Section M - Evaluation Factors for Award
Header Miscellaneous Text (Modified):
M-1 GENERAL INFORMATION
Basis of Contract Award M-1.0.
This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR) 15.3 and DoD Source Selection Procedures, as supplemented. In this procurement, the Government will determine best value based on an objective assessment and validation of the 2 Highest Technically Rated Offerors (2HTRO). Using 2HTRO, the highest 2 validated scores will be analyzed for price fairness and reasonableness in accordance with FAR 15.304.
If the offeror with the highest Government validated technical score also has the lowest price, the award is made to that offeror. However, if the second highest technically rated offeror has a lower price and their government validated technical score is within 10% of the highest rated offeror, then the award is made to the second highest offeror instead.
. EVALUATION METHODOLOGY AND FACTORS M-2.0
The basis of award will be a technically acceptable, 2 Highest Technically Rated Offeror (2HTRO). The Government will select the best overall Offeror based on results of an integrated assessment of the proposals and ratings of past experience.
- Factor 1. Technical Experience
- Factor 2. Technical Proposal and Qualifications
- Factor 3. Pricing
The Government will use 2HTRO to evaluate the two top highest self-rated offerors. Offers will be validated by the Government for self-rated scores through the Technical Experience (Factor 1) and will be evaluated by the Government for a Technically acceptable Technical Proposal and Qualifications (Factor 2). Then Price fairness and reasonableness (Factor 3) will be evaluated by evaluating Contractor's coefficients and Total Evaluated Price.
Once the Government has identified at least two awardable offers after evaluating and verifying Factor 1 and 2, the evaluation proceeds as follows. If the offeror with the highest Government validated technical score also has the lowest price, the award is made to that offeror. However, if the second highest technically rated offeror has a lower price and their government validated technical score is within 10% of the highest rated offeror, then the award is made to the second highest offeror instead.
Factor 1: Technical Experience M-2.1.
The Government will validate all technical experience for all six tabs as well as accompanying Contract Information Sheet/Attachment 45 and CPARS (or Past Performance Questionnaire/Attachment 3) corresponding to the self-scoring matrix. The Contract Information Sheets and CPARs will be provided by the Offeror. The validation will be completed by a verification team using the provided CPARS reports as well as an integrated assessment of any CPARS reports not included.
Recognizing that IDIQ SABER and MACC type contracts can either be assessed a CPAR on an annual basis for the base contract OR be assessed for a CPARs at the Task Order level, two distinct tabs, Tabs 1 & 2 for SABER and Tabs 3 & 4 for MACC/DB Contracts were created on the scoring sheet. Contractors are not permitted to request PPQs for work samples where CPARS evaluations already exist. If a contract is already rated annually in CPARS, a PPQ cannot be completed per task order.
Likewise, if a contract is already rated per task order in CPARS, a PPQ cannot be completed for an annual evaluation rating.
PPQs will only be counted in the scoring when no CPARS evaluations have been completed for the specific work sample. Attempts to receive multiple scores for the same project will be rejected and the score adjusted accordingly.
For the purpose of this Solicitation, a SABER (Simplified Acquisition of Base Engineer Contract Contract) is defined as:
-Element (1) The SABER needs to be a fixed price indefinite-delivery/indefinite-quantity (IDIQ) contract.
-Element (2) Design task orders and subsequent construction task orders based off those designs need to be in the scope of the IDIQ.
-Element (3) There is a unit price guide that is implemented, such as R.S Means or eGordian, that uses coefficients. (The pricing for designs are pre-priced).
-Element (4) The design and construction task orders must be carried out within the duration of the IDIQ. For the purpose of this Solicitation, a MACC (Multiple Award Construction Contract)/Design-Build is defined as:
-Element 1) IDIQ whose requirements are competed among a pool of multiple awardees based on work defined in individual task orders.
-Element 2) Work should consist of multiple disciplines in general construction categories. This may include the following: architectural, structural, civil, mechanical, electrical, fire protection or communications.
-Element 3) Contract involves DB which stands for Design-Build. Design-Build means combining design and construction in a single contract with one contractor.
If an Offeror makes unsupported or misleading claims in their past technical experience, the Government may find that their self-rated score is inflated. The Government reserves the right to lower the Offeror's score. Additionally, the Government reserves to right to identify additional work samples to be in accordance with Section M.2.3.5.
utilized in its evaluation of Past Performance.
