About this file
This is Addendum #1 to RFP S-10700-00009763 for Aluminum Boarding Docks issued by the State of Oregon Department of Administrative Services, State Procurement Services. The addendum modifies the original RFP by clarifying requirements for the fabrication and delivery of aluminum docks compliant with OSMB standards, including Type A, B, C, and Self Adjusting models, along with modifications (first dock, last dock), transition plates (12" & 18"), and a maintenance package. Proposers must submit detailed price proposals as separate electronic files in OregonBuys that include all labor, materials, tools, equipment, delivery, and offloading costs. The addendum specifies that delivery is a required service with pricing to be negotiated, and establishes the proposal submission deadline as January 23, 2026, at 1:00 PM Pacific Time, with a pre-proposal conference scheduled for December 17, 2025. The anticipated evaluation conclusion is March 2026, with an initial contract term of five years and renewal options available up to a cumulative maximum of ten years.
The addendum replaces both Attachment A (Sample Price Agreement) and Attachment E (Price Proposal Form) with revised versions. If multiple price agreements are awarded, authorized purchasers will receive fair opportunity consideration through best value analysis that includes cost as a considerable factor. The contractor must accept ordering instruments from authorized ORCPP and MCUA participants unless rejected within five business days with specified reasons. Contractor insurance requirements include Workers' Compensation, Commercial General Liability ($1,000,000 per occurrence/$2,000,000 aggregate), Automobile Liability ($1,000,000 combined single limit), and Bailee's Insurance ($240,000 per occurrence). Contractors must provide a two-year warranty on all docks and components, submit Volume Sales Reports, and remit Vendor Collected Administrative Fees equal to 2 percent of gross sales. All projects with federal funding must comply with the Infrastructure Investment and Jobs Act (IIJA) and Build America, Buy America Act (BABA) requirements mandating U.S. production of materials. Protests to the addendum are due by January 7, 2026, at 5:00 PM.

Section 1.5 is modified as follows.
1.5 CONTRACTOR SELECTION AND ORDERING INSTRUMENTS
1.5.1 If multiple Price Agreements were awarded under RFP # S-10700- 00009763, Authorized Purchaser will provide each Contractor a fair opportunity.
Each order will be determined using a best value analysis that includes cost as a considerable factor. Authorized Purchaser will document the best value analysis used for each order.
1.5.2 A Contract created by an ordering instrument consists only of the terms specified or required by this Agreement. Additional, different or conflicting terms and conditions in any Purchase Order(s) or any other ordering instrument of either an Agency or the Contractor shall not vary the terms of this Agreement. Unless otherwise expressly agreed, Contractor’s online ordering terms and conditions will not change the terms and conditions of this Agreement or any Contract.
1.5.3 Subject to the provisions of this Agreement, Contractor shall accept ordering instruments from Authorized Purchasers that comply with the provisions of this Agreement until this Agreement terminates. Contractor may, but is not required to, accept an ordering instrument requesting a delivery schedule less than any minimum lead time, if any, specified in Exhibit A.
1.5.4 An ordering instrument is deemed accepted by Contractor unless Contractor rejects an ordering instrument within five (5) Business Days after it is received.
Contractor may reject an ordering instrument: i) using the same means as were used to deliver the ordering instrument, or ii) by e-mail if that information is evident on the ordering instrument. Contractor shall specify the reason(s) for rejection.
Accepted ordering instruments establish separate Contracts between Authorized Purchaser and Contractor and include the terms set forth in Sections 2 and 3. As used in the Contracts, “Price Agreement” means this Agreement.
1.5.5 Nothing in this Agreement obligates Agency or any Authorized Purchaser to place any ordering instrument. Notwithstanding the award of this Agreement to Contractor, Agency and Authorized Purchasers may conduct separate solicitations or award project-specific contracts or purchase orders for Goods and related Services that are the same or similar to those described in this Agreement using any method allowed by law. In addition, Agency reserves discretion to re-open or readvertise competition to provide Goods and related Services that are the same or similar to those described in this Agreement, if necessary to serve the interests of Authorized Purchasers, at intervals no more frequently than on a yearly basis.
1.5.6 Contractor shall reject an ordering instrument that does not meet the requirements of this Agreement.
1.5.7 Contractor shall reject an ordering instrument from any entity that is not an Authorized Purchaser under this Agreement. Contractor may verify that Authorized Purchasers are ORCPP participants at the following address:
