SPECIAL CONDITIONS
1. SCOPE OF WORK. The work to be performed under the terms of this contract consist of furnishing all plant, labor, tools, transportation, travel, equipment, materials (Except Government– furnished materials) and any other incidentals necessary for the execution of painting and application of protective coatings, pavement markings applicable to existing roads, existing parking lots, existing aircraft runway and taxiways provide protective coating for Real Property and improvement thereto for Tinker Air Force Base.
Work within the scope of this contract includes, but is not limited to, the following:
- Maintenance management
- Quality control
- Requisition materials
- Prep and paint facilities exteriors
- Prep and paint facilities interiors
- Repair or remove existing wall coverings and base cove material
- Install wall coverings and base cove material
- Remove/Install corner guards
- Remove/Install chair rail or wood trim
- Remove damaged gypsum board and install Contractor furnished gypsum board
- Remove/Apply Thermoplastic (lead free) Markings from streets and parking lots
- Remove/Apply traffic paint to airfield, street, and parking lot markings
- Layout and paint handicap parking spaces, striping or markings
- Apply Glass spheres to airfield, ramp areas, street, storage locations and parking lots markings when required
- Remove and Dispose of Lead Base Paint
- Prep and Paint Miscellaneous Structures and Equipment (i.e. fire hydrants, pipes, signs, sign posts, swimming pools, tennis courts, interior and exterior tanks, and exterior water towers)
- Paint metal, chain link, or wood fencing
- Prepare surfaces to receive new coating (i.e. tape, spackle, seal surface for moisture/smoke damage, texture, plaster)
- Paint line graphics and stencils
- Pressure washing/water blasting for cleaning only (To include loose or spalling paint)
- Shot Blasting
- Sandblasting
- Chemical paint removal
- Brick Staining
- Scarify
- Caulk different surfaces
- Apply different types of floors coatings (i.e epoxy/urethane, high build performance coatings, moisture barriers)
- Minor repair of material (as part of surface prep)
- Stain, varnish, seal or cover various materials
- Other work as contained within
Protective coating shall be applied to, but not limited to, wood, metal, concrete, wall panels, acoustical tiles and grid, or other various man-made materials. MILITARY FAMILY HOUSING
UNITS/STRUCTURES ARE NOT INCLUDED IN THIS SCOPE OF WORK.
1.2 LOCATION OF WORK. All work covered by this contract will be accomplished for Tinker
Air Force Base, Oklahoma, approximately eight (8) miles southeast of downtown Oklahoma City, Oklahoma.
1.3 ORDERING PROCEDURES.
1.3.1 As the need exist for performance under the terms of this contract, the Contracting Officer
(CO) or his/her authorized representative will furnish a written Request For Proposal (RFP) to the
Contractor prior to commencement of any work on an existing requirement (after receiving requirements package from the Civil Engineer Technical Representative, 72 ABW/CE).
1.3.2 The Work Order, at a minimum, will indicate a Work Order Number, type of work offered, date and time of request or initiation, date work is required to be complete, description of work including existing paint, surface preparation, paint hazard test and paint to be applied and location of work, as applicable.
1.3.3 Upon receipt of the RFP, the Contractor shall respond as follows:
1.3.3.1 Visit the proposed work site with the Contracting Officer and/or his/her Technical
Representative for the Contracting Officer (TRCO) authorized representative.
1.3.3.2 Establish verbal contact with the CO or TRCO to further define the scope of the requirement. The Contractor shall, while on the site, take all measurements (field verify) and make written notes as to the instructions and verbal information given during the initial site visit. The
Contractor shall be responsible for providing all measuring equipment, ladders, etc., needed to verify sizes of buildings.
1.3.3.3 Time for submittal of the Contractor’s proposal for individual requirements will be as agreed upon by the government and the Contractor based on urgency of the requirements, as defined or established during initial planning. In the absence of an agreement, the written proposal shall be provided in writing, within one (1) workday for emergency request; three (3) workdays for urgent request; and ten (10) workdays for routine request from receipt of RFP.
1.3.3.4 The Contractor’s proposal must be supported by necessary documentation to indicate that adequate engineering and planning to accomplish the requirements has been accomplished.
1.3.3.5 Upon receipt of the Contractor’s proposal, the government will review the proposal for completeness. In the event the proposal requires negotiations, the Contractor shall submit a revised proposal based on the negotiations within a mutual agreed upon time frame based on the urgency of the requirement.