The Government intends to run Integrity Reports through Contractor Performance Assessment Reporting System (CPARS) for all Offerors and finding are subject to deductions. The CPARS Integrity Report is a report run through CPARS.gov. Potential deductions will be found running UEI and Cage codes through the database. The Government reserves the right to deduct 15 points for issues found in the Integrity Reports, except for Terminations for Convenience. Points will be derogatory reports deducted for records that display "Yes" under the following categories: Administrative Agreements, Defective Pricing, DoD determination of Contractor Fault, Information on Trafficking in Persons, Material Failure to Comply with Closeout requirements, Non-Responsibility Determination, Recipient Not-Qualified Determination, Subcontractor Payments Issues, Termination for Cause, or Termination for Material Failure to Comply.
Only applicable construction projects will be used against the contractor. In other words, non-construction projects that do not fit the criteria for each category will not be used.
In conducting the Technical Experience verification evaluation, the Government reserves the right to use both the information provided in the Offeror's Past Performance proposal volume and information obtained from other sources such as the Contractor Performance Assessment Reporting System (CPARS) or similar systems, Defense Contract Management Agency (DCMA) and commercial sources.
The Government reserves to right to identify additional work samples to be utilized in its evaluation of Past Performance.
Factor 2: Technical Proposal and Qualifications M-2.2.
Technical Proposal and Qualifications will be evaluated by a technical evaluation team. Technical Proposal and Qualifications includes a technically acceptable Seed Project proposal (Subfactor 1), Quality Control Plan (Subfactor 2A), and Bonding Capability (Subfactor 2B). The technical evaluation team will evaluate all proposals on a as either Acceptable or Unacceptable. The minimum requirements for acceptability are:
Subfactor 1) Seed Project Proposal
An acceptable Seed Project (Subfactor 1) must meet all requirements in Section L 4.3.1 and Attachment 01/Statement of Work, (Section 1.4.11.2 Level 1 Design and Section 1.4.11.2.1 Drawings) for RKMF 240010- Repair Honor Guard Facility B10250. The Seed project Cost Proposal will be completed by using eGordian or software specified in the SABER Specifications.
Subfactor 2A) Quality Control Plan
An Acceptable Quality Control Plan (Subfactor 2A) must meet the requirements in Section L 4.3.2 and Attachment 01/Statement of Work (Section 1.25 Quality Control).
Subfactor 2B) Bonding Capability Information
Bonding Capability Information (Subfactor 2B) must meet the requirements in Section L 4.3.3. in order to be Acceptable.
Factor 3-Price M-2.3 The Government will evaluate Factor 3 by assessing the Contract using Attachment 2 - Price Schedule. A price analysis will be conducted IAW FAR15.404-1 to ensure a reasonable price has been proposed. The Government will analyze offers to determine if they are unbalanced with respect to prices for separately priced line items.
The Total Estimated Price (TEP) to the Government will be calculated by the cost team of the SSEB for each Offeror. The TEP will be identified by multiplying each coefficient or price proposed by the Offeror listed in the Section B per the Price Schedule/Attachment 2 by the estimated dollar amount or quantity assigned to each line item. All dollar totals will be added together for each annual period. All five years will be considered in determining the Offeror's aggregate price.
Evaluation Methodology M-3.0.
The Government will utilize a 2 Highest Technically Rated Offeror (2HTRO) methodology. M-3.1.
The 2HTRO methodology requires the Offeror to submit a self-rated score based on the objective criteria described in Section L. The Government will utilize 2HTRO with fair and reasonable price. The use of 2HTRO enables the Government to evaluate the (2) highest rated Offerors.
The Government plans to have three Steps to evaluate the three Factors. The Highest Rated Offerors will be evaluated. If either of the Highest Rated Offerors are found incorrect or unacceptable at any Step of the process, the proposal will be removed from consideration. The next highest will be evaluated in the place of the removed offeror(s).
- Step 1 -Verify Factor 1, Technical Experience
- Step 2 -Evaluate Factor 2, Technical Proposal and Qualifications
- Step 3 -Evaluate Factor 3, Price The Government plans to award without any discussions. However, if needed, the Government reserves the right to have discussions based on the PCO's decision at any step of the Evaluation process.
- Step 1- Verify Factor 1, Technical Experience M-3.2.1.
