About this file
This is a Living Wage Certification Submittal document for the City of Austin, Texas, applicable to Invitation for Bid (IFB) 7800 MLJ1046 for bulk motor fuels and fuel-related products and services. The document establishes compliance requirements under the City of Austin Living Wage Program Rule R161-17.14, mandating that all contractor employees and subcontractors directly assigned to the contract be compensated at a minimum wage rate of $22.15 per hour. Contractors must submit a certification with their bid that includes a comprehensive list of all employees and subcontractors assigned to the contract, including employee names and job titles. The City requires individual Employee Certifications to be submitted within 30 days of contract execution, with annual renewal certifications due on the contract's anniversary date. Any changes in assigned personnel must be reported to the City Contract Manager as they occur.
The contractor must maintain employment and wage documentation in accordance with Fair Labor Standards Act requirements and permit the City to review employee records to verify compliance with the living wage provision. Violations of the living wage requirement, including failure to pay the minimum rate or fraudulent statements on the certification, may result in daily compensation deficits owed to affected employees, contract termination for cause, suspension or debarment of the contractor, or legal action. The contractor must certify that all current and future employees assigned to the contract will receive minimum compensation of $22.15 per hour and agrees not to retaliate against employees reporting non-compliance.