1.3.3.6 After the quantities, cost, and period of performance are negotiated, the Contractor shall be issued a individual Delivery Order (DO). The Contractor shall complete all work After Receipt of
Order (ARO) or receipt of Notice to Proceed (NTP) within the performance period specified on the
DO. This period includes all time required for submission and approval of submittals and for delivery of materials.
1.4 SCHEDULE OF WORK AND WORKLOAD.
1.4.1 Work Schedule. The Contractor shall submit a proposed work schedule. The schedule and work accomplishment shall be by DO and facility number. The Contractor’s work schedule shall be flexible to allow for minimal disruption of using agency’s mission in each facility.
1.4.2 This contract includes work in multiple use type facilities. The facilities may or may not be occupied when work is in progress; however, all work must be coordinated through the CO or
TRCO to cause minimal disruption of ongoing activities in occupied areas. The Government will advise of any known phasing or work hour situations for each DO. The Contractor may propose phasing plans as part of his or her proposal package as suited for the DO.
1.4.3 When specifically requested by the Government, the work shall, so far as practicable, be phased in defined sections or areas and confined to limited areas that shall be completed before work in other areas is begun. These areas shall be clearly defined in the Contractors proposed work schedule. Contractor personnel shall be limited to project locations.
1.4.4 Workload. The Contractor may be required to work multiple DOs simultaneously based upon customer requirements (i.e. end of year) and may have to complete work during other than normal duty hours to ensure minimal impact to Tinker AFB’s mission essential workload.
1.4.5. Communication. The Contractor shall keep the government informed of any changes in work schedule, environmental conditions (i.e. adverse weather conditions) or other conditions that could affect the contractor’s performance or completion of the delivery order.
1.5 FACTORS AFFECTING PERFORMANCE UNDER THE CONTRACT.
1.5.1 It shall be the Contractor’s responsibility to take whatever measures are necessary to ensure the protection of occupant’s assets, furnishings, vehicles, equipment, government property, etc.
The Contractor shall repair or replace damaged items as directed by the CO. Any damages to buildings, utilities, or equipment shall be repaired by skilled workman of the trade involved, at no additional cost to the Government IAW FAR Clause 52.237-2 (APR 1984), Protection of
Government Buildings, Equipment and Vegetation .
1.5.2 The Contractor shall keep all walks, entryways, doors and parking areas clear of materials and equipment. Approved fire lanes and egresses shall be kept open at all times as required by the
Government.
1.5.3 The Contractor shall protect all shrubbery against or near the building from being damaged or trampled on.
1.5.4 Materials or equipment temporarily removed to provide access to work shall be reinstalled in a workmanlike manner.
1.5.5 Contractor may utilize electrical power from existing outlets if it does not interfere or conflict with facility operations.
1.5.6 The Contractor shall cleanup work area around building at the end of each day.
1.5.7 All spoil, waste and debris removed from the work site and not specified for reuse or identified as salvageable items, shall become the responsibility of the Contractor and shall be disposed of off-base in areas authorized by the applicable county and/or state agencies and in accordance with current rules and regulations governing the disposal of solid waste.
1.5.7.1 Disposal of hazardous waste shall be in compliance with local, state and federal standards and coordinated with 72 ABW/CEA (Environmental). Disposal fees and sundry changes shall be paid by the Contractor. No government containers will be used. Do not allow accumulations inside or outside the buildings.
1.5.7.2 Safety. In the interest of occupational safety and health, the Contractor shall perform the work in accordance with U.S. Army Corps Of Engineers (USACE) EM 385-1-1 (2008, Change1-
2010; Changes 1- 3-2010, Changes 4-6 2011) Safety and Health Requirements Manual and
Attachment 2, Section 00 71 00 General Safety Requirements for Construction on Tinker Air
Force Base.
1.5.7.3 Except where specified in other sections, all materials and equipment removed, and not reused, shall become the property of the Contractor and shall be removed as stated. Title to materials resulting from demolition, and materials and equipment to be removed, is vested in the
Contractor upon approval by the Contracting officer of the Contractor's demolition and removal procedures, and authorization by the Contracting officer to begin demolition. The Government will not be responsible for the condition or loss of, or damage to, such property after notice to proceed. Materials and equipment shall not be viewed by prospective purchasers or sold on the site.
1.5.8 The Contractor shall post “Wet Paint” signs at access and egress areas of the building during painting operations.
1.5.9 The Contractor will not be responsible for moving any furnishings within any facilities. All items that cannot be removed will be protected by the Contractor.
