QUESTIONS AND ANSWERS
RFP FA8530-08-R-21758
27 Feb 08 Question: In amendment 007 to the RFP dated 22 February 2008, the previous amendment to clause H-910 was not included in this amendment. Does the Government intend to issue an amendment to include this change? In addition, the change to H-910 in amendment 006 only addressed situations where a critical subcontractor from one prime could be added to another prime’s team after contract award. Would a successful prime be able to join another team as a subcontractor without the same restriction?
Answer: The clause will be changed to reflect all changes in the conformed copy of the RFP forthcoming. If a successful prime wishes to join another team as a subcontractor after award, the rates that were accepted from the contractor as a prime will be incorporated as the rates utilized by that contractor acting as a subcontractor.
Question: Reference L-900(2)(F)(I): Would the government explain "only the most recent contracts ongoing/completed shall be listed"? Is it the most recent by date of award? or expiration date? Is it supposed to list FAST contracts if you are a subcontractor or the most recent no matter what the contract type? What does "total scope of work" mean in regards to this requirement?
Answer: The paragraph refers to the most recent contract performed which involved subcontractor management with no stipulation on recency applying to award date or expiration date. That is left to the judgment of the offeror. They should be the most recent regardless of contract type. Total scope of work refers to the total scope of the offeror’s efforts.
Question: Q&A on 25 Feb 08 indicates that an FPRA will not be accepted by the government in lieu of a Disclosure Statement. Amendment 7, paragraph g. (2) i., page 18 of 30, specifies that if a bidder proposes the same labor rate for all levels of a specific labor category in order to be compliant with their Government approved accounting system and/or Government approved Disclosure Statement, they must submit a copy of the portion(s) of their Government approved Disclosure Statement that requires such rates. What evidence that such rates are compliant with a Government approved accounting system will the government accept? Does the government require evidence that a composite rate for all labor categories is compliant with a Government approved accounting system or Government approved Disclosure Statement? If so, what evidence will be accepted by the government as compliant with a Government approved accounting system? In the event a bidder is a small business and has composite rates either for all labor categories, or all levels within a specific labor category, and is exempt from CAS (per 48 CFR.9903.201-1), what evidence will the government accept as being compliant with a Government approved accounting system?
Answer: It is anticipated that all rates will be submitted in accordance with the terms of the RFP and that composite rates for levels within a specific labor category will not be submitted; instead, a discrete rate for each level and each labor category is expected. If a contractor must submit a composite rate in order to be in compliance with their Government approved Disclosure Statement, a copy of the relevant portions of that statement must be provided in order to explain submittal of a composite rate. Therefore only a copy of the applicable portions of the Disclosure Statement will suffice as evidence that the contractor is proposing in the manner in which they are proposing (i.e. submittal of composite rates) in order to be compliant with their Disclosure Statement.
