About this file

This document is an amendment to a solicitation for the P-095 Pier 3 Recapitalization project at Naval Station Norfolk in Virginia. The solicitation is seeking offers for the construction of a new reinforced concrete pier, associated site and utility work including a new building. The amendment incorporates responses to offeror questions, updates evaluation criteria and instructions, and increases the offer submission period from 60 to 120 days.

Key details include revising the minimum project size required for relevant experience from $50 million to $25 million, allowing steel H-pile and sheet pile experience to satisfy installation experience criteria, and permitting references to landside building and utility projects. The amendment also removes the requirement for a Project Labor Agreement and adjusts pricing instructions.

With the shortages in labor causing significant delays in the postal system, can this be modified to allow hand-delivery?

4 11 (1)-(i) Non-Price Factor 1- Corporate Experience: Due to the limited scope/complexity required to be a relevant project, please allow projects above $20 million to be utilized as a relevant project for Corporate Experience. Especially in the Hampton Roads area, there have only been a few large pier projects in the past 15 years. Allowing projects to be submitted over $20M will allow for more qualified offerors to demonstrate their corporate experience locally in the Hampton Roads area on naval facilities (including Naval Station Norfolk).

Since the window for experience is 15 years, a $20M project 15 years ago is equivalent to a much larger project today.

Refer to Amendment 0001;

Summary of changes.

5 11 (1)-(i) Non-Price Factor 1 - Corporate Experience: Due to the restrictive minimum size and narrow required scope/complexity, for offerors to properly demonstrate corporate experience as a relevant project, not allowing an offeror’s experience as a subcontractor, is limiting an offeror’s ability to team or joint venture.

Please allow an offeror’s own experience gain, while performing as a subcontractor.

Bid per RFP

6 11 (1)-(i) Non-Price Factor 1 - Corporate Experience: Scope/Complexity is narrowly defined as “Construction of reinforced concrete wharf or pier structures.” Please allow an offeror to utilize experience of reinforced concrete of major waterfront structures to this scope. There are multiple major waterfront structures (e.g. bulkheads, relieving platforms and graving dry docks) that are relevant to this type of construction.

Bid per RFP

7 11 (1)-(i) Non-Price Factor 1 - Corporate Experience: The element associated with “Installation” limits the types of piles allowed to be evaluated. A considerable portion of this project is structural supported by steel H-Piles.

Please allow for this type of pile to be utilized in the evaluation criteria.

Bid per RFP

8 11 (1)-(i) Non-Price Factor 1 - Corporate Experience: The element associated with “Installation” limits the types of piles allowed to be evaluated. There are multiple similarities between installing a steel combination wall and a steel sheet pile wall. Please allow for steel sheet piles to be utilized in the evaluation criteria.

10 RFP Part 1 page

(1) (i) Our firm has executed upwards of 180 contracts for NAVFAC and delivered over $100m of marine construction projects, several of which were performed under the role of Prime Subcontractor and managed as if the Prime. If the experience and evaluated performance is considerable, will the Government please allow Offerors to submit relevant experience performed as a Subcontractor?

Bid per RFP

11 RFP Part 1 page

(1) (i) Factor 1, Corporate Experience defines a relevant project primarily by wharf or pier structure construction. Given that this project also features a significant landside building, sitework and utilities scope, would the Government please allow projects that feature the Offerors capability to perform the landside complexity elements required by the contract? We believe expertise in these areas will benefit the Government’s balanced evaluation of the Offerors and resulting successful execution of the project.

12 RFP Part 1 page

(1) (i) Factor 1, Corporate Experience states that the project shall have a final construction cost of $50,000,000 or greater. The Sources Sought that was issued on July 26, 2021, stated a value of $25,000,000 or greater.

Strategies and teaming arrangements were created based on this supplied information. Please consider changing the final construction cost value back to the $25,000,000.

Refer to Amendment 0001;

Summary of changes.

41 Section 00 22

Page 7 The Total Price for CLIN 0001 as described on Page 7, instructs the bidder to exclude CLIN 0001P from this total. On page 3 of 7 of the Solicitation Section 00 10 00, it instructs the bidder to list the total amount for CLIN 0001. Shall this total also exclude CLIN 0001P or shall it include it?

Please see revised Attachment H - Price Proposal Form. Line Item for additional costs associated with transportation and disposal of the dredged material identified in CLIN 0001O at an approved upland landfill has been deleted.