1.5.10 The Contractor shall be responsible for having all instruments necessary for checking the moisture content of all surfaces.
1.5.11 Dust and Debris Control. The Contractor shall prevent the spread of dust and debris to occupied portions of the building. Avoid the creation of a nuisance or hazard in the surrounding area. Do not use water if it results in hazardous or objectionable conditions such as, but not limited to, ice, flooding, or pollution. Vacuum and dust the work area daily.
1.5.12 Utility Outages. The Contractor shall obtain written approval from the Civil Engineering
Directorate, Program Division/Engineering Branch (72ABW/CEPE) at least 21 days prior to performing work which will interrupt any utility service. Utility interruptions shall be scheduled only between the hours of 0800 and 1600 Monday through Friday, and shall not exceed six (6) hours duration at any one time. All outages shall be coordinated with 72 ABW/CE Civil
Engineering Directorate. All services shall be restored at the end of scheduled outage. Any damage to utilities or communication lines will be the responsibility of the Contractor at no cost to the Government.
1.5.13 Establishment of “Free-Zone”. When work under this Contract is to be accomplished in a controlled access area, the Government will establish a “Free-Zone” or will provide security escorts as required.
1.5.14 Security Force Protection Level Impact. Tinker AFB Security Forces may incorporate various ‘Force Protection’ levels which impact the ability of the Contractor to perform work. Force
Protection levels may vary from Alpha (the least restrictive) through Bravo and Charlie, to Delta
(most restrictive) depending upon current base-wide potential security threat. Access onto the Base may be limited during increased force protection levels, which may impact contract operations. All prudent measures will be implemented by the Contracting Officer to ensure continuity of contractor operations during the establishment of increased Force Protection levels.
1.5.15 Vehicular Traffic Delays. Any delay of vehicular traffic affected within pavement marking work area shall be limited to not more than15 minutes. The Contractor shall provide adequate safeguards, barricades, all necessary flagmen, and protective equipment to protect the public’s health and safety.
1.5.16 Traffic Control Devices: The Contractor shall be responsible for signaling, lighting, and providing barricades in the immediate work area conforming to the provisions of the Manual of
Uniform Traffic Control Devices (OSHA Standards 1926.201 and 1926.202). Contractor shall maintain traffic movement within at least one lane of traffic at all times at all streets, roads, and driveways unless otherwise directed by the Contracting Officer.
1.6 STORAGE AREAS.
1.6.1 Areas to be used for stockpiling of materials and equipment shall be approved by the
Contracting Officer prior to start of work.
1.6.2 The Contractor shall not store flammable materials (i.e., oil base paints and thinners) in any
Government facility without the written authorization of the Fire
Department and the Contracting Officer.
1.6.3 Delivery of materials and equipment shall be made with a minimum of interference to
Government operations and personnel.
1.7 PREPARATION. Preparation shall be performed before beginning any work. The
Contractor shall review contract requirements; assure that the authorization of intended use for all materials has been approved (Section 00 72 00, Paragraph 1.4); examine the work area; and assure the required materials are scheduled, or on hand and properly stored. The Contractor shall coordinate with the TRCO at least 24 hours in advance of such preparation.
1.8 WORKMANSHIP. All materials shall be installed in a workmanlike manner using labor skilled in each type of work and in accordance with the recommendations of each manufacturer’s instruction for application of product, as approved by the CO, to conform to the specifications of the DO.
1.9 MATERIAL SUBMITTALS.
1.9.1 Initially, within ten (10) days after "Contract Award," the Contractor shall furnish four (4) bound copies of the Material Specification Sheets and Material Safety Data Sheets, for each product that will be used during the course of the contract. All the material submittals from the same specification section shall be submitted at the same time. Submittal requirements indicated on each AF Form 3000 shall be limited to an individual specification section and not grouped with others of different sections. If the submittal requirement is listed on the drawings, all material submittals of like work shall be submitted simultaneously and with all corresponding specification sections. Failure to submit all material submittals at the same time will be cause for rejection.
1.9.2 The Contractor shall submit work plans, samples, brochures, manufacturer’s data, shop drawings and/or certificates of materials, if needed, to the CO (in accordance with contract and individual delivery order specifications) for approval prior to their installation utilizing AF Form
3000 (The CO or TRCO will provide the Contractor with "Material Approval Submittal" Form AF
3000). If the material submittals provided are in variance from the contract requirements, the
Contractor shall describe such variations in writing at the time of submission and request a variance. Failure to provide such notification will not relieve the Contractor from his responsibility of meeting the contract specifications regardless of whether or not the submittal is approved by the
Government.
