About this file
This Justification & Approval (J&A) document is for the Department of Veterans Affairs, Veterans Health Administration, seeking brand name procurement for specific construction materials at the Boston Healthcare System, West Roxbury Division. The project involves replacing the existing medical center boiler system through a firm-fixed price contract, with two specific brand name items required: a TRANE Summit Tracer Building Technology Direct Digital Control HVAC Building Management System and a TRANE Packaged Air Handling Unit. The VA is requesting sole-source approval for these items based on existing campus-wide standardization, with arguments that alternative manufacturers' systems would compromise system compatibility, potentially disrupt functionality, and risk patient health and safety. The statutory authority invoked is "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements" under 41 USC §3304(a)(1), with the procurement effective date set for 11/15/2024.

DEPARTMENT OF VETERANS AFFAIRS
Justification & Approval (J&A) For
Brand Name
Acquisition Plan Action ID: 36C241-24-AP-4454
1. Contracting Activity: Department of Veterans Affairs, Veterans Health Administration, Regional Procurement Office East, Network Contracting Office 1 (New England).
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
Boston Healthcare System, West Roxbury Division has a requirement to replace the existing medical center boiler system. This requirement will be awarded as a firm-fixed price contract. This justification is for the procurement of certain brand name construction materials necessary during this construction project. There are two (2) brand name items listed for which the VA is not able to accept equal or alternate items. The total of the brand name items is approximately The breakdown of these items is listed below.
The use of a particular brand name for the items listed below accommodates standardization of these items throughout the campus:
a. Direct Digital Control Building Management System including components
i. TRANE Summit Tracer Building Technology Direct Digital Control HVAC
Building Management.
ii. Approximate Value:
iii. This system is VA West Roxbury Engineering’s Building Standard for the Direct Digital Control HVAC Building Management System.
b. Packaged Air Handling Unit
i. TRANE Manufacturer
ii. Approximate Value:
iii. Existing AHU units on campus are all manufactured by TRANE to support direct digital control compatibility to the BMS system.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: These items have been standardized throughout the West Roxbury VAMC. Installing a different manufacturers’ system not compatible with the existing system, in most cases will not function properly, therefore compromising patient health and safety. The specific justifications are listed below:
a) TRANE Building Technology Direct Digital Control HVAC Building Management System including components (including AHU) - TRANE Building Technology Direct Digital

Control (DDC). HVAC Building Management System is the existing building management control system installed and operating campus wide at the West Roxbury VAMC. Any products to be used on the existing HVAC Building Management System must interface with the existing system. To minimize the technical risks of ensuring compatibility among the component parts and integration of the entire DDC system with the campus wide system, the system and components installed in this project should be provided by the same manufacturer as that of the campus wide system; other manufacturer’s components may not operate properly or operate at all on the existing system. The VA has existing service contracts with TRANE. Using products from other manufacturers could potentially cause compatibility issues, disrupt the existing system's functionality, and potentially void the existing warranty with Trane, which is crucial for ensuring optimal patient care facilities. By adhering to Trane products, the VA can guarantee seamless integration with the existing system, minimizing technical risks and maintaining the reliability necessary for patient comfort and safety. Therefore, only this manufacturer’s products are acceptable, no substitutions.
4. Statutory Authority Permitting Other than Full and Open Competition:
( X ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1;
( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3;

( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7;
5. Description of market research conducted and results or statement why it was not conducted: Specific market research was not conducted in association with this request because the brand name products were previously obtained through full and open competition procedures and are now integral parts of existing facility systems. Approval of the items as brand name only is critical for the overall efficiency of the completed project and the entire West Roxbury VAMC facility.
