About this file

This justification and approval document outlines brand name requirements for work items under a solicitation for the regular overhaul and dry-docking of the USNS SUPPLY. The Navy requires original equipment manufacturers or authorized representatives for work involving cargo transfer indicator sensors, line shaft bearings, ship service diesel generators, capstan controllers, gyrocompasses, rigid hull inflatable boat davits and boats, and an oily water separator. Statutory authority permits restricting competition due to proprietary rights and safety risks from using non-OEM parts or service. The solicitation will be posted on SAM.gov seeking a fixed-price contract for the availability, requiring offerors to use the specified OEM vendors as subcontractors for the identified work items.

J&A No. N10420R4051

JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

AMENDED

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) - Norfolk.

2. Description of the Action Being Approved: This is a brand name justification and approval (J&A) for work to be provided by Government-mandated subcontractors under the Work Items (WIs) listed below of the Statement of Work (SOW) for the Regular Overhaul (ROH)/Dry-Dock (DD) of the USNS SUPPLY (T-

AOE 6) under RFP N3220520R4051. This J&A covers only the portion of the acquisition which is brand-name and the approval level requirements will then only apply to that portion. Authority to act under this

J&A expires on 04 November 2020.

Work Items (WI)

0125 - CARGO TLI SYSTEM SENSOR INSTALL

0201 - LINE SHAFT BEARINGS OPEN AND INSPECT

0310 - SSDG TOP END OVHL (20,000 HR)

0315 - CAPSTAN CONTROLLER OVERHAUL AND REPAIR

0415 - GYRO COMPASS AND REPEATER GROOM

0504 - PORT AND STBD RHIB DAVIT INSPECTION

0505 - PORT AND STBD RHIB INSPECTION

0552 - STEERING AND RUDDER INDICATING CHECKS

0555 - INSTALL OILY WATER SEPARATOR (OWS) UNIT (T-ALT 301)

0907 - CATHELCO PROTECTION SYSTEM PREVENTATIVE MAINTENANCE

3. Description of Supplies/Services: MSC Norfolk requires Original Equipment Manufacturer (OEM) authorized technical field service representatives and OEM parts to accomplish the requirements of the above mentioned WIs for the ship critical safety items during the 96-day ROH/DD availability. The estimated dollar value of the above WIs is , which will be funded utilizing FY20/FY21

Operations & Maintenance funds.

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c) (1), Only

One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a).

5. Rationale Justifying Use of Cited Authority:

a. WI 0125 - CARGO TLI SYSTEM SENSOR INSTALL

A representative from Naval Automation Group (NAG) Inc. is required for installation of the T-ALT.

NAG is the OEM and sole proprietor of the TLI system. The use of a non OEM authorized vender could result in improper assembly and calibration, which will result in unneeded work and repositioning of the sensors.

b. WI 0201 - LINE SHAFT BEARINGS OPEN AND INSPECT

A representative from American Metal Bearing (AMB) is required for the inspection of the Ship’s Line

Shaft bearings. AMB is the OEM and has restrictive rights to modification and fitment of the line shaft bearings. It is an unacceptable risk to have an unapproved technical representative for the ship’s line shaft bearings. The use of a non OEM authorized vender could result in improper assembly and catastrophic bearing failure resulting in personnel injury and loss of asset.

c. WI 0310 - SSDG TOP END OVHL (20,000 HR)

Caterpillar is the OEM for the Ship Service Diesel Generator (SSDG). Only Caterpillar Technical

Representatives or authorized licensees have the knowledge and equipment to properly refurbish and maintain the SSDG. OEM parts are required for all critical equipment onboard T-AOE class ships. Proper refurbishment and maintenance of the SSDG and is critical to the safe operation of the ship. Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

d. WI 0315 - CAPSTAN CONTROLLER OVERHAUL AND REPAIR

Proper knowledge and skill from the OEM is required to satisfactorily perform the Capstan inspections, checks and repairs. There are no authorized representatives for Appleton Marine, Inc. The safe operation of the capstan is critical, and Appleton owns the proprietary rights to the equipment Capstan