1.9.3 The above list of submittals comprises major items. This does not relieve the Contractor of the responsibility of submitting all items within these specifications to be used during each individual DO.
1.9.4 The Contractor shall ensure all requirements of Section 1200, Environmental Controls and applicable paragraphs of Section 00 72 00 are met prior to work being performed on each DO.
1.10 UTILITIES CONSERVATION.
1.10.1 The Contractor shall instruct employees in utilities conservation practices. The Contractor shall be responsible for operating under conditions which preclude the waste of utilities, which shall include:
1.10.2 Lights shall be used only in areas where and when work is actually being performed.
1.10.3 Mechanical equipment controls for heating, ventilation, and air conditioning systems shall not be adjusted by the workers.
1.10.4 Water faucets or valves shall be turned off after the required usage has been accomplished.
1.10.5 Government telephones shall not be used for personal reasons or for any toll or long distance calls.
1.10.6 The Government will supply reasonable amounts of electricity for lights and hand tools.
Contractor shall furnish his own welding facilities.
1.10.7 All requests to connect to Government utilities must be submitted in writing to the
Contracting Officer a minimum of seven (7) days in advance of need and shall be approved before connections are made.
1.10.8 Contractor shall be responsible for actual hook-up of utilities at points designated and shall remove same after completion of his work.
1.10.9 Any damage to utility connections shall be repaired at the Contractor’s expense.
1.11 UNFORESEEN BASE/BUILDING CLOSURES.
1.11.1 When unforeseen base/building closure occurs on a regularly scheduled day of work, the
Government shall have the following options:
1.11.2 Suspension of work and/or subsequent modification of appropriate order, or
1.11.3 Total or Partial Termination for Convenience.
1.11.4 When possible, the Contractor will be notified of any upcoming base/building closure a minimum of twenty-four (24) hours in advance.
2. GENERAL PROJECT COMPLETION REQUIREMENTS.
2.1 FINAL INSPECTION.
2.1.1 The Contractor shall complete all DO work requirements including notification of completion, inspection and correction of deficiencies, prior to the performance period completion date or as otherwise determined by the CO. The Contractor shall request a final inspection to the
CO. The Contractor shall participate in the final inspection along with the Government technical representative, the using organization, the CO and other organizations such as Base Safety, 72 Air
Base Wing (ABW)/SEG and Base Fire Prevention, 72 ABW/CEF. During the inspection, the
Contractor and Government will mutually determine minor items remaining for completion and list the items on the “Punch List.” The Contractor shall correct any discrepancies noted on the
Punch List.
2.1.2 The CO reserves the right to decline the Contractor’s request for a final inspection or suspend a final inspection when it is evident that the Contractor is not ready for the inspection.
2.2 PAYMENT.
2.2.1 Payment to the Contractor will not be made until the Government accepts the work.
2.2.2 Invoices shall cite the Contract Number and DO Number. Each DO shall be invoiced separately. The Contractor shall not receive Partial Payments unless a written and approved contract progress schedule was required. Partial payments shall be accompanied by a written and approved progress report.
2.3. WARRANTIES.
2.3.1 Warranties shall not commence until the Government has accepted the project either as a whole or as in part. The Contractor shall warrant that work performed under this contract and any resultant DO, conforms to the contract requirements and is free of any defect in material or workmanship performed by the Contractor or sub-contractor or supplier at any time.
2.3.2 The Contractor shall complete all warranty work to the complete satisfaction of the CO IAW the applicable specifications. If the Contractor fails to honor warranty requirements (including making temporary repairs if necessary), the Government may remedy the deficiency, failure, defect or damage at the Contractor’s expense.
2.3.3 The Contractor shall provide one (1) year material and workmanship warranties for each individual DO, in addition to any other manufacturer warranties required. The Contractor shall warrant that all work performed under this contract conforms to all contract requirements; is free of any defect in material or workmanship performed by the Contractor and any sub-contractor or supplier, regardless of tier. This warranty shall not limit the Government’s rights under FAR
52.246-12, Inspection of Construction, with respect to latent defects, gross mistakes or fraud.
