About this file
This is a Performance Bond template document issued by the County of Orange, California for use in securing faithful performance of County contracts. The bond serves as a financial guarantee that the principal contractor will complete all work in accordance with contract specifications and terms. The bond requires a surety company authorized to conduct business in California to jointly and severally bind itself with the contractor for the penal sum specified in the contract. The document mandates that the surety representative's signature be notarized with the certificate of notarization attached, and the surety company name must be typed or stamped above the signature line. The bond remains in full force until the contractor satisfactorily performs all covenants, conditions, and agreements outlined in the underlying contract, including any alterations made therein. The surety waives notice of any changes, extensions of time, alterations, or additions to contract terms and agrees that such modifications do not affect its obligations under the bond.
The bond includes provisions for the County to recover all costs and reasonable expenses incurred in enforcing the obligation, which are to be taxed as costs and included in any judgment rendered. Approval of the bond is required from both the County's CEO or Risk Management office and the Office of the County Counsel. The document incorporates California Corporations Code section 313 requirements for corporate signatories, specifying that either two authorized officers must sign (chairman, president, vice president, secretary, assistant secretary, chief financial officer, or assistant treasurer) or a single officer may sign with written evidence of authority through corporate resolution. This performance bond template is applicable to the Smart Irrigation Controllers and Master Valve/Flow Sensor contract (IFB #012-3044004-EB-2) and requires execution prior to contract commencement to ensure contractor performance and County protection.