49 Form 1442 Due to the size and complexity of this project, the coordination efforts required and preparation of both the "Price" and "Non-Price" proposals, we respectfully request an extension to the bid date of 5 weeks. This would still allow submission before the Christmas holiday while allowing more time to complete a thorough and responsive bid. We respectfully request a reply to this as soon as possible so that we can plan accordingly rather than notifying of an extension when the bid date is much closer.

Bid per RFP - any future changes to the submission date will be addressed via subsequent amendment.

65 N4008521R0219 Page 43 FAR Clause 52.222-34 Project Labor Agreement is incorporated by reference. Our understanding of this clause requires the Contractor to negotiate and enter into a Project Labor Agreement with organized labor unions. Please confirm.

Please see Amendment 0001, Summary of Changes

66 N4008521R0219 Page 8 Regarding bid submission, would NAVFAC allow flash drives in lieu of CD-ROM?

Bid Per RFP

73 N4008521R0219 Page 20 Regarding the requirement that bids be delivered by Express Mail only, We respectfully request an alternative delivery method be offered such as hand delivery or electronic upload. We are concerned Express mail delivery may require us to mail out bid out a couple days before the bid due date and may impact our opportunity to review subcontractor proposals that are often received the day before or morning of the bid due date.

Bid Per RFP

74 N4008521R0219 Page 11 Regarding the requirements for Factor 1, a large and important aspect of this project involves a lot of upland work, utilities and Building work, evidenced by Factor 2's requirement to speak to the "complexity of the USB construction and cleanliness control of systems during construction". It would appear to benefit the Client if bidders include a company that is very experienced in this upland and utility scope on its team due to the importance of it. However, Factor 1 is written to only allow submission of projects that must include construction of wharf or pier structures and contain installation of piling from a crane barge.

Furthermore, there is a sentence that states the following: "Offerors who fail to submit relevant experience for all Joint Venture members may be rated lower". To allow for teams who have strategically decided to partner with companies who specialize in the type of building and utility work required for this project not to be penalized because their partner cannot submit a Factor 1

Bid Per RFP

Experience form that meets the requirements, we respectfully request that the Factor 1 requirements be modified to allow for acceptance of a Factor 1 project that contains building and utility work that does not contain the marine elements as long as the other partners on the team are able to meet the Factor 1 requirements collectively as currently written.

75 N4008521R0219 General Regarding the proposal submission documents required, for newly formed Joint Ventures, some of these documents would not exist or no data would be available. In these cases, should the bidder submit individual data for each of its members? Please describe how the Government would like to see this information.

Offerors proposing as a JV shall submit a signed JV agreement.

For 8(a) Mentor-Protégé Joint Ventures, the offeror shall submit the signed and U.S.

Small Business Administration (SBA) approved Mentor- Protégé agreement.

77 12 of 73 of RFP Factor 2 1.a Is it acceptable to reference one or more relevant projects in the Non- Price Proposal Work Plan that do not meet all Corporate Experience criteria and are not shown on Work History Forms?

Bid per RFP

78 8 of 73 of RFP F.3 Amendment 0001 documents 1-4 do not have an amendment acknowledgement form. Is submission of an acknowledgement form for this Amendment required?

Offerors shall acknowledge each SF30 Amendment issued to the Solicitation. In accordance with the Solicitation, Basis of Evaluation and Submittal Requirements for Each Factor, (a) Price, (1) Solicitation Submittal Requirements, All submissions shall include the following:

Completed SF 1442 signed with all amendments acknowledged;

79 9 of 73 of RFP F.3.2 Company maintains confidentiality of its financial statements from company employees. Can the financial statements be omitted from the electronic CD ROM copy of the price proposal and sent via secure email ahead of the bid day instead?

See Amendment 0001, Summary of Changes

80 Structure Plans N/A Will reinforcing steel bar charts be provided so an accurate takeoff of the rebar can be performed?

Bill of Materials (BOM) and/or schedules for concrete reinforcing steel will not be provided. Contractor shall quantify reinforcing steel based on all applicable details provided in the Contract Documents.

86 N4008521R0219 Page 16 Regarding the PPQs for Factor 4, if the Contractor has PPQs completed already from other NAVFAC pursuits, may these PPQs be accepted rather than having them completed again for this project?

Please advise.

Offerors are permitted to provide copies of previously completed Past Performance Questionnaires (PPQs) in their proposal.