3. GENERAL CONTRACT INFORMATION.
3.1 PERSONNEL.
3.1.1 The Contractor shall provide a Project Manager who shall be responsible for the performance of the work. The name of this person and an Alternate(s) who shall act for the
Contractor when the Contractor and Project Manager are absent shall be designated in writing to the Contracting Officer.
3.1.2 The Project Manager or Alternate shall be available during normal duty hours and anytime crews are working on base. The Project Manager or alternate shall be physically available within sixty (60) minutes to meet on the installation with the Contracting Officer or the TRCO. The
Project Manager or Alternate shall have and wear an operational, "Power-On" communication device (i.e. "beeper," pager, or cellular phone). Contractor's communication device shall be compatible with the Government's telephone system.
3.1.3 The Contractor shall not employ any person or persons under this contract, whose continued employment is identified as a potential threat to the health, safety, security, general welfare, or operational mission of the installation and its population.
3.1.4 Contractor personnel shall present a neat appearance and be easily recognized by wearing distinctive clothing or by wearing appropriate badges which contain the company name and employee name.
3.1.5 The Contractor shall not employ any person who is an employee of the United State
Government, if the employment of that person would create a conflict of interest.
3.1.6 The Contractor shall obtain an AFMC Form 496, "Request for Identification Credentials,” to be signed by the Contracting Officer and taken to Pass & ID (Bldg 6612), for issue of a
Contractor's badge, AFMC Form 87, "Identification Credentials." Renewal of Identification
Credentials is required annually. (See Attachment 1, Section 00 70 00, General Requirements for
Construction on Tinker AFB, paragraph 1.3.1).
3.1.7 The Contractor must obtain favorable National Agency Check investigations in accordance with AFI 31-501, Personnel Security Program Management, for employees who require entrance to restricted areas. Contractor shall furnish an inventory list of all personnel issued accountable controlled area badges no later than 30 June for year of the contract in accordance with AFJ 131-
102, Physical Security.
3.1.8. The Contractor shall ensure all required training and certifications identified in the SOW are complete and have sufficient personnel with the applicable required training and certifications in their employ prior to work being started on each DO.
3.2 VEHICLE OPERATION.
3.2.1 Contractor's vehicles shall have the name of the Contractor's company clearly exhibited on each side. All motor vehicles driven by Contractor's personnel shall be maintained in a mechanically satisfactory condition, present a neat and clean appearance, insured, and registered in accordance with base regulations and Oklahoma law.
3.2.2 Airfield Vehicle Warning Lights. All Contractors’ vehicles used on Tinker airfield shall have flashing or rotating “amber” color warning lights before being allowed to operate on the active airfield. The lights shall be in accordance with OC-ALC-TAFBI-13-202, Par 3.2.12.
(Airfield Driving Program)
3.2.3 Airfield Training. All Contractors, subcontractor, supplier, etc. personnel operating any type of motor vehicle, equipment, or machinery shall be briefed on proper airfield driving procedures by one of the Contractor’s employees who have attended the Airfield Vehicle Operations class given by Airfield Management Personnel prior to being allowed on the airfield or ramp.
3.2.4 Communication. The Contractor shall provide a trained and qualified radio operator that is responsible for all movement of the Contractor’s personnel and equipment while in the vicinity of the airfield. The radio operator must be capable of conducting clear and concise communications by two-way radio with Tinker Ground Control and all other required radio communications. The radio operator must be responsive to all requests made by Government personnel concerning airfield movements and shall have the authority to act accordingly. The radio operator shall have no other duties while operating the radio. The Contractor radio operator shall be required to attend a one-day briefing provided by the Base Operations at Building 240 before being allowed on the airfield. When the Contractor’s operations require the radio operator to be separated from the work crews, the Contractor shall provide suitable two-way FM radios to provide communications between the radio operator and work crews. At no time shall the Contractor conduct airfield operations without the radio operator on site. The radio operator shall check in with Base
Operations, B240, obtain a radio at the beginning of each work shift, and return it at the end of the shift.
3.2.5 Pavement Marking Equipment. All machines, tools and equipment used in the performance of the work shall be approved and maintained in satisfactory operating condition. Equipment operating on roads and runways will display low speed traffic markings and traffic warning lights.
The equipment to apply paint to pavements shall be a self-propelled or mobile-drawn airless spraying machine with suitable arrangements of atomizing nozzles and controls to obtain the specified results as listed in Specification Section 03200, “Pavement Markings.”
