Master List Question and Comment worksheet for the F-16 Aircraft Maintenance for Taiwan solicitation, FA3002-16-R-0005
| Question Number | Topic (Pricing, Technical, Past Performance, Other, & etc.) | RFP Reference | Question | Response |
| 20 Revised | Attachment 3, Wage Determination and Attachment 11, CBA | FAR 22.1008-2 | In order to meet the established legal obligations and to accurately estimate the actual costs and obligations incurred by successful offerors, would the Government please provide offerors with a seniority list of employees currently covered by the CBA or a distribution of seniority for each labor category noted in the solicitation? |
Additionally, offerors require the seniority list (or a distribution of seniority chart) to accurately calculate the number of support personnel needed to offset labor shortages created by annual vacation entitlement for staff (which vary by seniority of individual staff). The Government cannot compel the contractor to provide the requested information. In accordance with 29 CFR, Part 4, Subpart A, Section 4.6, Paragraph (l)(1) & (l)(2) as well as Executive Order 13495, the incumbent prime contractor is only required to submit to the Contracting Officer a certified list of the names of all service employees on the contractor's or subcontractor's payroll 10 days prior to completion of the contract (so that the information can be provided to the succeeding contractor). However, even then, the incumbent prime contractor is only required to provide this information when service employees are entitled to a right of first refusal (to work on the succeeding contract) or when service employees may be: A) retained in the performance of a succeeding contract and B) subject to a wage determination.
At this time, the incumbent contractor has only volunteered for public release the following seniority list information:
Years of Service Annual Entitlement Accrual:
0 to Five 5 years 2 weeks per year 3.08 hours per pay period 31% Five years (5) but less than ten (10) 3 weeks per year 4.62 hours per pay period 12% Ten (10) years or greater 4 weeks per year 6.15 hours per pay period 57%
| 28 Revised | RFB Section B | Item Reference: RFP Section B, Page Reference 22 of 145 | Since the Retrofit CLINs are identified as FFP, and the possible use of these CLINs is notional at a yet-to-be determined timeframe, does the Government intend for offerors to price and enter only a fully-burdened hourly rate as the “Unit Price” to be entered as the “MAX Net AMT” on each of these Retrofit CLINs, or does the Government intend for the amount priced and entered in the “MAX NET AMT” block on these Section B Retrofit CLINS to be the product of multiplying the offeror’s fully burdened rate times the Max Quantity of hours identified on each CLIN? | Amendment 05 will revise Section B by removing the Retrofit CLINS X0009 through X015. |
| 29 Revised | Since the Retrofit CLINs can be used only after a normal 8-hour shift has been expended, does the Government expect for the “fully burdened rate” applied to these CLINs to be calculated at an overtime rate per the applicable Collective Bargaining Agreement (CBA) or Area Wage Determination (AWD), or at a straight-time rate, with overtime premiums applied when these CLINs are exercised following Government authorization? | Amendment 05 will revise Section B by removing the Retorfit CLINS X0009 through X015. |