Model AMD-698 drawings and technical data. OEM Appleton The contractor must provide the services of an Appleton OEM Representative during the inspection, assembly and test of the Capstans.

e. WI 0415 - GYRO COMPASS AND REPEATER GROOM

WI 0552 - STEERING AND RUDDER INDICATING CHECKS

Northrop Grumman/Sperry Marine (NGC) is the OEM for the Gyro Compass system. Both Sperry and

Nav Systems, Inc. possess the qualifications needed to maintain, troubleshoot and service the gyrocompass system. Each has the technical data and knowledge required to repair, maintain, and adjust settings of the

Gyro Compass and associated equipment. This is a business proprietary design with zero authorized users.

The Steering Gear and Gyrocompass are both included in the Military Sealift Command COMSCINST

4490.1A, List of OEM and Non OEM Use Policy. This policy is a command directive that identifies venders that are authorized to work on Critical Ship Systems and Equipment.

f. WI 504 RHIB DAVIT OVERHAUL AND CERTIFICATION

Allied Systems is the OEM of the RHIB Boat Davit. Allied has proprietary rights to the technical data, to provide changes, upgrades, parts, and perform engineering services on the RHIB Davit. Improper repairs by a non-OEM provider could result in improper parts and service and a degraded functionality that could incapacitate the davit and result in the loss of mandatory rescue services required for helicopter operations.

Proper upgrade, parts, and maintenance of the RHIB Davit is critical to the safe operations of the USNS

SUPPLY, T-AOE-6. SMS Number 10.6-002-ALL lists all Lifeboats, Rescue Boats, Davits, and

Accommodation Ladders as critical equipment.

g. WI 0505 - PORT AND STBD RHIB INSPECTION

Willard Marine is the OEM of the RHIB Boats. Allied has proprietary rights to the technical data, to perform the Annual inspection and complete all inventories, testing, and certifications of the Rigid Hull

Inflatable Boat (RHIB) Rescue Boats to meet Safety of Life At Sea (SOLAS) Chapter III requirements.

Proper repair and maintenance are critical to the safe operations of the rescue boats, and SMS Number

10.6-002-ALL lists all Lifeboats, Rescue Boats, Davits, and Accommodation Ladders as critical equipment.

h. WI 0555 - INSTALL OILY WATER SEPARATOR (OWS) UNIT (T-ALT 301)

Alfa Laval is the OEM for the newly installed OWS. The OEM is required for system installation and initial start-up and operations, and they have no authorized representatives. Alfa Laval’s proprietary design and operation makes the use of non-OEM parts incompatible with the form, fit and function of the installed system. The use of other than OEM parts and service would not guarantee proper operation of the

OWS and would violate the manufacturer’s warranty. Additionally, the use of non-OEM parts that cause an OWS system failure would result in an overboard discharge of more than 5ppm of oil content, which is in direct violation of USCG, EPA and ABS requirements and would present a hazard to the environment and navigation. The OEM will have access to material and proprietary technical data necessary to ensure proper installation and operation.

i. WI 0907 - CATHELCO PROTECTION SYSTEM PM

The OEM for the vessel’s marine growth inhibitor anodes is Cathelco; Cathelco has numerous vendors to provide OEM parts and service to their equipment. Vendor is required to provide parts and proprietary technical data/drawings only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, and crew safety, therefore precluding consideration of a product manufactured by another company.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The Government intends to post a synopsis and a Request for Proposal (RFP) at the Government Point of Entry, beta.SAM website, with the intent of awarding a firm-fixed-price contract for the/ROH/DD availability to the lowest price offeror. Any prospective contractor will be required to use the OEM or OEM authorized vendor(s) as a subcontractor to perform the work in the related Work Items. The Government is not procuring these parts or services directly. The potential offeror may propose an alternate OEM Vendor capable of performing the work, which will be reviewed during the Technical Review of the Source Selection Process.

7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A is fair and reasonable in accordance with

FAR Part 15.404-1.

8. Actions to Removed Barriers to Future Competition: For reasons set forth in Paragraph 5, MSC has no plans at this time to allow prime contractors to solicit these requirements competitively, other than synopsizing the requirements. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