3.2.6 Traffic Controls. Contractor shall provide adequate traffic controls as indicated in
Specification Section 03200, “Pavement Markings.”
3.3 TRANSPORTATION. Designated on-base bus route service will be available for Contractor use (Bus service shall not be used to transport materials or equipment).
3.4 PUBLICATION/FORMS.
All work under this contract shall comply with the most current Local, Air Force and United States
(US) regulations to include any subsequent updates as they occur. The latest edition of building codes, regulations, standards, and technical specifications shall be followed for all painting and , and materials under this contract. All required Air Force Forms used in the execution of this
Contract shall be provided by the Civil Engineer Technical Representative. The Contractor shall be responsible for obtaining any other Air Force regulations, instructions, manuals, and other directives as referenced herein. Civil Engineering Directorate (72 ABW/CE) will not be providing copies of said documents. See Section 01300, “Codes, Regulations, Standards and Technical
Specifications” for additional information.
3.4.1 Unified Facility Guide Specifications (UFGS). The following Unified Facility Criteria
(UFC) specifications listed below have been modified and are considered part of this SOW. The
Contractor shall use the most current editions of the Air Force approved Unified Facility Guide
Specifications that are not specifically incorporated into this statement of work. These guide specifications are available at: http://www.wbdg.org/ccb/browse_org.php?o=70 .

3.4.4 All the above publications, either incorporated by reference or attached, are considered as mandatory compliance requirements to this SOW. Where similar requirements conflict among the
UFCs, other DOD documents, referenced codes, standards, or publications, select the appropriate requirement as follows:
3.4.4.1 When a UFC specifically states that it shall take precedence, or where requirements of the referenced codes or standards are modified by a UFC, the UFC shall take precedence.
3.4.4.2 In all other cases, the most stringent requirement shall apply.
3.5 GOVERNMENT FURNISHED MATERIAL.
3.5.1 Government provided wall covering or sisal will be made available, when applicable, to the
Contractor for installation.
3.5.2 When applicable, the Government furnished applicable base cove will be made available for the Contractor for installation.

3.5.4 The Contractor shall be authorized to use any available Class A, B, or C fire extinguishers at any work site in case of any emergency situation.
3.6 EMERGENCY MEDICAL SERVICE. The Government will provide emergency medical treatment and emergency patient transportation service for Contractor personnel. The Contractor shall reimburse the Government for the cost of medical treatment and patient transportation service at the current in-patient treatment rate.
3.7 QUALITY CONTROL (QC). The Contractor shall develop, implement and maintain a quality control plan to ensure contracted services are performed IAW this SOW. Contractor shall make the Plan available for Government review within two (2) workdays of request. Contractor shall develop and implement the plan with procedures that will encompass all requirements of this
SOW and individual DOs. The QC plan should include procedures to identify, correct and ensure non-recurrence of defective services. The QC plan shall also identify the role of the QC manager and shall include the ability to amend the QC plan to identify unique requirements associated with individual delivery orders.

SECTION 01200
ENVIRONMENTAL CONTROLS
GENERAL REQUIREMENTS.
Contractor shall provide at his/her own expense, refuse containers at project sites to accommodate all empty paint containers, used tools, and other refuse generated by the contractor during performance of work. Containers shall be emptied as required. Containers shall not be allowed to overflow so that materials may blow around during inclement weather. Trash, debris, refuse, garbage, used paint, or thinner/solvents shall be removed from individual job sites on a daily basis.
Government dumpsters located throughout Tinker AFB shall not be used for disposal of refuse from work generated under this contract.
1. WASTE DISPOSAL. Refuse shall be legally disposed of off Tinker AFB at the Contractor's expense. Contractor shall provide the name of the company who shall be providing refuse collection services. The name, phone number and permit number of the landfill where disposal is to be made shall also be provided. The information shall be furnished to the Contracting Officer at the pre-performance conference and updated as changes occur, but at least annually. Contractor shall always recycle materials such as, but not limited to, cardboard, paper, and aluminum.
Contractor shall use whatever means necessary to store all recyclable materials and be responsible for turning such material over to the Base Recycle Center.
2. PRESENCE OF ASBESTOS-CONTAINING MATERIAL (ACM). If suspected asbestos containing materials (ACM) are encountered when performing the work described herein, the contractor shall notify the Contracting Officer and/or SCM. If a material sample is required to determine the presence of ACM, further work in the affected area will stop only at the direction of the Contracting Officer.
