About this file
This Question and Answer document addresses clarifications regarding RFP #S-10700-00009763 issued by the State of Oregon, Department of Administrative Services, State Procurement Services, for aluminum boarding docks. The RFP seeks to establish one or more statewide price agreements for seven types of aluminum boarding docks in various configurations (Type A, B, C, and Self-Adjusting models), each measuring 6 feet by 20 feet, along with related materials, equipment, and services. All dock designs must conform to specifications detailed in the RFP attachments, with the maximum length for self-adjusting dock systems limited to four sections. The pre-proposal conference was scheduled for December 17, 2025, with proposals due January 23, 2026, at 1:00 PM Pacific Time, and anticipated evaluation conclusion in March 2026. The initial contract term is five years with renewal options extending to a cumulative maximum of ten years. No bonding is required for dock purchases, though bonds may be required for installation under separate public improvement bids.
Pricing will be structured as fixed-price agreements with standard terms and conditions to streamline the procurement process for authorized purchasers. Delivery costs must be negotiated separately between the authorized purchaser and contractor and itemized on invoices as separate line items. The fixed-price agreement may allow for progress billing throughout projects as detailed in the sample agreement. Contractors are eligible to estimate on individual projects through open market solicitation, though authorized purchasers subject to OAR 125-247-0200 are required to utilize price agreements before pursuing open market bids. Proposers must meet minimum qualifications including AWS structural welding certifications and a minimum of five years' consecutive experience manufacturing aluminum structures. Contractors awarded price agreements must submit volume sales reports and vendor-collected administrative fees equal to 2 percent of gross sales. Projects with federal funding must comply with the Infrastructure Investment and Jobs Act, including Build America, Buy America Act requirements mandating U.S. production of materials and manufactured products.

Question and Answer Document
RFP # S-10700-00009763
State of Oregon Aluminum Boarding Docks (updated 12.29.2025)
1. Are these floating docks or can they have legs?
This RFP is for the Oregon State Marine Board (“OSMB”) standard floating aluminum docks as detailed in Section 2.4 of the RFP and also in Attachment A, Exhibit E (Specifications) and Exhibit F (Drawings).
2. Carve out for pilings, can they be on the inside or do they need to be on the outside of the piling?
There are several dock configurations. Some are internal pile pockets, some are external pile hoops, some are without pile accommodations. See Attachment A, Exhibit F (Drawings) for complete details.
3. Are the designs only tied to the ones listed in the RFP or is there an opportunity to provide other designs?
The designs are tied to the ones listed in Attachment A, Exhibit E (Specifications) and Exhibit F (Drawings). Modifications to the standard docks listed in the Specifications or shown on the Drawings shall be the responsibility of the Authorized Purchaser, to be priced ‘as quoted’ (reference Attachment A, Exhibit A).
4. How are materials and inflation costs covered in this RFP?
Attachment A, Exhibit E (Specifications), specifically Section 2.16 (Products) detail material requirements or approved equals. Similarly, Attachment I (Material Certification Sheet) details material requirements, if Proposer can meet the specifications, and if not, the proposed substitutes.
Regarding costs as it relates to inflation, additional items may be negotiated during the negotiation process per RFP Section 5.4 (Price Agreement Negotiation).
5. Are there bonding requirements for this?
Bonds are not required for the docks in this RFP. Bonds may be a requirement under a public improvement bid for installation of docks but not required for the purchase of docks.
6. For the self-adjusting docks, there are a varying number of arms that are attached to the bottom of the dock, is there a way to account for the number of arms and how long they will need to be (ie: 3, 4, 5, 6, 7 dock sections)?
The design maximum is 4 docks long for self-adjusting dock systems. The arm lengths are determined by the ramp slope. See Attachment A, Exhibit E (Specifications) and Exhibit F (Drawings).
7. Section 1.1 of the RFP cover page states you are looking to award fixed price agreement to one (1) or more companies, as well reserve the right to put the projects out to public bid?
Correct, Proposers are advised that there is no guarantee of any specific amount of purchases under the Price Agreement. Notwithstanding the award of a Price Agreement, Agency may conduct separate solicitations or award project-specific contracts or purchase orders for Goods or Services similar to what is described within this RFP using any method allowed by law.
8. Being as how most, if not all, of the Dock Projects in recent history have been awarded based on lowest bidder status only, are we still subject to a lowest bidder format on each project even with a fixed price agreement in place? And if so, how does a fixed price agreement change the current process?
This will be addressed in Addenda 1 to the RFP.
See Section 5.4.2 of the RFP for Contractor Selection Methodology. A price agreement would create standard terms and conditions, specifications, and a set pricing structure to streamline the process for authorized purchasers. See Section 1.5 in Attachment A (Sample Price Agreement)
9. I do not see any Oregon Based Company incentive in the RFP?
Preferences are detailed in Section 4.10.4 of the RFP.
10. Would a Contractor still be able to estimate on individual projects, without being awarded a fixed price agreement?
Any contractor can bid on the Open Market solicitation process but Authorized Purchasers subject to OAR 125-247-0200 are required to go through Price Agreements prior to the Open Market. Local ORCPP agencies may also utilize the Price Agreement prior to soliciting under an open market bid process.
11. Under the fixed price agreement, would the recipient still be able to progress bill throughout projects, or only bill upon completed delivery?
Negotiation of a Price Agreement is detailed in Section 5.4.1 of the RFP. In addition, please review Attachment A (Sample Price Agreement), specifically Sections 2.2 and 2.5.
12. Section 3.3.12 requests delivery and offload as part of the proposal, how would you like to see that, as quantity and location are a significant factor in this cost?
This will be addressed in Addenda 1 to the RFP.
Per Attachment A, Exhibit E, Section 2.11.2, Delivery shall be negotiated between Authorized Purchaser and Contractor. Delivery costs shall be included on invoice as a separate line item. See Attachment A, Exhibit E, Section 2.11 for additional details.
13. Is the agreement transferable upon a change of ownership?
Negotiation of a Price Agreement is detailed in Section 5.4.1 of the RFP. In addition, please review Attachment A (Sample Price Agreement), specifically Sections 1.8.4 and 2.27.
