# RFP Ref. Question/Comment Response Amend # 157 Question 41 & 60 Are BOEs to be submitted only when the offeror does not use the
Government’s labor categories and FTEs?
Discussion—updates to Questions 41 and 60 say that “Any BOE will be part of the Cost Volume.” The SOWs and the pricing templates specify in detail the labor categories for each task order, and the number of FTEs in each. We are presuming the reference to BOE means a BOE that explains why a particular position is necessary and how much time that position needs to devote to the task. There seems no need for an offeror to submit a BOE if the offeror intends to price the labor categories and FTEs as listed by the Government.

The BOE references refer to the basis of an offeror’s direct labor rates, indirect rates, and proposed hours (offeror’s may calculate a man-year differently than the government’s assumption of 1880).

158 L4.3 Are the BOEs being referred to the same as the substantiation of direct labor rates described in L4.3?
Discussion—updates to Questions 41 and 60 explain that “Any BOE will be part of the Cost Volume.” The SOWs and the pricing templates specify in detail the labor categories for each task order, and the number of FTEs in each. There does not seem a need to justify the labor category or the FTEs, only the direct labor rate being used for the position.
The BOE references refer to the basis of an offeror’s direct labor rates, indirect rates, and proposed hours (offeror’s may calculate a man-year differently than the government’s assumption of 1880). Regarding labor categories, if the Government labor category detailed in the Attachment 3 is not the same as the labor category used by the offeror’s company, map the Government labor category based on the required qualifications and experience level to the labor category used by your company. In addition, provide the labor category title used by your company.

159 L4.5 What substantiation is the offeror required to provide for subcontractor FFP/T&M fully loaded rates? We read L4.5 as requiring only a cost or price analysis of the subcontractors’ rates, and not Attachment 3? Is this correct?
Discussion—L4.5 says the prime has the subcontractor submit Attachment 3 when the prime cannot determine reasonableness of the subcontractors FFP or T&M fully loaded rates. If the prime can determine reasonableness and does provide the cost or price analyses, it does not appear that Attachment 3 needs to be filled out by the subcontractors. However an earlier sentence in L4.5 says the offeror will provide the same level of detail for subcontractors as required of the prime. L3.4 says the offeror and any subcontractors shall submit detailed substantiation for all direct labor rates for which there is no available FPRA.
The Offeror may submit the subcontractor's fully loaded labor rate if they can provide support for the prime's determination of price reasonableness for the FFP/T&M labor rate. If the Prime cannot determine the reasonableness of the proposed subcontractor rates, then the buildup of the rates is required. Otherwise, they may submit the fully loaded labor rate on Attach 3.

160 L1.4 How long does it take for mail to be delivered from the Joint Mail Screening Facility to the Command Mailroom?
Discussion—the answer to question 106 says packages are date/time stamped when they reach the Command Mailroom. The answer to Question 107 says mail and packages received through commercial carriers and the USPS is screened at the Joint Mail Screening Facility prior to being delivered to the Command Mailroom. Can the Government clarify how much time offerors should allow for the Screening facility to deliver our proposals to the Mailroom where the proposal will be time/date stamped?
All mail delivered to the JMSF is delivered to Command on the same day. No mail or packages are stored or held overnight in the JMSF.

161 L4.6 Can the Government clarify whether offerors are to indicate a max fee?
And if so, are offerors to write it into the cost volume, as there is no place on Attachment 3 for it?
Discussion—the clarification to answer 63 says the requirement to propose a max fee for future task orders will be removed. However, L4.6 says “the proposed fee will become the maximum allowable fee on all future task orders. For task orders 1-3, the Offeror may elect to propose a lower fee. The fee per Task Orders 1-3 will be input on the Tab 2.”
The max fee language was inadvertently left in the language of Amendment 0001. Amendment 0002 will revise L4.6 as follows:
L4.6 Fee. IAW FAR 15.404-4(c) For other cost-plus-fixed-fee contracts, the fee shall not exceed 10 percent of the contract’s estimated cost, excluding fee. The fee per Task Orders 1 – 3 will be input on the Tab 2.
162 General If an unpopulated joint venture (JV) is established to be the small business prime, will SOCOM/SORDAC treat the individual members’ past performance as the JV’s past performance?
SOCOM will evaluate individual joint venture member’s past performance as part of the Past Performance assessment.
N/A
163 General Will the facility clearance (FCL) of the managing member of an unpopulated JV be viewed as the JV’s FCL?
No. An FCL is required for the JV . And SOCOM’s understanding is that each of the joint venturers needs to have an FCL in order to receive an FCL for the JV.

164 SF1408 Is it acceptable to submit the completed form and provide instructions on how to access the supporting documentation via a company sponsored, secure web-site? Many companies maintain records, policies, and procedures electronically and extracts from those records are considered uncontrolled copies. Providing support data via a secure web-site would ensure that data is protected and easier to find and retrieve.