3. ENVIRONMENTAL INSPECTION. If at any time, an authorized environmental inspector feels that regulatory requirements listed above are not being followed, the inspector reserves the right to notify the Contracting Officer and recommend corrective action.
4. PRESENCE OF LEAD-BASED PAINT. This contract may encounter coated (painted) surfaces of materials which may contain lead exceeding acceptable levels associated with CFR
1926.62 ‘Safety and Health Regulations for Construction –Lead’. All suspect coating material shall be considered as lead-containing and incorporate special handling procedures as directed by
CFR 1926.62 unless tested by the contractor and proven otherwise. All costs associated with testing for determination of lead shall be borne by the contractor. Surface preparation of existing painted surfaces in support of new protective coatings shall include special handling procedures to mitigate the exposure of LBP during operations. Contractor is required to perform a ‘Paint Hazard
Test’ incorporating the Toxicity Characteristic Leaching Procedures (TCLP) For Metals’ criteria as described below in Para 9, ‘Waste Management’ for determination of LBP existence on all existing paint coatings where sanding, scraping or other destructive means are scheduled to be utilized in preparing an existing painted surface to receive new paint coating. Special handling procedures shall follow requirements of Federal Regulations 29 CFR 1926, (OSHA), (40 CFR 745 Subpart ‘L’
– Lead-Based Paint Activities) currently in place.
5. BANNED REFIGERANTS. Heating, ventilating and air conditioning equipment, which uses chlorofluorocarbon (CFC) refrigerants, are strictly prohibited. This includes, but is not limited to
R-11 (trichloromonofluorethane, R-12 (dichlorodifluoromethane), R-113
(trichlorotrifluoroethane), R-114 (dichlorodifluoromethane), R-115 (chloropentafluorethane), and all azeotropes of these refrigerants such as R-500.
6. HAZARDOUS WASTE. All hazardous wastes such as abrasive blasting media, chlorinated solvents, paint thinners, and fuels will be labeled and an inventory management system initiated to ensure timely removal and proper disposal. There will be no on-base disposal allowed, including use of sanitary, storm or industrial drains.
All drums must be labeled with a hazardous waste label. The proper DOT shipping name, UN or
NA, EPA waste number, generator information, and accumulation start date on the label shall be filled out. All drums used to store hazardous waste must be non-leaking and safe to handle. Drums that are rusty, dented, or leaking should be over-packed. Drums and/or over-packs shall be purchased by the Contractor. All drums purchased by the contractor must meet latest DOT specifications. Drums shall be stored in an area authorized by the 72 ABW/CEA. In general, the area must have a containment system and be secure. Area is subject to unannounced inspections by
72 ABW/CEA personnel. Drums filled with hazardous waste shall be inspected weekly for leaks.
Contractor shall fill out a generator's inspection checklist for each week the drums are in storage
(up to 90 days). All hazardous wastes removed from Tinker AFB shall be manifested. The manifest will be signed and approved by an authorized person from the 72 ABW/CEA Division.
Contractor shall call 72 ABW/CEA at least 24 hours in advance to obtain approval for manifest. A copy of the completed manifest must be received in the 72 ABW/CEA offices within 30 days after approval is obtained.
7. ENVIRONMENTAL TRAINING. The Contractor shall ensure all personnel are trained in
Hazard Communications and Hazardous Management at least annually
8. HAZARDOUS MATERIALS & RESTRICTIONS. The Contractor will store hazardous materials in accordance with Base Fire Prevention, Environmental, and Ground Safety policies.
The Contractor will request a semi-annual fire prevention inspection of his workplace by the Base
Fire Chief, if applicable. No acid batteries will be stored in any Government facility. When flammable materials or flammable wastes are being transferred between containers, the containers will be properly grounded. Mercurial fungicides shall not be used at any location on Tinker AFB.
9. CLEAN-UP. All waste materials generated by all work under this contract shall be handled, transported, stored, and disposed of off base by the Contractor and his Sub-Contractors at any time
IAW all applicable federal, state, or local codes, ordinances, regulations, court orders, or other types of rules or filings having the effect of law, including, but not limited to the following:

9.1.1 Federal Water Pollution Control Act (33 U.S.C. 1251 et seq.) [As Amended Through P.L.
107–303, November 27, 2002]
9.1.2 Clean Air Act, as amended, 42 USC Sec. 7401 et. seq.
9.1.3 Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act, as amended, 42 USC Sec. 6901 et. seq.
