The Employer agrees to contribute toward the premium payment of such insurance in the amount of five dollars and sixty-two cents ($5.62) per compensated hour per employee. Contributions will be made and benefits provided on an individual employee, not an average cost, basis.

If the Employer's contribution equals more than the total premium amount(s) owed for an employee, such overages, at the sole discretion of the Employer, shall be allocated to cash payments each pay period or that employee's 401(k) plan with the Employer, subject to the terms and conditions of such plans.

ARTICLE XXVII SICK LEAVE PROVISION

SECTION 1. Employees (shall accrue one (1) day of sick leave for each month of service from the date of hire. This means that sick hours are vested and available for use after the end of each month.

For example, sick hours earned during the month of October, are available for use as of November 1st. One day of sick leave is equivalent to the number of hours an employee regularly works. For employees who work an irregular schedule of weekly hours (OCE’s) which is dependent upon workload, sick leave shall be figured on the basis of the hours worked each week (pro rata basis) in the previous twelve (12) months of employment.

SECTION 2. At the site supervisor’s discretion, they may request to utilize OCEs to cover FT employees’ absences in the case of vacation, sick, medical leave, jury duty, and other absence, as agreed to by signatories to this agreement.

SECTION 3. An employee may use paid sick leave for an absence resulting from the following:

• The Employee’s own physical or mental illness, injury, or medical condition;

• Obtaining diagnosis care or preventative care from a health care provider by the

Employee;

• Caring for the Employee’s family member with a physical or mental illness, injury, or medical condition or for obtaining diagnosis care or preventative care from a health care provider by the family member, or the family member is otherwise in need of care;

• Domestic violence, sexual assault, or stalking, where the Employee or a family member is a victim, including to obtain counseling, seek relocation, seek assistance from a victim services organization, or take legal action.

For purposes of this section, “family member” shall include the Employee’s child, parent, spouse, domestic partner, or any other individual related by blood or affinity whose close association with the Employee is the equivalent of a family relationship.

SECTION 4. Upon termination, each employee shall be paid in one lump sum all of his/her unused sick leave up to 12 days, provided that in the event of a voluntary quit, the employees gives the Company two (2) weeks written notice of his /her intention to quit.

SECTION 5. The Parties acknowledge that Executive Order 13706 requires that employers to allow up to 56 hours of unused sick leave to carryover from one year to the next. Since this Agreement provides sick leave in number of days, rather than number of hours, the Union and Employer agree that up to a maximum of eight (8) unused sick days may be carried over from one year to next depending on the number of hours an employee regular works. The actual number of days carried over will be determined by dividing 56 by the number of hours an employee typically works in a day. For example, if an employee regularly works seven (7) hours a day, the employee may carry over up to eight (8) days of unused sick leave. An employee who regularly works eight

(8) hours a day may carry over up to seven (7) days of unused sick leave. Employees may not use more than 12 days of sick leave in any anniversary year. All other accrued sick days must be used within the calendar year. There will be NO payout of sick days year to year. The only exception is in the contractor’s final month of the contract. The accrued sick day for the final year’s final month will be paid out since the employees would otherwise not have the chance to utilize it.

SECTION 6.

Sick leave may be used in a minimum of one (1) hour increments. Employees will receive regular pay and benefits when using paid sick leave, but Employees will not continue to earn additional paid sick leave during that time. If the need for leave is for preventative care or is otherwise foreseeable, the Employee is encouraged to make reasonable efforts to schedule absences so as not to unduly disrupt operations. When an Employee wants to use accrued paid sick leave and the reason for the absence is foreseeable, the Employee must request the leave at least 7 calendar days in advance of the absence. When the need for the absence is not foreseeable, Employees must request to use accrued paid sick leave as soon as practicable, which in most cases should be at least 2 hours before the start of the Employee’s shift. If an Employee with accrued paid sick leave takes leave under the Family and Medical Leave Act policy, all accrued paid sick leave must be used before leave is unpaid. Paid sick leave will run concurrently with Family and Medical Leave. When an Employee is absent for 3 or more consecutive full days, the employee must provide certification or documentation from a health care provider. Engaging in fraud in connection with paid sick leave, personal leave, and/or obtaining paid sick leave under false pretenses may result in discipline up to and including termination of employment.

The Company agrees to pay on behalf of each employee an amount as outlined in Addendum "A" per compensated hour into a money accumulation Retirement 401k Plan which will provide for purchase of a guaranteed annuity. In the event that the Government expressly directs the removal, discipline or reassignment of a contract employee, the Company agrees to cooperate with the Union by providing it with all relevant information.

SECTION 3. It is recognized and acknowledged that the work performed under this Agreement is being performed at a Government military center, and it is therefore essential and expected that all employees will act in a manner appropriate to such an environment. It is further recognized and acknowledged that the Government imposes specific requirements concerning the manner in which the work under this Agreement is to be performed, and it is essential and expected that all employees comply with such requirements.

ARTICLE XXXI DISCIPLINE

The Union and the Company recognize and agree that the following offenses are examples, though not all inclusive, of serious conduct that constitute just cause for immediate discharge without the need for any prior progressive disciplinary action:

Disciplinary action does not need to be for the same offense. Probationary employees shall not be able to grieve or arbitrate any disciplinary action or discharge.
