About this file
This file consists of three cost-related attachments for an Indefinite-Delivery/Indefinite-Quantity (ID/IQ) Small Business Environmental Remedial Action Contract (SBRAC VI) for sites in Hawaii, Guam, and other Naval Facilities Engineering Systems Command Pacific area locations.
Attachment J.3 establishes the indirect ceiling rates and fee application framework, requiring offerors to submit separate rate sheets for the prime contractor, each joint venture member, and each cost-reimbursable subcontractor. The indirect rate pools include fringe benefits, home overhead, field overhead, and general and administrative costs, with allocation bases tied to direct labor and total cost input. Offerors must propose both their estimated indirect rates for pricing and maximum ceiling rates for each contract period (Base Year, Option Years 1-4, and Service Extension), not to exceed 7.0% fixed fee. The government will incorporate these ceiling rates into the awarded contract as maximum allowable rates, with any costs exceeding the ceiling deemed unallowable unless authorized by the Contracting Officer. Attachment J.4 requires offerors to document the proposed distribution of work as a percentage breakdown among the prime, joint venture members, and cost-reimbursable subcontractors, reconciling to the cost model summary. Attachment J.6 provides an alternative format for offerors unable to complete J.3, requiring submission of historical indirect rates for the latest three complete fiscal years and current year-to-date rates, which must reconcile to the proposed and ceiling rates submitted in J.3.

Note 1 - A separate rate sheet shall be submitted for the prime, each joint venture member, and each cost reimbursable subcontractor. If the Offeror is a JV and the JV partners are proposing separate rates, separate rate sheets must be provided by each member. One submittal may be submitted for the JV entity, only if the JV has an established separate cost center for the JV entity with an adequate accounting system for a cost reimbursement contract. The indirect rate ceilings will be incorporated into the awarded contract. The Government will not accept discounted indirect rates. The offeror may adjust the columns or rows to be consistent with its cost accounting system.
Note 2 - Indirect rate pools and allocation bases listed above are EXAMPLES ONLY. Offeror shall list indirect rate pools and allocation bases consistent with its estimating/accounting system.
Note 3 - Offerors (Prime, each JV member, each cost reimbursable subcontractor) shall enter their proposed indirect rates utilized in pricing of the proposal.
Note 4 - The Government is seeking to establish maximum or ceiling rates for the Prime, each JV member, each cost reimbursable subcontractor. Offerors should identify their proposed ceiling rates applicable to the various contract periods. The indirect rates as detailed in this Attachment J.3 will be incorporated into the contract and will establish ceiling rates for the Contractor’s indirect rate pools. Any amount incurred by the Contractor above the ceiling rate shall be unallowable unless otherwise authorized by the Contracting Officer. The ceiling rates represent the maximum indirect rates that may be charged on any effort performed under the contract. Should actual indirect rates experienced during performance of the contract be lower than those shown on this Attachment J.3, the actual rates will be charged.
Note 5 - The proposed Fixed Fee Percentage shall be effective for the Base Year, all subsequent Option Years, and the Service Extension. The Fixed Fee Percentage (%) shall remain constant, shall not fluctuate from period to period, and shall not exceed 7.0%. Fixed Fee shall not be applied to Equipment (Contractor – Acquired Property), Travel, Facilities Capital Cost of Money, and Fee on Cost Reimbursable Subcontractor’s cost at any tier.
