one or more worksheets. As noted the Detail Pricing Tables must reflect the breakdown of each firm-fixed-unit-price per M2 proposed in

Pricing Table 4 (4.Firm-Fixed-Unit-Prices). Since the Detail Pricing

Tables support Pricing Table 4, will the Government allow such tables to be in the same folder (Excel Workbook) as Pricing Tables

1-7 rather than a separate folder? This approach will allow the direct linking of data to Pricing Table 4. Further, it will allow the

Government to review all data in a single Excel Workbook rather than opening two Excel Workbooks to confirm the firm-fixed-unit-prices reflected on the Pricing Table 4.

While the Government recognizes the linking aspect, it elects to maintain the instruction [in Section L.16.2.2(1)].

L.16.2.1 Price Proposal

Information 38 and 39

Instruction 38 states the Contractor’s proposed ceiling fiscal year indirect rates on the Detail Pricing Tables (for Pricing Table 5) must coincide with contract performance period. Instruction 39 states the ceiling indirect rates on the Detail Pricing Tables (for Table 5) must match Pricing Table 3. If the contract performance period does not match the Contractor’s Fiscal Year, Contractors will not be in compliance with this requirement. Will the Government modify these paragraphs or Pricing Table 3 to allow the weighting of indirect rates so they reflect the indirect rates associated with the contract performance period?

The Government finds no need to modify these instructions because they not only allow, but also require offerors to propose the applicable ceiling indirect cost rate(s) for more than one contractor fiscal year for a given contract year when the offeror's fiscal year does not match the contract year. In such a case, offerors should show on the Detail Pricing

Tables (for Pricing Table 5) the applicable ceiling indirect cost rate(s) from Pricing Table 3 and apply each rate to the number of months of its fiscal year that coincides with the contract year.

L.16.2.2. Price Proposal

Instructions 32

Under this section the Government has requested a breakdown of the proposed DBA Insurance costs by employee name. The incumbent is the only Contractor that has employee names for this contract. Further, it is impossible for a competing Contractor to know employee names for every position on the contract until after award. Typically competing Contractors will hired some incumbent employees, but this information will only be available after award.

Will the Government consider eliminating this requirement?

The Government maintains this instruction but will not penalize an offeror which cannot identify each covered employee name.

Pricing Table 5

Government specified "4" in the "Units" column under a few descriptions because it does not have realistic estimates at this time. The RFP-specified units for all descriptions will be used for evaluation purposes only.

Key Personnel, Key

Personnel - Sample

Task Order, Key

Personnel

Pages C-33, 121, 146

Within the RFP, key staff nomenclature and requirements are referred to specifically in Section C.6.A.; Section L.16.1.3.2; and

Section M.10.1.2.2. Additionally, the issue of key staff usage and requirements was raised during the Job Walk, by an attending bidder, who asked if the designations for Key Staff as referred to in the RFP were specifically required. The verbal answer by the KO, paraphrased, indicated “…each bidder will propose their own methodology, identifying staff and positions consistent with that firms unique approach…”.

While this verbal answer appears to conflict with Section L requirements - Section C.6.a.2 allows some flexibility in the naming and designation of key staff as modified by the phrase “or equivalent” in the requirement quoted from Page C-32 as follows:

“These positions (or equivalent) are the contract executive….et. al”.

To clarify these ambiguities regarding specific key staff requirements, our question is this: Given that Section C.6.a.2 allows for equivalent usage of key staff and associated terminology, can each bidder specifically specify and propose key staff, using terms consistent with that firm’s management structure and approach, such that DOS clearly understands: • Which positions are designated as Key by the bidder; • The roles and responsibilities of each key position;

• That resumes for such key staff are included,

• And that requirements of C.6.a.5 addressing commitments of key staff are complied with?

See also H.62 If a contractor decides to bid key personnel other than those identified in the

SOW and associated sections of the solicitation, it is incumbent upon the bidder to: 1. identify the key personnel by name and provide resumes; 2. explain their role and responsibilities;

3.ensure that there is the level of talent and expertise identified by the solicitation for each key position and technical field within the proposal,

4. ensure there is adequate coverage for areas requiring clearances and during times of a key person being absent from the place of performance (e.g. R&R). Further, the contractor will need to explain the overall business approach, organizational structure and identify advantages (financial, efficiencies, etc) to the

Government on accepting these alternatives.
