About this file
This is a Performance Bond template document issued by the County of Orange, California, for use in conjunction with contract performance obligations. The bond serves as a faithful performance guarantee requiring the principal contractor and a surety company to guarantee completion of contracted work according to specified terms and conditions. The bond is structured as a penal sum obligation, with the actual bond amount to be determined based on the contract price and applicable premium rates. The County retains the right to enforce the bond, recover associated legal fees and expenses, and maintain the bond's validity regardless of any contract modifications, time extensions, or specification changes without requiring notice to the surety.
The bond requires execution by authorized corporate officers of both the contractor and surety company in compliance with California Corporations Code Section 313, with surety signatures subject to notarization requirements. The document must receive approval from both the County's CEO/Risk Management office and the Office of the County Counsel before execution. The template permits the County to recover enforcement costs, attorney fees, and reasonable expenses as part of any judgment obtained against the bond. All bonds submitted must include the notarized certificate of notarization attached to the document, and the surety company name must be typed or stamped above the representative's signature line to ensure clarity and proper identification of the bonding entity responsible for performance guarantees.