The Government will validate the top two ranked proposals to evaluate for Factor 1: Technical Experience. To qualify as the top two ranked proposals, Offeror's must have one of the two highest number of points on their self-scoring matrix. The Government will complete the verification process by checking each self-rated score on the Self Scoring Matrix. Verification will require the scores match the correlating work samples and CPARS provided by the Offeror in the proposal package.
If the Government is unable to find the supporting information within the referenced page, paragraph, table, etc., the Government may or may not reach out further for the substantiating information. The Government will unilaterally downward adjust the Offeror's self-rated score, potentially down to zero points. The Government may unilaterally downward adjust the Offeror's self-rated score if unsupported information is referenced. The Government will only adjust the Offeror's self-rated score downward, not upward. Such adjustments are within the sole discretion of the Government and are based upon the substantiation of the self-rated score provided by the Offeror.
The Government reserves the right to deduct 15 points for any issues found in the Integrity Reports. Points will be deducted for records that display "Yes" under the following categories: Administrative Agreements, Defective Pricing, DoD determination of Contractor Fault, Information on Trafficking in Persons, Material Failure to Comply with Closeout requirements, Non-Responsibility Determination, Recipient Not-Qualified Determination, Subcontractor Payments Issues, Termination for Cause, or Termination for Material Failure to Comply.
Only applicable construction projects will be used against the contractor. In other words, non-construction projects that do not fit the criteria for each category will not be used.
Since the scores can be deducted it is possible that one or both top two original Offeror proposals become lower than the other lower ranked self-scored proposals. If this happens, next highest self-scored proposal or proposals are evaluated.
Once two of the highest scores are validated by the Government, Factor 2 will be evaluated for those two Offerors.
- Step 2 - Evaluate Factor 2, Technical Proposal and Qualifications M-3.2.2.
In Step 2, the Government will evaluate Factor 2: Technical Proposal and Qualifications. This includes evaluating the top two proposals based on their Seed Project Proposal, Quality Control Plan, and Bonding Capability.
If both contractors meet the requirements and are considered technically acceptable in Step 2, the Government will move forward to Factor 3: Pricing and proceed to Step
3. However, if one or both proposals fail to meet the standards in any of the three subfactors: Seed Project Proposal, Quality Control Plan, or Bonding Capability, the process will revert to Step 1. At this point, any proposal deemed unacceptable may prompt the Contracting Officer to initiate discussions if necessary. However, the Contractor reserves the right to eliminate contractors from considerations when deemed appropriate.
- Step 3- Evaluate Factor 3, Price M-3.2.3.
The Government will review the top two validated Offerors that are technically acceptable and determine prices proposed are fair and reasonable using price analysis methods in accordance with FAR 15.404. Specifically, the prices for base contract will be evaluated. The Seed project will not be evaluated for price.
If either of the Offerors' prices are determined not fair and reasonable, the Government will return to Step 1 and evaluate the next highest validated Offeror. In the event of a tie between the 2 highest validated, technically acceptable proposals, the Government will award to the lower total evaluated proposal offering fair and reasonable pricing.
If the offeror with the highest Government validated technical score also has the lowest price, the award is made to that offeror. However, if the second highest technically rated offeror has a lower price and their government validated technical score is within 10% of the highest rated offeror, then the award is made to the second highest offeror instead.
The Government intends to award to one (1) Offeror who is validated as the highest technically rated, with a fair and reasonable evaluated price.
Number of Contracts to be Awarded M-3.3.
The Government intends to award to one (1) contract for the Nellis/Creech Simplified Acquisition of Base Engineer Requirements (SABER) as a HUBZone set-aside.
Rejection of Unrealistic Offers M -3.4.
The Government may reject any proposal that is evaluated to be unrealistic in terms of program commitments, including contract terms and conditions, or low in price when compared to Government estimate, such that the proposal is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the program. Offerors are required to meet all Solicitation requirements, such as terms and conditions, representations and certifications, and Statement of Work, in addition to those identified as factors. Failure to comply with the terms and conditions of the Solicitation may result in the Offeror being ineligible for Award.
The Government will not entertain any exceptions. In the case a discrepancy exists between Section L- Instructions to Offerors and Section M -Evaluation Factors for Award, the evaluation criteria in Section M - Evaluation Factors for Award will take precedence.
Discussions. The Government reserves the right to award without discussions and make award based on initial proposals but may conduct discussions if the M.4.
Government determines it to be necessary.