9.1.4 Federal Insecticide, Fungicide and Rodenticide Act, as amended, 7 USC Sec. 736, et. seq.
9.1.5 Endangered Species Act of 1973, as amended, 16 USC Sec. 153 et. seq.
9.1.6 Comprehensive Environmental Response, Compensation and Liability Act, as amended by the Superfund Amendments and Reauthorization Act, as amended 42 USC Sec 9601, et seq.
9.1.7 Federal Environmental Protection Agency guidelines on thermal processing and land disposal of solid waste (40 CFR 240 and 241).
If the Contractor or any of his Sub-Contractors creates oil or any other hazardous substance spill, they must implement initial notification procedures consistent with the installation's Oil and
Hazardous Substance Pollution Contingency Plan.
9.3 Spill containment and clean-up beyond the Contractor's ability will be arranged or accomplished by the Government. The Contractor shall reimburse the cost to the Government for the cleanup.
9.2 If the Contractor or any of his Sub-Contractors creates an oil or any other hazardous substance spill, they must implement initial notification procedures consistent with the installation's Oil and
Hazardous Substance Pollution Contingency Plan.
10. HAZARDOUS MATERIAL/WASTE MANAGEMENT. The Contractor will be briefed on
Tinker Air Force Base Hazardous Material/Waste Management Plan at the pre-performance conference.
10.1 Hazardous Material Handling. The Contractor shall have approval from the base Bio-
Environmental (BEE) and HAZMART sections prior to purchasing, handling, using, and storing any chemicals, solvents, lubricants, and other products that require MSDSs. The Contractor shall identify these materials and products on Air Force Form 3952, Chemical/Hazardous Material
Authorization Request, Process Identification Form, and Shop Disposal Form. The Contractor shall provide one copy of the MSDSs for each item to BEE and HAZMART sections for review prior to any chemicals being brought onto Tinker Air Force Base. The Contractor shall maintain one (1) copy of the MSDSs for each hazardous material item used within the Tinker AFB.
10.2. The Contractor shall maintain central hazardous materials storage and issue point per current directives. The Contractor shall provide one (1) copy of Material Safety Data Sheet (MSDS) to the
TRCO, one (1) copy to the CO and one (1) copy to the Tinker AFB Environmental Hazardous
Material Office (72ABW/CEA) on all first time purchases of hazardous items obtained through sources of supply, and approval shall be obtained prior to purchase.
10.3 The Contractor shall input request for Material Authorization via the Hazardous Materials
Management System (HMMS) or other designated Air Force approved chemical tracking system for Hazardous Material Request approval. The Contractor shall be given access to input all material into HMMS through 72 ABW/CEA. The Contractor shall receive material in HMMS and print hazardous material labels. The Contractor shall then post the receipt, make labels, and attach them to all materials. The Contractor shall track all hazardous material used through the HMMS.
(See Section 00 72 00, paragraph 1.4).
10.4 The Contractor shall not use products that are or contain Toxic 17 chemicals, Extremely
Hazardous Substances (EHS), Ozone Depleting Substances (ODS), and/or Persistent
Bioaccumulative and Toxic (PBT) chemicals. Any HM containing one of these banned substances will not be allowed on Tinker AFB.
10.5 The Contractor shall ensure all employees complete the local Air Force Hazardous
Communication, HAZMART, and hazardous waste training. The Contractor shall appoint a primary and alternate HAZMART and Hazardous Waste monitor. Monitors are responsible for training all Contractor personnel regarding hazardous material containers maintained within Tinker
Air Force Base and complete MSDSs immediately upon receipt of new chemicals, products, or materials. The Contractor shall submit MSDSs to HAZMART as required.

LEAD IN CONSTRUCTION
PART 1 GENERAL REQUIREMENTS
1.1 SECTION SUMMARY.
This specification covers the requirements for planning, removal, environmental protection, collection, testing, handling, transport, disposal, and the management of hazardous and non-hazardous debris generated from paint removal or disturbance activities. Air Force facilities contain buildings that have been painted multiple times with various types of paint. Paint may contain lead. Regulated metals from paint, paint chips, and dust can pose health hazards if not managed properly. During any demolition or paint activities that disturb known or assumed regulated metal-containing paint, the Contractor shall implement programs and procedures that comply with the requirements of this specification and all applicable Federal, state, and local standards and regulations, such as OSHA, DOT, FDEP, and EPA.
